Nigerian Immigration Service In Contempt of Dr Peter Odili – Judge

A Federal High Court in Abuja Monday ordered that the International Passport belonging to a one-time Rivers state governor, Peter Odili, be released with immediate effect.

The passport was seized by the Nigerian Immigration Service, NIS, who maintained that they were acting on the instructions of the Economic and Financial Crimes Commission, EFCC.

The presiding Judge, Hon. Justice Inyang Ekpo, ruled that there is no justification for the NIS to continue holding the passport.

Odili was the governor of Rivers State from 1999 to 2007.

His passport was seized on June 20,  2021, at Nnamdi Azikiwe International Airport, Abuja, by officials of NIS, on his return to Nigeria from  a routine medical trip abroad. Odili said he had been screened and was waiting for his luggage when an Immigration Officer came to him to ask for the passport on the pretence of checking something, and never returned it to him.

No reason was given to him but the NIS was to say later that its action was because Odili is on the watch list of the EFCC.

But Justice Ekwo in his ruling declared the seizure “contemptuous”, saying that it infringed on his fundamental rights.

Besides giving a restraining order to NIS from any form of arrests, intimidation, and harassment, he ordered NIS to write a letter of apology to Odili for the embarrassment they have caused him, saying that the excuse that he was on the EFCC watch list is not tenable, and violates an existing court order.

Besides, according to him, such a claim was not backed by any evidence.

“The reason given by the respondent for the seizure of the passport is that he was on the watch list of the EFCC”, he said.

“This claim is not backed by any evidence showing that the EFCC requested the seizure of his passport.

“It is settled law that any pleading that is not backed by evidence is of no effect,”.

The court also held that Odili produced judgment in evidence proving that the EFCC had no legal backing to order the seizure of his passport.

“The travel passport is not a document that can just be taken away from a citizen by the whims and caprices of any person.

“Such seizure must be done in strict compliance with the law,” Justice Ekwo said.

Odili had approached the court to challenge the seizure of his travel passport with number B50031305 by the NIS.

In an eight-paragraph affidavit to which he deposed, Odili said the passport was seized upon his arrival.

I have Not Made Any Statement on EFCC ‘s Invitation – Obi

The Vice Presidential candidate of the PDP in the 2019 election, Mr. Peter Obi has denied reacting to the invitation to him by the EFCC as being circulated on different media platforms.

The said reaction quoted Obi as  requesting the EFCC to make their investigations public, among other out-of-character remarks.

The release by his media office and signed Valentine Obienyem said that Obi was yet to receive the letter from the EFCC, which he read on social media like others. “From what is circulating, the letter appears to have been sent to an office he is no longer part of and is yet to reach him.”

“However,” the release further reads,”Obi being a law abiding Nigerian will honour all legitimate invitations from government agencies at all times.”

Obi’s “problem” stems from the now famous Pandora Papers which listed him, among other Nigerians, as one of the world’s rich men who hide their wealth in tax heavens.

Forty-eight hours after a programmed bid to compromise the outcome of the November 6, 2021 gubernatorial election in Anambra state was blown open, those fingered in the deal are, sadly, still walking the streets, free.

Expressing disappointment at the development, the Senator Andy Uba Governorship Campaign Organisation, SAUGCO in a statement issued by its Director, Media and Publicity, Hon. Victor Afam Ogene, on Sunday, in Awka, the State capital, called on the nation’s security agencies to swiftly unravel those behind the sordid attempt to subvert the will of ndi Anambra.

A national newspaper,  Vanguard, had in its edition of Saturday, October 16, 2021 reported inter alia: “A Southeast governor and a top official of the Independent National Electoral Commission have run into trouble with security agencies over a princely sum of $4 million bribe doled out by the governor as bribe to compromise the November 6, gubernatorial election in Anambra state.”

Since the scandal blew open, neither Governor Willy Obiano nor his Commissioner for Information and Public Enlightenment, Mr. C. Don Adinuba, have mustered the nerves to utter a single word in response, despite clear and unassailable indications that, indeed, the Governor at the centre of the bribery saga is the Anambra State helmsman.

“Instead of coming clean on the allegations, as it affects it, the Obiano administration has rather chosen to divert attention, by engaging third parties and social media miscreants under its payroll to engage in a wild goose chase over who the alleged Governor and his spouse are.

“Besides the $4 million bribe money, the newspaper report also made mention of ‘the wife of the politician, who is described as an influential and powerful first lady in the Southeast(who) is reported to have been meeting secretly with many electoral officers, EOs, who are key to the forthcoming election.

“In the face of the puerile attempts to divert attention from Mrs Ebele Obiano as the First Lady in issue, we hasten to raise the following posers:

  • Which First Lady in the Southeast is reputed to freely dish out slaps to aides and government functionaries?
  • Which First Lady did her husband openly address as ‘Her Excellency, the Governor’ in a viral video?
  • Which First Lady is known to vet government appointments before release?
  • Which First Lady chastised her husband’s deputy, to the point of compelling him to defect to another political party, simply because she took umbrage at him paying a private visit to a prominent son of the state?

Noted the newspaper: “The evidence against the Governor’s breach of his oath of office and public trust is strong, but he is still protected under the immunity clause, but we will see what happens once his immunity elapses.”

We ask again: Of all the governors of the Southeast, whose immunity is due to expire soon? Governor Willy Obiano of Anambra state, of course.

“We, therefore, call on our nation’s security agencies not to lend credence to current boasts within government circles in Awka, that the bribery saga would fizzle out in a matter of days.

“On our part, we call on the media, civil society organisations and anti-graft agencies to beam their searchlights on the burgeoning crisis, which is capable of tainting the outcome of the Anambra governorship election, if not nipped in the bud.”

Release Our Passports For Treatment Abroad, El-Zaakzaky Tells FG

Leader of the Islamic Movement of Nigeria, IMN, a Shi’ite sect of Islam in Nigeria, Sheikh Ibraheem El-Zakzaky, has accused the Federal Government of preventing him and his wife from seeking medical attention abroad, saying the Government has been withholding their passports even with the Court ruling in their favour.

Three months after a Court of competent jurisdiction acquitted him and his wife, Zeenat, of criminal charges, the Federal Government is yet to release their passports.

The couple was also stopped from acquiring fresh international passports to replace the previous ones the security agencies allegedly claimed to have lost.

El-Zakzaky stated this in an interview with Press TV, an Abuja-based Tv station monitored in Lagos.

According to him, they had no intention of fleeing the country.

Narrating his ordeal, the Islamic cleric said his wife is still having bullets lodged in her hips.

“We were shot severally, such shooting that a human being cannot survive. They (security operatives) battered my right side and battered my right eye. Around the head, from the cheek up to the head, they counted about 38 fragments. Also, my wife has gunshot on her stomach and her thigh”, he said.

“They took us to their hospital and somehow removed some of the bullets without putting her under anesthesia. It was later in another hospital that more bullets were removed, and she still has one complete bullet in her body, which found its place in her pelvis. And they said, at that time, they could not remove it.

“Up till now, these fragments release poisons like lead and cadmium. I am still living with some amount of those poisons in my body, including the fragments of bullets. It’s the will of Allah that I’m still alive; because when they tested the level of lead in my body, at one time, it was about 244, which they said a normal human being should contain only 10, but I had 244 in my body. Well, that’s the will of God that I’m alive, anyway.

“On July 28, this year, 2021, we were discharged and acquitted, and we were exonerated from all the eight charges against us. At the end of the day, it was found that none of us committed any offense, and then they were ordered to pay compensation, yet nothing happens. None at all.

“They know that we have a health issue, but we were kept with these difficulties, incarcerated for almost six years. But, by the grace of God, we survived it. Here (in Nigeria), they said they could not remove it, but our doctors, who came from outside the country, studied the situation and said they would be able to remove it.’’

“An order was given by the court of law that we have the right to seek medical assistance outside Nigeria. We were thinking that immediately after we are out of prison, it will not be a matter of days we will leave this country. When we came out, we were hoping to get our passports back.

“Our lawyer, after they ruled that we were discharged, went and begged the presiding judge to give an order that our passports should be released to us because of our health problem.

”The Judge said there was no need for him to give any order because we have no charges. We have been discharged. He said we were entitled to all our property. The court doesn’t have to give orders.

“When we came out, we were thinking in a matter of a week it will be okay for us. But, up till now, the passports have not reached our hand. At one time, the security operatives said they had lost the passports, and they are no longer in their hands.

“So, we took steps to make another one. But, at the end of the day, we were told that “passport flagging” has been placed on us; meaning that the two of us have no right to leave this country. We don’t know what for. At least, officially, they didn’t say it.

“So the matter has not come to an end. We are still, in a way, incarcerated because we are not allowed out of the country for no reason.

Breaking: Tributes As Ex-US Secretary of State, Powel Dies of COVID

Former President George W. Bush of the United States of America, USA has paid tribute to General Colin Powel, the first black Secretary of State. Powel, died few hours ago of COVID 19. A retired Army General, he was widely respected for his bi-partisan approach to national issues.

He was one of the top Republicans to first support Joe Biden during last year’s Presidential contest against Republican Donald Trump, which the former won.

A statement from his family said he died of COVID 19 complications, after being treated at Walter Reed National Military Medical Center in Bethesda, Md. He was fully vaccinated.

“We have lost a remarkable and loving husband, father, grandfather and a great American,” a statement issued by the family said, adding that “we want to thank the medical staff… for their caring treatment.”

Former President Bush, in his tribute said Powel was “a family man and a friend” who “was such a favourite of presidents that he earned the Presidential Medal of Freedom – twice”.

The demised former Secretary of State was a moderate Republican who broke ranks with his party to endorse Barack Obama in 2008, became a trusted military adviser to a number of leading US politicians.

He is also admired for  helping guide the U.S. military to victory in the 1991 Persian Gulf War as chairman of the Joint Chiefs of Staff, then struggled a decade later over the U.S. invasion of Iraq as a beleaguered secretary of state under President George W. Bush, died Oct. 18 at 84.

Born in New York to Jamaican immigrants, Gen. Powell rose rapidly through the Army to become the youngest and first Black chairman of the Joint Chiefs. His climb was helped by a string of jobs as military assistant to high-level government officials and a stint as national security adviser to President Ronald Reagan. Charming, articulate and skilled at managing, he had a knack for exuding authority while also putting others at ease.

As the Pentagon’s top officer, he played a prominent role in restoring a sense of pride to the nation’s post-Vietnam military and began the reshaping of American forces after the end of the Cold War. His famous prescription for the use of force, dubbed by journalists the Powell Doctrine, called for applying military might only with overwhelming and decisive troop strength, a clear objective and popular support.

His selection by President George W. Bush in late 2000 to be secretary of state transformed Gen. Powell from soldier to statesman and made him the first Black person to lead the State Department. But his four years as secretary proved his most difficult assignment.

A pragmatist and a strong believer in international alliances, Gen. Powell often found himself the odd man out in an administration dominated by neoconservative ideologues who were dubious about the usefulness of the United Nations and NATO and all too ready to employ U.S. military power.

Other than his well-known reservations about military intervention, Gen. Powell, as he often acknowledged, was not given to grand principles. He saw himself primarily as a problem-solver and expert manager.

He was 84 years old.

N20m Cash: Airforce, WSJ Bicker Over Payment To Bandits

The Nigerian Air force has denied report by the Wall Street Journal, WSJ that it paid bandits N20 million in exchange for an anti-aircraft gun.

The American based online newspaper had claimed in a report that the sum was paid to retrieve the anti-aircraft gun seized by the bandits recently.

It said the weapon could be used to bring down President Muhammadu Buhari’s aircraft whenever he visits Katsina, his home state.

On 18 July, a Nigerian Air Force, NAF Alpha Jet aircraft, was shut down by bandits while returning from a successful air raid between the boundaries of Zamfara and Kaduna State. The pilot of the bomber jet, Abayomi Dairo escaped by hairs’ breath. The incident, Defence analysts insist, further proved the capability of criminal elements such as Boko Haram and bandits to use sophisticated weapons to bring down any aircraft flying on the nation’s airspace.

WSJ claimed in the report that “nearly $50,000 in crisp Nigerian bank notes, wasn’t for a person, but to retrieve a weapon that directly threatened the country’s president,” the newspaper reports.

“A kidnapping gang encamped in Nigeria’s Rugu forest had seized an antiaircraft gun in a clash with a military unit. That posed a threat to President Muhammadu Buhari, who had been planning to fly to his hometown about 80 miles away, and the government needed to buy it back.

“An hour later, the officer, who declined to be identified, was clasping hands with a leader of a diffuse network of criminals whose campaign of kidnapping civilians — including hundreds of schoolchildren — has raised millions of dollars to build an arsenal of heavy weaponry they are using to wrest control of swaths of the north, including the president’s home state.

“Over tea, the militant leader agreed to part with the truck-mounted 12.7 calibre anti-aircraft gun in exchange for the ransom,” WSJ said in the report.

But in a swift reaction, Edward Gabkwet, the spokesperson for the Nigerian Airforce, said in a statement, that the bandits were not paid, describing the report as “spurious allegation that was undoubtedly designed to cast aspersions on the good image of the Service.”

According to him “the said report is totally false. It should therefore be taken as fake news and disregarded. Indeed, we ordinarily would not have responded to such baseless and utterly illogical allegation but for the need to set the record straight as well as reaffirm the NAF’s unflinching commitment to decisively dealing with the armed bandits and all other criminal elements in the country in partnership with other services of the Armed Forces and other security Agencies.

“For the avoidance of doubt, it must be stated that there is no basis for the NAF to pay bandits or any criminal elements that it has continued to attack and decimate in Katsina State, other parts of the North-West as well as other Theatres of Operation in the Country.

“Indeed, as recent as October 12, 2021, NAF aircraft conducted 5 missions in the Jibia general area and engaged targets with rockets and cannons at Bala Wuta bandits’ locations in Kadaoji.

“Similar successes were recorded at Fakai Dutsin Anfare, an area in Jibia LGA known for its high incidences of bandits’ activities. The false reportage therefore, begs the question as to why the NAF would negotiate for a weapon allegedly seized and still carry out air interdiction missions on the same bandits and their strongholds.”

He said further that the report could be targeted at whittling down the recent gains made by the Nigerian armed forces against bandits and criminal elements in northern parts of the country, adding that this will not stop the resolve to rid the country of insecurity.

He said “the NAF is of the view that, this latest false report could be a part of a campaign to further the cause of insecurity in Nigeria by elements who see the NAF as a threat following series of successful exploits in operations against criminal gangs.

“Perhaps, this provides an avenue for the NAF to yet again appeal to members of the media, both local and international, as well as social media, to be circumspect in their reportage and endeavour to always verify their facts before going public. The public is enjoined to disregard the falsehood emanating from some sections of the social and mainstream media.

“The NAF also uses this opportunity to call on citizens to continue to cooperate with security agencies as efforts are ongoing to rid the entire Nation of criminals and their activities.

“On our part, the NAF, as a professional and disciplined force, will not in any way be discouraged from carrying out its mandate to rid the entire North-West Nigeria of banditry and other forms of criminality,” Gabkwet said.

Kwara: Saraki Directs Supporters To Take Back State From APC

Former Senate President, Bukola Saraki has assured that the Peoples Democratic Party, PDP will win Kwara state in the next election.

Saraki, a two-time governor of the state disclosed this after the successful completion of the PDP state’s congresses, where new leaders were elected to run the affairs of the party in the state.

The former governor’s promise also came amidst deep seated animosity in the ruling APC, which Governor Abdulrahman Abdulrasaq heads. Two parallel congresses were held by the party, last Saturday, which has further polarized the two factions headed by the governor and Lai Mohammed, the Minister of Information.

Speaking after the election, Saraki charged the newly elected executives of the PDP in the state Kwara state to ensure that the state falls under the control of the PDP in 2023.

According to him “the struggle for Kwara begins now, let commitment be your watchword.

“Let the campaign begin with your election today at wards, local governments and state levels as you begin your tenure in office. The task ahead is a serious one,” he stated.

He said the peaceful conduct of the congress is a pointer that the PDP has realized its mistake and was prepared to do everything possible to take back the state from APC.

“The peaceful conduct of this congress has confirmed to me that we are indeed ready to take back power in Kwara.

“I charge all the new state officers of our party to begin work in earnest to return PDP to power in 2023 and reposition Kwara state again,” the former Senate President said.

Meanwhile, Sunday Fagbemi has emerged as the state APC chairman for the faction loyal to Governor AbdulRazaq, while a former caretaker chairman of the party in the state, Bashir Bolarinwa, was returned by the faction led by Mohammed.

Fagbemi, who was chosen by consensus by loyalists of the governor at their congress held at the state secretariat of the party in Ilorin, pledged that his team has pledge to reconcile the warring factions with the aim of strengthening the party.

In his acceptance speak after the election Fagbemi said “I thank His Excellency, our party leaders, elders and delegates for the confidence reposed in me. I also want to thank my predecessor, Alhaji Abdullahi Samari, for holding forth so well for the party.

“We will soon reel out our plans and we will start with genuine reconciliation of our brothers and sisters of the same family,” he said in his acceptance speech.”

Analysts, however, insist that true reconciliation is still far from the party as the struggle for the control of the soul of APC  by the state governor and the minister continues.

Secondus To Save PDP from Hirelings

The Media Office of the embattled National Chairman of the Peoples Democratic Party, PDP, Ptince Uche Secondus, has refuted a story making the rounds that he is under pressure to withdraw the case he instituted against the party.

Secondus was stopped from parading  himself as the National Chairman by three courts – two from his State, Rivers, and one from Cross River State. The cases were, allegedly, instigated from his home State, which Party branch, also, suspended him.

Denying the claim, the Media Office said it was not possible for him to be under such pressure as he instituted no case against the party, but was dragged to the Court by those the office described as “hirelings” known to the Party.

If anything, the Office said in a statement signed by his Media Adviser, Ike Abonyi, Secondus is under pressure for justice, and determined to rid the party of hirelings out to destroy it.

“The attention of the media office of Prince Uche Secondus has been drawn to unsubstantiated story claiming that Prince Uche Secondus is under pressure to withdraw his case against the party from court.

“The truth which the said news did not state is that Prince Secondus is not in court against the party but was dragged to court instead by person bent on hijacking the soul of the party.

“For the avoidance of doubt the media office wishes to restate that Prince Secondus is really under pressure for justice and would seek it anywhere to save the party from hirelings out to destroy and derail the focus of the party.

“The party leaders are aware of who went to court against it and knows what to do rather than indulging in mind game.

“Nothing short of Justice and respect for its servants will save PDP from the hands holding now.

“For avoidance of doubt the justice Prince Secondus is seeking is as enshrined in the party constitution which is Supreme and states clearly how a National Chairman and any National officer can be sanctioned even where there is a known breach talk less where there is none.”

The Party is being run by an Acting Chairman. It is not known how the cases in Court would affect the Party, especially, its Congresses and upcoming National Convention.

Until the crisis, Secondus would have left Office, peacefully, in December, 2021.

APC State Congresses: Governors Hold The Ace

The All Progressive Congress, (APC) held its State Congress on Saturday in Ondo and Ekiti states with former Caretaker Chairmen returned unopposed to their previous positions.

Analysis of the Congress in the two States indicate that the Governors still had upper hand in who emerged at the Congress.

In Ekiti, Mr Paul Omotoso was returned as Chairman as Mr Ade Adetimehin retained his position in Ondo.

It was learnt that the Congress was mere affirmation of names of those that had been pencilled down by the Governors, who are leaders of the party in States.

States where they could not tow same line with the Governor, parallel congresses were held with each faction affirming their officers.

The presence of the Governors at the venue of the Congress, it was learnt, was meant to intimidate the delegates to toe their line.

Among states where parallel congresses were held are Osun, Benue, Ogun, Niger Akwa Ibom, Kwara and Kano States.

The leadership of the party is expected to constitute Appeal Committee to look into grievances in the affected states.

Although there was no parallel Congress in Ekiti, there are indications that a faction that is championing the Presidential ambition of Asiwaju Bola Tinubu, SWAGA, which members boycotted the Congress, will announce their position.

Imo Mourns Former Military Administrator, Tanko Zubairu

Governor Hope Uzodimma has described the death of Col. Tanko Zubairu (rtd), the last Military Administrator of Imo State, before the return to civil rule in 1999, as another big loss to the State.

The late Col. Zubairu (rtd) served as Military Administrator of Imo State from August 22, 1996 to May 29, 1999 when he handed over to Chief Achike Udenwa as an elected civilian Governor.

In a statement signed on his behalf by his Media Adviser/Chief Press Secretary, Oguwike Nwachuku,  Governor Uzodimma said Col. Zubairu’s passing was shocking, coming shortly after the State lost, and recently buried its first Military Administrator, Rear Admiral Ndubuisi Kanu.

He described Col. Zubairu as a disciplined, fearless and God-fearing Military Officer who had little tolerance for social ills and crime, and was always prepared to fight such negative tendencies wherever they existed in Imo State with his whole strength.

The Governor said Imo State and its citizens cannot forget in a hurry how Col. Zubairu’s administration worked tirelessly to stamp out social ills and criminality associated with a few bad eggs hibernating in our society using Imo as a launch pad during his reign.

He said Col. Zubairu ensured that the activities of the few bad ones did not dent the moral rectitude that Imo people are noted for and that he worked hard to preserve what he saw as the pride and major characteristics of Imo people such as hard work, honesty, integrity, fear of God, love for one another, among others numerous to mention.

The Governor who said Imo State has lost a friend, a brother, a compatriot and partner in progress in Col. Zubairu, therefore, commiserated with the widow and immediate family members, the Government and people of Kaduna State, the Military and the Federal Government over the loss.

He prayed God to grant all that Col. Zubairu left behind to mourn him the fortitude to bear the loss. He also prayed for the repose of the soul of the deceased.
