Kano Emirate Conflicting Legal Pronouncements: CJN Summons Judges

Justice Olukayode Ariwoola - CJN

By Ayodele Oni

Following conflicting judicial pronouncements of the Kano state Emirate tussle, Chief Justice of Nigeria (CJN), Justice Olukayode Ariwoola, has summoned the Chief Judge of the Federal High Court, and the Chief Judge of Kano State High Court to Abuja.

The Federal High Court in Kano, presided over by Justice S. A. Amobeda, issued an order for the eviction of Emir Muhammadu Sanusi II from the Kofar Kudu Palace, reinforcing the authority of the 15th Emir of Kano, Aminu Ado Bayero.

The judgement was seen as reinforcing the authority of the 15th Emir of Kano, Aminu Ado Bayero.

Also, the Kano State High Court, presided over by Justice Amina Adamu Aliyu, issued an injunction to protect Muhammadu Sanusi II and other key figures from potential harassment by state authorities.

This order prevents any interference with the Emir’s autonomy and the seizure of key symbols of his authority, such as the twin spear, the Royal Hat of Dabo, and the Ostrich-feathered shoes.

These conflicting orders have led to significant confusion regarding the rightful authority and protection of the Kano Emirate.

The State High Court’s case is set for further hearing on June 13, while the Federal High Court has adjourned its case to June 4.

Rivers Gov Fubara Laments, Says Early Stage Of Administration Wasted On Political Crisis

Siminalayi Fubara - Governor of River State
Governor Similanayi Fubara

By Ayodele Oni

While other governors that were sworn in along with him on May 29, 2023, are celebrating one year in office, Rivers State Governor,  Siminalayi Fubara, has said his administration is just four months old in office.

Fubara’s remark may be due to the unending political crisis, which almost consumed him, spearheaded by his predecessor in office, Nyesome Wike, now Minister of the Federal Capital Territory, (FCT).

The Governor, however, noted  that despite this, his administration is still standing strong, delivering dividends of democracy to the people and solving critical problems of governance.

Fubara said that the successes recorded so far were possible because God has been graciously upholding the government, offering it the right direction and giving him the strength to carry on.

A statement by Nelson Chukwudi, Chief Press Secretary to the  Governor stated that Fubara spoke at the State Banquet to celebrate his first one year in office and 57th Anniversary of the creation of Rivers State at Government House in Port Harcourt.

He pointed out  that while others were celebrating one full year of service to the people, he has only actually been in control of real governance characterized by prudence, purposefulness and protection of the interest of the State in the last four months.

He said that under his watch, Rivers State Government has provided “Governance that has the interest of our people at heart. Governance that is prudent. Governance that has respect for you: all of you.

“We decided to have this banquet today to say: thank you, thank you and thank you to everyone of you. You have supported us.”

“The last time I had this opportunity to dine with you was on 1st of January, 2024, and you know, the mood was not like this. We never knew we could even stand up till today.

“You see the reason why we need to give God all the glory. It is very simple: one thing is very important and unique; we are succeeding because we are on the side of God.”

“It is not just standing on the side of God; because every body professes to be standing on the side of God, even the native doctor would call on God.”

“But what is important is God being in your business. God is in our business. And because He is in our business, we will continue to survive, no matter where they are coming from.”

Governor Fubara insisted that his purpose in government is to deliver the dividends of democracy to Rivers people, which will not be compromised.

“It takes somebody who loves this State genuinely to embark on a project like the Trans-Kalabari Road. I am not from that axis of the riverine, where somebody would say I’m doing it because I’m from there. No. That project alone will cost this government over N225billion.

“But so far, to show our commitment that we are not just saying that we want to do it, we have started it, and we believe in delivering it.

“We believe that when this project is completely delivered, security issues will be reduced, development will come to our people in far remote areas that you could hitherto only traverse through the sea, issues of water piracy will be gone, including issues of boat mishaps that we keep recording.”

President Tinubu Signs Into Law Bill Repealing New National Anthem, Reintroduces Old Anthem

Bola Tinubu

By Ayodele Oni

The Compatriots will no longer arise,  but we continue to hail Nigeria as our own dear native land with President Bola Tinubu signing into law the bill seeking to reintroduce the old national anthem into law.

The Senate President, Godswill Akpabio, announced this at the joint sitting of the Senate and House of Representatives on Wednesday.

Akpabio said the President signed the bill into law on Wednesday morning.

President Bola Tinubu, who later joined the joint session, confirmed ‘Nigeria, we hail thee’ as the “latest national anthem”.

Akpabio said the sitting was primarily to launch the new national anthem, explaining that the President would not be making a speech because he has to leave to launch the Abuja metro line.

The Senate and the House of Representatives had previously passed the legislation to swap the national anthem from “Arise, O Compatriots” to “Nigeria, We Hail Thee” at separate sittings.

Following the signing of the bill by the President to reintroduce the old national anthem, the joint sitting jettisoned what has been in existence since 1978, to adopt the former and newly signed national anthem ‘Nigeria, we hail thee’.

The old anthem, “Nigeria, we hail thee”, composed when Nigeria gained independence on October 1, 1960, has replaced the “Arise, O Compatriots” anthem.

Nigerians have continued to express surprise with the speed with which the two houses of national assembly passed the bill into law and the signing into law within 24 hours of its passage.

They continue to ask questions about the impact of the old national anthem will bring to cushion the biting economic hardship in the country.

Goodbye ”Arise O Compatriots”, Welcome “Nigeria We Hail Thee”, As Onanuga, Ngalele Test Power

Bola Ahmed Tinubu - Nigeria President

By Ayodele Oni

President Bola Tinubu confirmed Nigeria, we hail thee as the country’s “latest national anthem” when he joined a joint sitting of the National Assembly to mark the Silver Jubilee Of Nigeria’s fourth Republic.

The President, joined the joint session of the national Assembly to celebrate 25 years of the new democratic dispensation in the country which began in 1999 after a very long stretch of Military Rule.

Accompanied by the Vice President, Kashim Shettima, top aides in the Presidency and Ministers, the President’s visit confirmed the earlier statement by one of, Bayo Onanuga, Special Adviser on Information and Strategy, that Presideny Tinubu would be part of the celebration at the National Assembly.

Another Aide, the presidential Spokesman, Ajuri Ngalele, had countered Onanuga’s statement in a terse release dismissing the content and even the author. Ajuri had written that “In view of public commentary concerning the President delivering a speech before a Joint Sitting of the National Assembly tomorrow, May 29, 2024, it is important to state that this information is false and unauthorized as the Office of the President was not involved in the planning of the event.”

The two contradicting statements   have shown that there is power play at the seat of power especially among the various aides of the President.

Ngalele was first to be appointed as Special Adviser to the President on Media and Publicity immediately after Dele Alake, current minister of solid minerals vacated the seat. He became the Presidential spokesman, that always speaks the mind of his principal.

Onanuga came on board thereafter with same office designation, almost, as Ngalele, also dishing out reports from the seat of power. Both of them have been coming out with statements on the activities of the president until Tuesday’s contradictory statements, which portrayed a perceived ongoing personality clash between the presidential spokesmen.

There is no doubt about the credentials and professional experience of Ngalele and Onanuga as the duo had paid their price in the profession.

From all indications, the offices of the two presidential aides are located right inside the presidential villa, the seat of power. The itinerary of the president, as the practice, after it is vetted by the Chief of Staff is expected to be circulated to all those aides that are directly working with the president, including the two spokesmen.

Onanuga’s statement was first to be released before  Ngalele’s  which dismissed the later as “false and unauthorized.”

The Senate President, Godswill Akpabio had confirmed that

the joint sitting was primarily to launch the new National Anthem, explaining that the President would not be making a speech because he has to leave to launch the Abuja metro line.

Said an observer: “Let’s even admit that the statement by Onanuga was not authorized or approved before it was released to the public as claimed by Ngalele, the tone with which Ngalele dismissed the whole thing sparks a cold personality clash between the duo. There are two sides to a coin and in this business of journalism, every word, the moment it is released to the public has connotative and denotative meanings.

“There is no way the President’s activities will not suffer for as long as the two media aides are working at cross purposes. The reason for their appointments has become meaningless and useless for the office of the number one citizen. They should, while trying to please their godfathers, not allow the intrigues and dirty politics affect their assignments.”

As an endorsement of the “new” National Anthem, it was sang before the President left the National Assembly.

Governor Mbah Warns IPŐB Against Purported Plan To Disrupt Ongoing WAEC Examination As 300,000 Igbo Students Risks Missing WAEC Exam

Peter Mbah - Governor of Enugu State

By Akinwale Kasali

The Governor Peter Mbah-led Enugu State Government has strongly warned the Indigenous People of Biafrä, IPŐB, not to embark on its purported plan to disrupt the ongoing West African Examination Council, WAEC, Examination in the State.

IPŐB had threatened to disrupt the ongoing examination in the State on May 30th, 2024, prompting the Enugu State Government to severely warn the Group.

The Enugu State Commissioner for Information and Communication, Aka Eze Aka, in a Statement on Wednesday in Enugu, the State Capital said that there was no room for IPŐB’s activities in the State and urged the residents and students to go about their exams and normal activities on May 30, assuring them of adequate security.

He said the State Government noted with deep concern the statement credited to IPŐB directing WAEC to postpone the General Mathematics (Theory and Objectives) examinations scheduled for May 30, the day IPOB designated as “Biafra Heroes Day.”

Aka said: “We note with particular concern IPOB’s statement that the WAEC Board should not endanger the lives of students because the day is not safe for any individual in Biafra territory.

“This is unacceptable to us, not only because of the well-known position of the Enugu State Government on illegal sit-at-home orders which have dealt a great blow on the socio-economic life and fortunes of the South East region, but it is, also, because of the far-reaching consequences of a whole generation of Enugu children failing to sit for a fundamental subject such as mathematics in one year.

The commissioner stressed that the Igbo excel on the wings of industry, education, and human capital development, saying that any pronouncement or action that tends to deny the children their rights to education, which is their ticket to the future, was offensive.

He said the Igbo founding fathers and fallen heroes, who must be turning in their graves, would be wondering what could have happened to the Igbo as a people.

“Many of the architects of such unjust and evil agenda live in the comfort of civilised societies where they go to work and their children go to school every workday.

“The Enugu State Government recognises the sacrifices of our gallant forebears, who gave their all, including their lives, to defend the Igboland.

“But we also recognise that they died that we may not just have life, but to have the best of it, which can only come from developing our human capital to be able to excel in all that we do as individuals and collectively as a people.

“The government will not sit by and watch the future of our children aborted by such ill-conceived pronouncements intended to keep them at home.

“WAEC, as the name implies, is a regional body not just in Nigeria, but across West Africa.

“The subregion will certainly not wait for us.

He said the State Government, therefore, advises candidates sitting for the ongoing WAEC Exam in Enugu State to feel free to go to their respective centres to sit for their papers on May 30, without any fear.

“ While the officials involved in the conduct of the examination should also go about their legitimate duties without apprehension.

“No one has the right to impose any illegal and involuntary restriction of movement or business activities on anybody within the territory of Enugu State. Such will be met with the full weight of the law.

“Consequently, the Government has put the Security Agencies on red alert to ensure security of lives and property and also deal, according to the laws of the land, with anyone or group bent on scuttling the ongoing WAEC Exam,” Aka warned.

If IPOB carries out its threat, it means that about 300,000 Igbo children will miss the Mathematics examination, in which case they need to wait till 2025 to take it.

Kano Royal Battle: Gov Yusuf Outlaws Public Protests, Demonstrations, Alleges Plan By Opposition To Destabilize State

Abba Kabir Yusuf - Governor of Kano Sfate

By Suleiman Anyalewechi

Amidst growing tensions, and unease surrounding the festering Kano Emirate Throne’s disagreement, the Kano State Government, on Wednesday May 29,  2024 announced a clamp down on protest marches and unauthorized public gatherings across the State

This is just as the State Governor, Abba Kabir Yusuf, has urged law abiding residents to go about their lawful activities without fear.

A statement issued by the Governor’s Media Aide, Sanusi Bature, said the State Government is in possession of credible intelligence suggesting that some powerful, but unnamed forces have concluded plans to disrupt the peace of Kano using students bodies and other political agitators from some parts the Northwest region.

According to the statement, Governor Yusuf’s decision is   in line with his constitutional responsibility as the Chief Security Officer of the State.

“By virtue of his position, the Governor has directed the Police, the Department of State Services, DSS, and the Nigeria Security and Civil Defence Corps, NSCDC, to apprehend, detain, and  prosecute any individuals or groups partaking in demonstrations on the streets of kano.

“We are privy to credible intelligence indicating that  the certain prominent figures from the opposition parties in kano have devised plans to sponsor student associations and political agitators from other Northwest States to incite chaos under the guise of advocating for the reinstatement of the dethroned Emir of Kano, Aminu Ado Bayero.

“The State Government has explicitly outlawed protests, demonstrations, or processions of any kind, and individuals found on the streets of Kano engaging in such activities will be promptly apprehended .

“Through this declaration, we caution student-groups against being manipulated by trouble makers who are resolute in fomenting disorder in Kano” part of the statement reads.

The statement further noted that the ban on protest marches and other related activities is a proactive measure to forestall the break down of law and order in the face of the challenges posed by the ongoing struggle for the Kano Emirate stool principally between Emir Bayero and  Emir Muhammad Sanusi.

The Source reports that following the May 23  dethronement of Emir Bayero and four  others to pave way for the  return of Emir Sanusi ,a spate of protest marches  and demonstrations have hit most parts of the State.

Specifically, irate youths have, in the last two days, embarked on a series of protests in Gaya and Bichi, two of the five areas whose Emirs were equally swept aside together with Emir Bayero.

Credible sources have revealed that with the conflicting pronouncements  emanating from the judiciary on the royal crisis, chances are that some of the interested parties may resort to self help any time soon.

Academic, Non Academic Staff In Oyo State-owned Tertiary Institutions Embark On Warning Strike

Seyi Makinde - Governor of Oyo State

By Ayodele Oni

Academic and Non-academic staff under the aegis of Joint Action Committee, (JAC) of Trade Unions Oyo State-owned tertiary institutions, commence three days warning strike on Wednesday.

To be affected by the strike are: The Polytechnic Ibadan, The Oke-Ogun Polytechnic (TOPS) Saki, Adeseun Ogundoyin Polytechnic (AOP) Eruwa, Oyo State College of Education (OYSCOED) Lanlate, and Oyo State College of Agricultural Technology (OYSCATECH) Igboora.

The Joint Action Committee (JAC) of Trade Unions, comprising the Academic Staff Union of Polytechnics (ASUP), Colleges of Education Academic Staff Union (COEASU), Senior Staff Association of Nigeria Polytechnics (SSANIP), Non-Academic Staff Union of Educational and Associated Institutions (NASU), and Senior Staff Union of Colleges of Education in Nigeria (SSUCOEN) satud the strike was necesitated by refusal of Oyo state government to meet their demands.

In a statement signed by JAC Secretary, Akin Adekanbi, and made available to journalists in Ibadan, the Oyo State capital, the workers’ unions noted that the three-day warning strike was promted by exhaustive discussions and numerous deadlines issued to the Oyo State Government through the Ministry of Education, noting that no substantive resolutions have been achieved.

We demand the immediate implementation of this 25/35% increment and the payment of arrears from January 2023. 2. Platinum Consultant: The Platinum Consultant’s activities have turned into a financial burden, siphoning off 10% of internally generated revenue from our institutions. The money that should have been used for academic commitments is being deducted by the said consultant.

Among the demands, according to the statement are financial autonomy for the institutions, stoppage if salary augmentation by the institutions and shortage of manpower and workers casualization.

“Financial autonomy had been eroded from the institutions against best practices making the system inefficient and ineffective in meeting the demand of an educational institution.

“This practice must end immediately. Notably, all universities in the state – Ladoke Akintola University, Ogbomoso, Emmanuel Alayande University of Education, Oyo and Abiola Ajimobi First Technical University, Ibadan were exempted from this arrangement highlighting discriminatory practices against the Polytechnic and College of Education in the state.

“Salary Augmentation: The current salary augmentation policy is unsustainable and detrimental to effective service delivery of our institutions.

“Schools are using a substantial proportion of their Internally Generated Revenue (IGR) to augment the salary of staff making it difficult to meet essential services and demands of academic institutions.

“Oyo State Government should provide full subvention to end this debilitating practice.

“Shortage of Manpower and Casualization of Workers: There is a critical shortage of both teaching and non-teaching staff within our institutions, with many departments functioning with minimal academic staff of between 1 and 3 staff.

“Our Polytechnics and Colleges of Education now rely heavily on Casual staff for teaching and administrative functions.

“Some of these casual staff tagged Teaching Assistants have spent many years contributing their efforts, energy and academic qualifications to teaching, accreditations and rating of our institutions.

“These casual staff across the institutions should be regularized as permanent employees to ensure dedication and improved service delivery in line with the requirements of regulatory bodies.

“The stagnated non-academic staff, Cleaners and Gardeners, at OYSCOED, Lanlate for many years past should be regularized

“Governing Councils: The non-constitution and irregular tenure of Governing Councils about a year since they were dissolved are hindering policy decisions and promotions in our institutions.

“Immediate action is required to constitute these councils with immediate effect for the efficient running and management of our institutions.

“Salary Arrears: The non-payment of salary arrears for 2018/2019 in OYSCOED, Lanlate, OYSCATECH, Igboora and EAUED, Oyo is exacerbating the financial hardship of staff. These arrears must be settled without further delay.”

Ajuri: Onanuga’s statement is false and unauthorised

Conflicting report on President Bola Tinubu’s activities to commemorate first anniversary of the administration emanating from his two spokesmen may have sparked confusion between the two image makers.

Ajuri Ngelale, special adviser, media and publicity to the president clarified that presidency has nothing to do with the planned 25th celebration of democracy being packaged by the national assembly.

Bayo Onanuga, also special adviser, media and publicity, had stated in another release that the president will not make any nationwide broadcast, but will address a joint session of the national assembly.

Ngelale stated that ‘In furtherance of his commitment to delivering good governance, President Bola Tinubu has embarked on the inauguration of strategic projects across the country.

“More transformative projects will be inaugurated by President Tinubu’s administration for the benefit of all Nigerians.

“In view of public commentary concerning the President delivering a speech before a Joint Sitting of the National Assembly tomorrow, May 29, 2024, it is important to state that this information is false and unauthorized as the Office of the President was not involved in the planning of the event.”

Onanuga, had earlier released that “President Bola Ahmed Tinubu will not make  a  broadcast to the nation on Wednesday to celebrate his first anniversary as the leader of Nigeria.

“Instead, the President will address a joint session of the National Assembly, which has lined up a programme to commemorate 25 years of the nation’s democratic journey at both the executive and legislative levels.

“President Tinubu’s speech  will dwell on the achievements of his administration and Nigeria’s democracy since the military ceded power in 1999.

“Former Senate President, Senator David Mark, former speaker of the House of Representatives and now President Tinubu’s Chief of Staff, Rt. Hon. Femi Gbajabiamila are all lined up to address the parliament.

“Also lined up to speak is the former military ruler, General Abdulsalami Abubakar, who handed over power to civilian administration in 1999.

Kano Royal Stool Face Off: Conflicting Judicial Rulings Heighten Tension, Anxiety

0
Aminu Bayero and Sanusi Lamido

By Suleiman Anyalewechi

In what may readily pass as a manifestation of judicial shenanigans in the ongoing struggle for the control of the soul of Kano Emirate, two high courts sitting in the ancient commercial city delivered conflicting rulings which have tended to further complicate the stalemate.

First in what appears to be  a reinforcement of an earlier order restraining the Kano State Authorities from dethroning Emir Aminu Ado Bayero and four others, Justice S. A. Amobeda of a Federal High Court sitting in Kano,  on Tuesday May 28, 2024 granted an order directing all relevant Authorities ,Security Agencies inclusive, to evict the Kano State Government backed Emir Muhammad Sanusi from the main Kano Emirate Palace which he has been occupying since his purported reinstatement on Thursday, May 23, by Governor Abba Kabir Yusuf.

The Source reports that Justice Mohammad Liman of the Federal High Court Kano had, on same Thursday ,May 23 2024, issued an order restraining the Kano State authorities, particularly Governor Yusuf from deposing Emir Bayero pending the determination of a  substantive suit filed by the applicants .

However, in contravention of the order, Governor Yusuf deposed Emir Bayero and four other Emirs of Gaya,Karaye,Rano, and Bichi, and  reinstalled Emir Sanusi ,after signing into law the 2024 Kano State  Emirates amended bill that, at once, voided the 2019 laws which recognized five Emirates.

But the refusal of Security Agencies to enforce the deposition efforts prompted the Kano State Government to approach and subsequently secured an order from a Kano State High Court on Monday, May 27, compelling security agencies to enforce the deposition of Emir Bayero .

Specifically, Justice Amina Adamu Aliyu had directed security agencies to evict Emir Bayero from the mini Emirate palace in the Nasarawa area of  Kano, insisting that his continued stay both at the Palace and Kano poses a great threat to the peace and stability of the state.

But ruling on an ex parte motion brought before him by the camp of Emir Bayero ,Justice Amobeda of the Federal High Court Kano issued an interim order directing Security Agencies and other relevant authorities to evict Sanusi, noting that such is imperative for the continued existence of peace and stability in Kano.

“An order of interim injunction restraining the Respondents ( Kano State Government ,Security Agencies and any others) from inviting arresting, detaining threatening intimidating, and harassing the Applicant( Bayero) or infringing on his rights is hereby granted ” Justice Amobeda further ruled

Similarly,to protect Sanusi and  its earlier order Justice Aliyu again same Monday May 28 issued an order restraining Security Agencies and or any others from  harassing Sanusi and or other key persons in relation to the ongoing Royal tussle.

“This order prevents any interference with the Emir’s autonomy and the seizure of key symbols of his authority ,such as the twin spear ,the Royal spear and Hat of Dabo and the Ostrich-feathered shoes.

“An order of interim injunction is granted restraining the Respondents from harassing or intimidating the Applicant or confiscating any symbols of the Emir’s authority .

“The Respondents are ordered to maintain the status quo pending the hearing and determination of the motion on notice ” Justice Aliyu ordered.

Justice Amobeda has fixed June 4, 2024, for hearing of the motion on  notice ,while Aliyu of the Kano State High Court adjourned hearing to June 13, 2024.
