The United Kingdom Conservative Party Leader, Kemi Badenoch has hailed the country Supreme Court’s ruling on transgender women, describing it as a ‘victory’.
The UK apex court, on Wednesday, ruled that the legal definition of a woman is based on biological sex following a legal challenge by For Women Scotland, FWS.
FWS had contended that including trans women in the definition of woman under the Equality Act 2010 and related Scottish laws could undermine sex-based rights and affect single-sex spaces and services such as shelters, hospital wards, and sports.
Ruling on the appeal filed by For Women Scotland, FWS, the court, according to a unanimous judgment said the ruling has clarified the argument over the definition of a woman, particularly as regards the UK’s Equality Act .
The court said “the concept of sex is binary, a person is either a woman or a man.”
Badenoch said the controversy over the true definition of a woman has now been finally settled, even though the apex court said the ruling is should not be seen as a ‘triumph’ by any of the group.
According to Badenoch, “Saying ‘trans women are women’ was never true in fact, and now isn’t true in law either.
“This is a victory for all of the women who faced personal abuse or lost their jobs for stating the obvious.
“Women are women and men are men: you cannot change your biological sex.”
