Delta: Aniocha/Oshimili Constituency Seat:  Elumelu Accused Of Trying To Bribe Tribunal Judges

Ndudi Elumelu
By Akinwale Kasali
Ndudi Elumelu, People’s Democratic Party, PDP, House of Representatives candidate who lost the Aniocha/Oshimili Federal Constituency, Delta State, seat to Labour Party’s, LP, Ngozi Lawrence Okolie, has been accused of trying to induce members of the Election Petition Tribunal to rule in his favour.
The Tribunal Judges are Justice A.Z Musaa, Justice C.K Nwankwo and Chief Magistrate Khadijat and M. Ibrahim
The victory of the LP Candidate, according to political watchers in the state, surprised Elumelu, the Minority Leader in the 10th National Assembly.
Elumelu, they insist, is yet to accept defeat, and is now doing what he could to upturn Okolie’s victory, including allegedly bribing some officials of the INEC and the judiciary.
It would be recalled that Concerned constituents of Aniocha/Oshimili Federal Constituency in Delta had earlier raised alarm over alleged plot by Elumelu to compromise the Judges through financial inducement.
The group also alleged that the former Minority Leader is doing this even though he knows that he lost massively to Okolie.
Few months ago, President of Civil Rights Realisation and Advancement Network, CRRAN, Olu Omotayo, disclosed that  the Court of Appeal has, since the signing into law of the Electoral Act 2022 abundantly, established the issue of locus standi in matters relating to challenging the outcomes of the primary election of political parties.
Omotayo said  the Court of Appeal and the Supreme Court had also before the passage of the Electoral Act 2022 equally frowned on what he termed the busybody attitude of some political actors, who challenge the primary elections of parties other than their own
The lawyer and activist had said that although the lower courts appear to be divided on the subject, the Court of Appeal had through several recent verdicts shown that the nascent Electoral Act 2022 had not changed anything about who could challenge the processes leading up to as well as the conduct and outcome of primary elections of political parties.
He cited the January 5, 2023 decision of the Court of Appeal Port Harcourt Division in the case ABUEH & Others V. PDP & Others Suit No: CA/PH/557/2022, where the court held: “A political party is not allowed by extant Electoral Act, 2022 and the Constitution of the Federal Republic of Nigeria to sue another political party in a bid to challenge the nomination of the latter party’s candidates elected from primary election conducted by the latter political party and seeking to prevent the Independent National Electoral Commission (INEC) from acting on the list of candidates submitted to it by the political party sued”.
He also cited a January 23, 2023 decision of the Makurdi Division of the Court of Appeal in PDP & Others V. INEC & Others, Appeal No. CA/MK/PE/15/2022 where the Court was called upon to interpret  the cumulative effect of Sections 77(2) and (3), 82(1), (2) and (5); 84(1), (4)(a)-(c) and (13) of the Electoral Act, 2022.
Justice Biobele Georgewill, who read the appellate court’s judgement stated: “In the light of all I have stated above, it seems clear to me and I so firmly hold that by whatever canons of interpretation employed on the provisions and wordings of Section 285(14) (c) of the Constitution of Nigeria 1999 as amended it can neither accommodate nor confer any locus standi on one political party to challenge the internal affairs or planning, preparations and holding of the primary election of another political party.
“Simply put, the Appellants/Cross – Respondents, being PDP and its candidates for the House of Representatives in the 2023 General Elections lack the locus standi to challenge by way of instituting their Suit before the lower Court to challenge the planning, preparations and holding or even non holding of primary elections by the 2nd Respondent, APC”.
Furthermore, Omotayo referenced another Court of Appeal, Port Harcourt Division’s judgement of November 29, 2022 in the case of PDP V. INEC & OTHERS, Appeal No.CA/PH/480/2022 where the court went further to add that only aspirants, who participated in a primary, not just any member of a particular political party, could challenge the process of a primary election.
Delivering the judgment, Justice Gabriel Kolawole stated: “The appellant is a member of PDP not APC, and even if he is a member of the APC, he would have no locus to challenge the nomination of the 1st Respondent as he is not one of the Aspirants who participated in the primary election. In my view he is a meddlesome interloper who having assumed the position of hired mourner is crying more than the bereaved”.
The activist added that the decisions were in tandem with the verdicts of the Court of Appeal and the Supreme Court before the coming into force of the Electoral Act 2022, citing the Supreme Court in the Case Alhasan & Ano V. Ishaku & Others in SC.907/2015, which was delivered on January 8, 2016.
The Supreme Court held: “Only an aspirant at the primary election is permitted by Section 87(9) of the Electoral Act 2010 (as amended) to challenge the selection or nomination of a person for an elective office. Apart from an aspirant who took part in the primary election, no other person is authorized to file an action to challenge the selection or nomination of a candidate by a political party for an election.
“As I said earlier, the appellant is a member of the PDP, not APC and even if he is a member of the APC, he would have no locus to challenge the nomination of the 1st Respondent as he is not one of the aspirants who participated in the primary election.
“In my view, Appellant is a meddlesome interloper who, having assumed the role of a hired mourner, is crying more than the bereaved”.
Omotayo regretted a situation where the judiciary is bogged down by a plethora of litigations,  even on matters the Supreme Court has already made declarations,  urging politicians to play the game by the rules.

Ejikeme Joy Mmesoma

By Ayodele Oni

Following admission that she falsified her score in the Joint Admissions and Matriculation Board, (JAMB) Examination, the Management of Innoson Automobile Company, has withdrawn the N3 million scholarship awarded to Miss Mmesoma Ejikeme.

This was contained in a statement signed by Mr Cornel Osigwe, Head of Corporate Communications at Innoson Group, and made available to newsmen on Saturday in Onitsha.

This is just as Mmesoma’s father, Mr Romanus Ejikeme tendered an unreserved apology to Nigerians over the involvement of his daughter in such an act.

According to spokesman of Innoson Group, “In recent days, we have been involved in the process of investigating allegations surrounding the 2023 UTME examination results of one of our scholarship recipients, Miss Mmesoma Ejikeme.

“It was reported initially that Miss Joy scored exceptionally high on the exam, a feat that led to her being awarded a scholarship by our company.

“However, subsequent reports of discrepancies in her UTME score led us to seek clarification from the Joint Admissions and Matriculation Board (JAMB) and to allow her to voice her stance, we engaged in direct dialogue with Miss Joy.

“Further to this, a Committee set up by Governor Charles Soludo, carried out a thorough independent investigation into this matter.

“This conclusion is deeply disappointing and stands in direct contravention of the values we hold dear at Innoson Vehicles, particularly those that underscore our scholarship program.

“In line with these principles and response to the confirmed findings, we have made the difficult decision to withdraw the scholarship awarded to Miss Mmesoma Ejikeme.

“This action is a testament to our unyielding commitment to honesty, integrity, and merit-based recognition.”

He acknowledged that the development was regrettable, and it has undoubtedly caused dismay among those who stood by Miss Ejikeme.

Mr Ejikeme, Mmesoma father has tendered an unreserved apology to JAMB and Nigerians at large saying his daughter lied to him initially.

Mr Ejikeme had earlier accused JAMB of pulling his daughter down.

Mmesoma, a 19 year-old student of Anglican Girls Secondary School, Nnewi, inflated her Unified Tertiary Matriculation Examination organised by the Joint Admissions and Matriculation Board, JAMB, from 249 to 262 and claimed she obtained tye highest score in the country.

Her claim has been confirmed a brazen forgery.

Ezekwesili Backs JAMB On Three-year Ban For Mmesoma Ejikeme, Supports Counselling

By Ayodele Oni

A former Minister of Education, Oby Ezekwesili, has backed the three-year ban placed on Miss Mmesoma Ejikeme for forging her 2023 Unified Tertiary Matriculation Examination, UTME, conducted by the Joint Admissions and Matriculation Board, JAMB.

She, also, backed the recommendation by the committee set up by the Anambra State Government, that the candidate at the centre of the scam should go for counselling.

In a statement posted on her Twitter account on Saturday, the former Minister said that the embattled Anambra student, Ejikeme Mmesoma who was accused by the Joint Admissions and Matriculation Board, (JAMB) of forging her 2023 UTME results, deserved to be counselled and punished.

Ezekwesili said: “I have just read the report of the Committee set up by Anambra State Government to investigate and report their independent findings on the Mmesoma and JAMB saga.

“I am satisfied with the process and findings of their investigation which gave Mmesoma a fair hearing to enable the Committee gather all facts.

“It was necessary to have independent evidence that the result Mmesoma laid claim to publicly was not only fake but that the forgery was personally orchestrated by her.

“Therefore, I support the sanctions imposed by JAMB as a deterrent to all who participate in the systemic exam malpractices within our educational system.

“I also recommend sustained counseling for Mmesoma by the family, school and church to support her as she reflects on this tragic episode and makes a decision to embrace values and rewards of effort while eschewing dishonest gain for the rest of her life.”

Mmesoma, 19, had claimed she scored 362 marks, and vigorously laid claim to be the highest scorer in the 2023 UTME conducted by JAMB. But her criminal claim was exposed by JAMB which said she scored 249 and inflated it to 362.

“There are usually syndicates at the center of perpetration of exam malpractices in Nigeria, but it appears not to be so in Mmesoma’s case from the facts of the Committee’s report. Mmesoma’s action has consequences.”

Tinubu Will Soon Be Richer Than Dangote- Sowore

0

Omoyele Sowore, the Presidential candidate of the African Action Congress, AAC, says President Bola Ahmed Tinubu will soon become the richest man in the country.

He accused the president of planning to use a tax consulting firm linked to him to collect taxes on behalf of the federal government, in turn, the firm will collect some commission.

This will make the president richer than any other Nigerian, the human rights activist said during the recent Eid el Kabir celebrations get-together with the members of his party.

According to Bloomberg’s latest report, business mogul Aliko Dangote is Nigeria and Africa’s richest man with wealth estimated at over $15 billion.

Tinubu, a former Lagos governor has been accused of using a proxy tax collection firm Alpha Beta, to enrich himself, in and out of office, even though he denied the allegation.

After coming to office on May 29, 2023, President Tinubu has not let anyone in doubt that an effective tax system will be one of the policy thrusts of his administration.

On Friday, the president approved the establishment of a Presidential Committee on Fiscal Policy and Tax Reforms headed by Taiwo Oyedele, a foremost tax expert at PriceWaterhouseCoopers, PwC.

Sowore suggests that the president’s focus on taxation as the fulcrum of his government is for selfish reasons to make him rich, warning that Nigerians are becoming poorer every day as a result of the burden of taxation imposed by the administration.

According to him “The consultant they are bringing will be collecting the tax on behalf of Federal government and they are going to be collecting 10 percent from the taxes they collect on behalf of the Federal government.

“They would be the richest people in the world by the time Tinubu has done four years. Our position is unambiguous and unapologetic. This is not our government. We have accepted that our job is to liberate this country not to go and work for somebody and lose our focus and direction.”

Ejikeme Joy Mmesoma

By Ayodele Oni

A committee set up by the Anambra State Government on the controversy surrounding Ejikeme Joy Mmesoma Joint Admission and Matriculation Board, (JAMB) examination result has recommended that she tenders an unreserved written apology to JAMB.

She was equally asked to apologize to her School, Anglican Girls’ Secondary School, Uruagu Nnewi and the Anambra State Government with immediate effect.

The committee added that “EJikeme Joy Mmesoma should also undergo a psychological counselling and therapy.”

The recommendations followed discovery that Ejikeme actually falsified the mark which gave her the highest scorer in the just concluded JAMB conducted examination.

The committee was set up by the Anambra state government in the wake of conflicts reports on Ejikeme’s actual score in the examination.

The committee found out that “The results released by the Joint Admission and Matriculation Board (JAMB) with respect to the UTME score of Ejikeme Joy Mmesoma is 249.

“The results paraded by Ejikeme Joy Mmesoma with aggregate score of 362 is fake as buttressed by the very significant and instructive variations in the registration number, date of birth, centre name and other.

“Ejikeme Joy Mmesoma admitted that she manipulated the fake results herself, using her phone. The Principal Anglican Girls’ Secondary School – Mrs. Edu Uche and the Education Secretary, Diocese of Nnewi (Anglican Communion) expressed dismay at the conduct of Ejikeme Joy Mmesoma.

The report, which has been submitted to Governor Charles Soludo stated further that “The Committee invited Ejikeme Joy Mmesoma, the Principal of Anglican Girls’ Secondary School, and officials of JAMB for interactive session with the Committee.

“JAMB officials led by Dr. Fabian Benjamin, the Head Public Affairs presented the detailed processes and procedures involved in JAMB admissions, the policy changes that have occurred in the release of UTME scores since 2021 and what specifically transpired between the candidate – Ejikeme Joy Mmesoma with registration number: 20230639047FF in her quest to obtain her JAMB score.”

“I forged My JAMB Result”, Mmesoma Finally Confesses; School Principal, Anglican Diocese Shocked

By Akinwale Kasali

After the brickbats between  the Joint Admission Matriculation Board, JAMB, Anambra State Government, Human Rights Activists, Legal Activists, families and sympathizers of Mmesoma Ejikeme over her scores at the Unified Tertiary Matriculation Examination, UTME, the panel of inquiry set up by the Anambra State Government has confirmed that Mmesoma Ejikeme manipulated her UTME result, where she actually scored 249 as against the 362 she awarded herself.

In an eight-page report  the panel confirmed that the 19-year old manipulated her results. It recommended she should, with immediate effect,  tender an unreserved written apology to the Joint Admission and Matriculation Board, the school (Anglican Girls’ Secondary School, Uruagu Nnewi), and the State Government. She was also asked to undergo psychological counselling and therapy.

The eight-member panel was set up by the Anambra State Governor, Prof. Chukwuma Soludo, to investigate the ongoing controversy between the Joint Admissions and Matriculation Board and Mmesoma, whose UTME result came under scrutiny.

Mmesoma, a student of Anglican Girls Secondary School, Nnewi, had sat for the UTME in May and came under scrutiny for parading the “highest score” of 362, which JAMB later revealed was manipulated.

The panel report addressed to Governor Soludo and was disseminated by the State’s  Commissioner for Information, Sir Paul Nwosu.

The panel said it conducted interviews with relevant parties, including Mmesoma, JAMB officials and other individual(s) involved in the process as well as the Principal of Anglican Girls Secondary School.

According to the panel, Mmesoma had sent a request to JAMB with a different registration number showing a UTME result of an aggregate score of 362, with Eng: 98, Phy: 89, Bio: 94, and Che: 81 which differed substantially from the standard JAMB format where she got an appropriate rebuttal stating her real score of 249.

The panel indicated in its findings that “the results released by the JAMB with respect to the UTME score of Ejikeme Joy Mmesoma is 249.

“The result paraded by Ejikeme Joy Mmesoma with an aggregate score of 362 is fake as buttressed by the very significant and instructive variations in the registration number, date of birth, centre name and other infractions.

“Ejikeme Joy Mmesoma admitted that she manipulated the fake results herself, using her phone.

“The Principal, Anglican Girls’ Secondary School — Mrs Edu Uche and the Education Secretary, Diocese of Nnewi (Anglican Communion) expressed dismay at the conduct of Ejikeme Joy Mmesoma.”

The report, titled, “Report of the committee on Ejikeme Joy Mmesoma’s JAMB score controversy” also indicated that the candidate was well informed of her correct score of 249.

It read in part, “Recall, Mr Governor, that with the recent release of scores of candidates who applied for admission by the JAMB and subsequent announcement of Nkechiyere Umeh as the candidate with the highest score of 360, Ejikeme Joy Mmesoma, a 19-year-old student of Anglican Girls’ Secondary School, Uruagu Nnewi, from Enugu State, protested to the State Government that she scored 362 and ought to have been so recognised.

“This has elicited interest and generated serious controversy and misgivings among the general public that the state government in its wisdom decided to constitute a committee of inquiry to look into the under-listed terms of reference; review Ejikeme Joy Mmesoma’s JAMB results and associated documents.

“Conduct interviews with relevant parties, including Mmesoma, JAMB officials and any other individual(s) involved in the process. Provide recommendations based on the findings of the investigation.

The committee invited Mmesoma, the Principal of Anglican Girls’ Secondary School, and officials of JAMB for an interactive session with the Committee.

“JAMB officials led by Dr Fabian Benjamin, the Head of Public Affairs presented the detailed processes and procedures involved in JAMB admissions, the policy changes that have occurred in the release of UTME scores since 2021 and what specifically transpired between the candidate Ejikeme Joy Mmesoma with registration number: 20230639047FF in her quest to obtain her JAMB score.

“JAMB revealed the different times that Ejikeme Joy Mmesoma made several requests to the JAMB portal asking for her results at different hours, and each of these times (four in number), she received in her phone, same results from JAMB indicating candidate’s UTME Results to Wit: Eng: 64, Phy:54, Bio: 74, Che: 57 with a total aggregate score of 249.

“JAMB disclosed that the candidate was well informed of her correct score. Mmesoma had sent a request to JAMB with a different registration number showing a UTME result of an aggregate score of 362, with Eng: 98, Phy: 89, Bio: 94, and Che: 81. The results she sent differed substantially from the standard JAMB format where she got an appropriate rebuttal stating her real score of 249.”

The panel also disclosed that a number of red flags were highlighted by JAMB officials showing a different date of birth, different Registration Number, and Notification of results template that has been discarded since 2021, amongst others.

“It was also evident that even the centre name ‘Nkemefuna Foundation (Thomas Chidoka Centre for Human Development as it was known before now) used for the examination was also manipulated where the candidate used the old name of the centre (Thomas Chidoka Centre for Human Development) in her own manipulated result sheet.

“In Ejikeme Joy Mmesoma’s submission, she owned up in the presence of her Principal, and the Education Secretary that the narration by the JAMB officials was a true and correct description of what transpired.

“She also admitted to having given a manipulated result by herself unaided, using the same phone Airtel Number.

“According to her, she proceeded to the cybercafé (Prisca Global Computers, Uruagu, Nnewi) where she printed the results she had manipulated.

“The Committee tried to find out the motive behind her action, but Ejikeme Joy Mmesoma said nothing.

“In their own submissions, the Principal Anglican Girls’ Secondary School, Uruagu, Nnewi, and the Education Secretary — Diocese of Nnewi (Anglican Communion) expressed shock at what transpired where in their presence, Mmesoma admitted to have manipulated her UTME results, deceiving the school, her immediate family and the state government.”

The panel commended JAMB for their diligent handling of the matter and the information supplied about the interface with the candidate.

“We hope that this unearthing of the truth as we have discovered will go a long way in correcting the sentiments, misconceptions and deceptions that have been in the public domain”.
