Why Appeal Court Sacked MC Oluomo As NURTW National President

The joy of Musiliu Akinsanya, popularly known as MC Oluomo, as the National President of the National Union of Road Transport Workers, NURTW, has been cut  short following his sack by the Court of Appeal.

The Court annulled his appointment, upholding  an earlier judgment from the National Industrial Court, which recognized Tajudeen Baruwa as the legitimate leader of the Union.

It would be recalled that the Southwest Zone of the NURTW elected MC Oluomo during the Quadrennial Delegate Conference in Osogbo, Osun State last week elected

Following the election, he took office at the Union’s headquarters in Abuja.

However, on Friday, the Appellate Court’s panel of three judges rejected the appeal filed by MC Oluomo’s faction.

The decision awarded a fine of ₦100,000 against the appellants and confirmed Tajudeen Baruwa’s re-election.

The judgment solidifies Baruwa’s position as the NURTW president, countering recent moves to replace him.

The judgement reads, “This is an appeal against the judgment/decision of the National Industrial Court Sitting in Abuja, in Suit No. NICN/ABJ/263/2023 delivered on the 11th March, 2024 by Justice O. O. Oyewumi.

“Upon Reading the Record of Appeal compiled and transmitted before this court together with the respective briefs of argument;

“And After Hearing, O. I. Olorundare, SAN with F.T Sotikare, esq) Jimoh Balogun, Esq O. D. Emole, Esq I. Yunanah Esq) for the Appellants.

Controversial Cross Dresser, Idris Olanrewaju Okuneye, with the moniker, Bobrisky, has filed a lawsuit  against the Economic and Financial Crimes Commission, EFCC, for allegedly violating his fundamental human rights.

The lawsuit seeks to enforce and protect his rights as guaranteed under the Nigerian Constitution and the African Charter on Human and Peoples’ Rights.

In the lawsuit, Bobrisky claims that the EFCC summoned him for investigation based on a hearsay WhatsApp phone call published by Martins Vincent Otse, also known as VeryDarkMan.

He further alleged that the EFCC failed to investigate the authenticity of the recording, which led to his ridicule on social media, threats from unknown persons, and invasion of his privacy.

Bobrisky is seeking damages of ₦1 Billion against the EFCC for violating his right to fair hearing, privacy, and freedom from discrimination.

He is also seeking ₦200 million against the National Assembly for reckless reporting and failure to investigate the allegations properly.

The lawsuit highlights several grounds, including:

– Violation of Fundamental Rights: Bobrisky’s rights as guaranteed under the Nigerian Constitution and the African Charter on Human and Peoples’ Rights.

– Lack of Investigation: The EFCC’s failure to investigate the authenticity of the defamatory recording.

– Invasion of Privacy: The EFCC’s actions led to Bobrisky’s ridicule on social media and invasion of his privacy.

Denial of Right to Counsel: The EFCC refused Bobrisky’s right to counsel and examine witnesses.

Bobrisky also accused the EFCC and other security agencies of violating his human rights and acting above the law. The lawsuit is a significant step towards seeking justice and protecting his rights.

All Progressives Congress (APC) candidate in the ongoing Ondo State governorship election and incumbent Governor, Lucky Aiyedatiwa, has cast his vote.

Aiyedatiwa arrived at Polling Unit 5, Ugbo Ward 4, in Ilaje Local Government Area at around 8:40 a.m. and  voted at 8:50 a.m., expressing optimism about the seamless conduct of the electoral process.

Addressing journalists after casting his ballot, he commended the organisation and efficiency at the polling station, noting that the process was both orderly and transparent.

“It’s encouraging to see the exercise going smoothly here, I am hopeful that this is reflective of the experience across the state.”

The Governor also addressed concerns over accessibility for voters, urging that all eligible voters be granted a fair opportunity to exercise their democratic rights.

“I want to call on all officials and security personnel to ensure that every supporter and citizen is allowed to cast their vote freely and without obstruction.”

The governor praised security agencies for their effective handling of potential threats during the election process, highlighting that Ondo State remains one of the most peaceful states in Nigeria.

“We have consistently conducted peaceful elections over the years, and I am confident this one will be no different.”

He also commended the Independent National Electoral Commission (INEC), expressing confidence in the transparency of the process, acknowledging the timely arrival of officials at his polling unit.

The governor expressed confidence in the outcome, indicating his belief that his administration’s achievements over the past 10 months and its commitment to the people of Ondo State would resonate with voters.

The Nigerian Police is using drone to monitor the election round the state.

Ondo state command has assured electorate not to be scared when they sight the drone.

Doubles Salaries of all PAMO University Staff

A former Governor of Rivers State, Dr. Peter Odili, has commended Governor Siminalayi Fubara to high heavens.

Odili, regarded as the political godfather of Rivers State, having either produced or mentored, fully, most of those who are playing active politics in Rivers State of today, including Nyesom Wike, FCT Minister, Chibuike Amaechi, Celestine Omehia (all former Governors), spoke at the Fourth Convocation Ceremony of PAMO University of Medical Sciences, Port Harcourt which held on Friday, November 15, 2024.

Odili is the Founder and Pro-Chancellor of the University.

Applauding Fubara for keeping a level head in the face of difficult challenges, Odili said: “His Excellency, the Governor is a dogged fighter. He is resilient and has stood firm to govern. There is no Governor in Nigeria who has faced the challenges he has encountered.”

Responding to the economic situation in the country which has forced the Federal and State Government’s to increase the salaries of workers, Dr Odili increased the salary of every member of staff of the University by 100 per cent.

Odili: “I have the permission of the Chairman  of the Board to confirm and announce that in compliance with the minimum wage regulation, all staff salaries are doubled.”

Fubara, an estranged political godson of Wike, has been facing the fight of his political life since three months after he was sworn- in on May 29, 2024. Suddenly sworn political enemies, a number of attempts, including an aborted impeachment, has been made by Wike loyalists to frustrate Fubara’s Government. The most recent is the stoppage of the Federal Allocation to Rivers State, no thanks to a Court order granted by pro-Wike Rivers State House of Assembly members.

Incidentally, Odili and most of his political sons, which Wike was before now, a proud member, are behind the Governor.

Despite all the incentives through the provision of healthcare facilities by the Government, over 70 percent of Kano women still  prefer to give birth at home.

This is just as the nonchalant attitude of some healthcare workers has been adduced as one of  the factors for the  high rate of home deliveries .

At a one day talk shop on the advancement of  women health in Kano State held on Friday November 15, 2024,  in the ancient city, the State Commissioner for Health, Dr Abubakar Labaran Yusuf, noted that findings have shown that over 70% of women in the State also avoid ante natal services.

The situation, he lamented, has resulted in many of the women being exposed to many avoidable risks, including deaths  before, during, and after child birth.

Part of the problems associated with giving birth at home, Dr Yusuf stated,  is excessive bleeding which, in most cases, lead to avoidable death .

Similarly, he noted that the practice of avoiding antenatal and giving birth at home have worsened cases of mother to child transmission of diseases such as the HIV.

Dr Yusuf expressed regret that despite the State Government’s huge investments in the  healthcare sector, many women still prefer to give birth at home.

“This administration revived the free maternal and child health programmes to address these avoidable deaths, but only 30 percent of the women attend the free ante natal services.

“You only see them during complicated labour”, the Kano Health Commissioner lamented.

This negative attitude he maintained, has tended to place the lives of both mother and child at great risks both during, and after births.

Dr Yusuf noted that avoiding prenatal planning has been one of the major reasons for complications during birth, as well as the transmission of communicable diseases from mother to child.

According to him, rural women are more prone to the habit of avoiding antenatal services, a development which he blamed on the availability of limited access to healthcare facilities, as well as ignorance.

He blamed the high mortality rate in Kano and other Northern States on the twin problems of ignorance and the deliberate shunning of healthcare services by the majority of the women

Further speaking at the work shop put together by the Centre for Communication and Social Impact, CCSI, and Pathfinder International as part of the activities to create awareness and strengthen multi-level partnership in advancing women’s health in Kano, Dr Yusuf expressed concern over how unscrupulous workers connive with beneficiaries to steal free drugs.

He noted that more often than not, free drugs meant for patients have found their ways into the market through the activities of some saboteurs.

This ugly development, he insisted has combined to undermine Government’s efforts at improving healthcare delivery system in the State .

“A lot of people, both workers and the beneficiaries of the programme (free drugs in Kano) connive to steal the drugs which is a sort of depriving persons who really need the drugs from getting the services.

“This is one of the problems we are facing and we have succeeded greatly, but still there are some pockets of thefts in facilities.

However, despite the observed constraints, the Commissioner for Health stated that the Kano State Government has continued to take steps towards improving health facilities across the State.

This he noted, is in addition to the engagement of more health workers in the last one year for the purposes of reaching out to more people, especially the rural dwellers.

Police Apprehends Killers Of Enugu Market Chairman

Two suspected masterminds of the gruesome murder of Stephen Aniagu, the Chairman of the Ogbete Main Market Traders Association, OMMATA ,have been arrested by the Enugu State Police Command.

The late Aniagu was, early October, 2024, felled by assassin bullets, on the street of Enugu, the State Capital, while heading back home from his office after the day’s  activities.

The Source reports that following the public outrage that trailed the murder , Governor Peter Mbah, issued a 48 hour dateline for the security agencies to fish out the perpetrators .

A statement on Friday, November15, 2024, by the Enugu state police Command  spokesman, Daniel Ndukwe, DSP, said the arrest of the two suspects was a direct  consequence of  intelligence, driven and well coordinated efforts by the operatives of the Anti-Robbery Section ( D9) of the SCID and personnel of the Anti-Kidnapping Tactical Squad of the state Police Command.

The suspects were apprehended between Friday, November 8, and Saturday, November 9, while actively involved in another criminal operations in Akwuke, Awkunanaw in Enugu South Local Council of the State.

Ndukwe described the arrest of the suspected killers of the Market Chairman as a major milestone in the fight against crime and criminal activities in the State .

“The suspects include Chukwudi Aboshi, a-28 year old native of Anike in Ikwo Local Government Area of Ebonyi State and Ani Innocent Ebuka (a.k.a Excellent, a driver and native of Isigwe-Ugbawka in Nkanu East Local Government Area.

They were arrested in Akwuke Awkunanaw in Enugu South LGA of Enugu State .

During interrogation, both suspects confessed to their active involvement in the crime. They provided detailed accounts of how they attacked Mr Aniagu, snatched his vehicle, and similarly shot another male driver severally at the same location on the night of the murder and snatched his Toyota Corolla as well.

Fortunately, he is stable and undergoing treatment .

Furthermore, the suspects confessed to having committed several other crimes stating that their criminal camp was in a forest at Mmaku in Awgu LGA .

They also mentioned the following names- at large- as members of their criminal gang who were actively involved in the perpetration of the crimes.

They include Obinna Nnamani of Ndiagu Ogbo-Ezinne,Akpugo in Nkanu West LGA,Miracle ( other names unknown) but has the nickname C-C White ) of Mmaku community in Awgu LGA , Okoro Chisom of Ihie community in Awgu LGA ,Israel ( other names and nativity unknown), Pius Anoja ( a.k.a Ezeobo and the Chief priest of the criminal group ,of Mmaku community in Awgu LGA ,and Mosquito (real names unknown ) of Mmaku community in Awgu LGA .

The list also include Anunti ( real names unknown) of Mmaku community in Awgu LGA and Iyangbakwu ( real names unknown) of Akegbe-Ugwu community in Nkanu West LGA ” part of the police statement reads .

The Police spokesperson informed that the suspects are currently assisting the service in tracking down the aforementioned members of the criminal gang .

While reaffirming the Command’s unwavering commitment towards apprehending all those implicated, Ndukwe said that the Police will remain firm in its determination to combating crimes and criminal activities in the State.

Supreme Court Dismisses Suit Challenging Constitutionality Of Graft Agencies

The Supreme Court, on Friday, dismissed the suit instituted by 16 states of the federation challenging the constitutionality of the acts establishing the Economic and Financial Crimes, Commission (EFCC) and two others.

The plaintiffs had argued that it was a UN Convention against corruption that was reduced into the EFCC Establishment Act and that in enacting this law in 2004, the provision of Section 12 of the 1999 Constitution, as amended, was not followed.

They posited that, in bringing a convention into the Nigerian law, the provision of Section 12 must be complied with.

While delivering judgement, Justice Uwani Abba-Aji, who led a seven-member panel of justices, held that “the EFCC Act, which is not a treaty, but a convention, does not need the ratification of the houses of assembly.

“Let me first look at the constitutional provision. The plaintiffs rely on Section 12 of the constitution in their argument. Treaty is an agreement reached by two or more countries which has to be ratified.

“Convention: Conventions are agreed by a larger number of nations. Conventions only come into force when a larger number of countries agree.

“Therefore, the EFCC Act, which is not a treaty but a convention, does not need the ratification of the houses of assembly.

“A convention would have been ratified by members state and the NASS can make laws from it, which will be binding on all the states in Nigeria as it is the case of EFCC Establishment Act.

“In a country like Nigeria, the federating units do not have absolute power. The NFIU guideline is to present a benchmark and not to control the funds.

“Where an Act of law is made by NASS like the NFIU and its guideline, it is binding on all. Any act that has been competently enacted by the NASS cannot be said to be inconsistent.

“Where the NASS has enecated several laws on corruption, money laundering, etc, no state has the right to make law to compete with it.

“The investigative power of the EFCC cannot be said to be in conflict with legislative powers of the state assembly.

“I must agree with the AGF that the plaintiffs’ argument, that is, the houses of assembly of the plaintiffs states is not tenable in law.”

The Court ruled that the NFIU guideline had not contravened the provision of the constitution to manage the funds of their states and resolve the issues against the plaintiffs.

All other judges agreed with the lead judgment, saying all the issues raised in the states’ suit had no merit “and are accordingly dismissed.”

The Court had earlier dismissed all objections of the Federal Government to the suit filed by the states.

Justice Abba-Aji said the plaintiffs case was against the Attorney-General of the Federation and not any of the agencies mentioned, hence, the Supreme Court has jurisdiction to determine it.

“Since the AGF is assumed to be the chief law officer of the federation, he is by all means the proper and necessary party.

“The AGF has locus standi to institute action against any one

And the AGF can be sued in any civil matter against the government.

“It is clear that the Federal Government has legal tussle with the states based on the directive of the NFIU, which the states are contending. The preliminary objection is hereby dismissed.”

Court Of Appeal Judgement: INEC Reinstates Olorunfemi As Ondo LP Gov Candidate, Removes Ebiseni

Less than 24 hours to the Saturday governorship election in Ondo State, the Independent National Electoral Commission (INEC) has replaced the Labour Party, (LP) candidate, Olusola Ebiseni, with Dr. Olorunfemi Ayodele Festus.

Olorunfemi had emerged a candidate of the party in a primary election conducted by the LP before Ebiseni came, after losing primary of the People’s Democratic Party, (PDP) to declare himself a candidate of LP.

INEC explained that the change followed the receipt of the Certified True Copy (CTC) of a Court of Appeal ruling, which overturned the Federal High Court’s judgment in Abuja.

The update was shared in a statement on the commission’s X handle on Friday.

The Federal High Court, in September 27, in case number FHC/ABJ/CS/1105/2024, had directed INEC to recognize Olusola Ebiseni as the Labour Party’s candidate for the 2024 Ondo State Governorship election.

“However, in the appeal with reference number CA/ABJ/CV/1172/2024 filed by the Labour Party, the Court of Appeal, Abuja Division struck out the judgement of the FHC for lack of jurisdiction.

“In obedience to the court order, the commission has restored Olorunfemi Ayodele Festus, whose name was first published as the Labour Party candidate for the 2024 Ondo State Governorship election and uploaded same to our website for public information.”

Speaking on the development, the LP National Publicity Secretary, Obiorah Ifoh, explained that Ebiseni was the candidate put forward by the Nigeria Labour Congress (NLC) faction within the party.

However, the Appeal Court had disqualified him and reinstated Dr. Olorunfemi as the valid candidate.

Ebiseni had on Thursday while reaction to the Court of Appeals judgement, claimed that it was silent on his candidacy.

The Nigerians in Diaspora Commission on Friday November 15, 2024, informed that about 163 underaged trafficked persons have been returned  to Nigeria from different parts of the world, particularly neighbouring West African countries in the last five months.

This is even as the Commission announced the rescue of 13 trafficked young Nigerian girls from Ghana at the weekend.

According to the Commission’s  Representative, Akinboye Akinsola, the latest batch of 13 rescued victims however voluntarily submitted themselves to the authorities.

A statement from  NIDCOM’s spokesperson Abdul-Raham Balogun, said Akinsola spoke at the  occasion of the formal handing over of the repatriated victims to the National Agency for the Prohibitions of  Trafficking in Persons NAPTIP.

The latest victims ,the Commission’s Representative noted, decided to surrender themselves after learning about previous rescue operations in Kpone Katamanso and Tema areas of Ghana by the NIDCOM.

The statement noted that the 13 rescued victims whose ages range between 19 and 30 years, hail from Rivers, Kaduna, Benue and Ebonyi States.

The rescue operations were jointly carried out by Ghanaian Anti-Human Trafficking Police, the Rescue Live Foundation International and the NIDO Ghana, in concert with NIDCOM .

According to the statement, the NIDCOM expressed its profound appreciation to Nigeria’s First Lady, Senator Remi Tinubu, and the Ebonyi State Governor, Francis Nwifuru, for their crucial support in facilitating the repatriation of the trafficked young girls back to the country.

The Commission, also, acknowledged the immense contributions and assistance from the  Rescue Live Foundation International and NIDO Ghana, particularly, the Chairman of BoT, Chief Callistus Alozieuwa and the Ghanaian Anti-Human Trafficking Police Unit ,in ensuring that  those behind the  traffickings were made to face the law.

The NIDCOM spokesman said the victims were lured to Ghana under the pretext of being offered employment opportunities.

However, rather than the offer of jobs as promised, they were forced into exploitative jobs, including as commercial sex workers.

They  were also  administered with oath of secrecy while their traffickers smile to the banks.

The Commission while reaffirming its commitment to protecting all Nigerians outside the shores of the country, noted that  the NAPTIP is to rehabilitate and reintegrate the rescued victims back into the society.

President Tinubu Urges Peace As Ondo Gov Election Holds

As the people of Ondo State troop out on Saturday for the Governorship election, President Bola Tinubu has urged all political stakeholders and the electorate to uphold peace and decorum and fulfil their civic responsibilities without fear before or after the elections.

A statement by the special Adviser media, Bayo Onanuga, stated that President Tinubu anticipates a democratic process in the state that will genuinely reflect the people’s will and power to freely choose their leaders.

The President commended the Independent National Electoral Commission (INEC) for its diligent preparations for the election, particularly its timely distribution of sensitive materials across all 18 local government areas in the state.

He also acknowledged the deployment of security men to maintain law and order.

The president appreciated the assurances from the Inspector-General of Police and the Chief of Defence Staff that the personnel will act professionally and adhere to the provisions of the Electoral Act to ensure a credible electoral process.

President Tinubu reminded all political stakeholders, especially the candidates, that the people bestow the privilege to govern, and this right must be respected and not undermined.

He added that it is in the best interest of all Nigerians to ensure a free and fair election and consolidate the over 25 years of democratic governance.
