Assault on Journalists: Media Groups, JODER, LJL Condemn attacks on Journalists

Saint Mienpamo Onistha

By Akinwale Kasali

The Journalists for Democratic Rights, JODER, has condemned in its entirety the abuse, unlawful arrest, detention and maltreatment of Saint Mienpamo Onistha, a Journalist.

JODER said the Bayelsa State based blogger is being persecuted for exposing inadequacies in  the Bayelsa State Government.

Onistha was handcuffed, brutalized and treated like a common criminal for discharging his duties as the watchdog of the society by disseminating information to the public.

Onistha is the Publisher of Naijalivetv.com, an Online Media platform. He was arrested for his report on the Bayelsa State Tribunal Matter against the Bayelsa State Deputy Governor and the story on Kogi State Isolation Center.

According to Onistha, he was arrested, handcuffed, tortured and maltreated, and asked to disclose where he got the Subpoena documents he used in writing the story against the Bayelsa State Deputy Governor.

Recounting his ordeal, Onistha said, “I was tortured with mosquitoes feasting on me. I was interrogated daily, on how  I got my information, forcing me to disclose my source.

“They alleged that I have offended the State government and I was going to suffer for it. I was dehumanized, maltreated, abused and starved of food. I was forced to make statement on duress.

“I was forced to apologized to the State Government under  duress, as I was beaten. I had no choice than to accept my fate and apologized to the Government, knowing that is the only way I can regain freedom.

“I had no choice, and I apologized to the Government under duress. I did not offend

anyone. I am just doing my duty as a Journalist”, Onistha stressed.

JODER’s Executive Director, Adewale Adeoye, who signed the JODER statement condemned the abuse on Onistha, calling on the Nigeria Union of Journalists,(NUJ) Nigeria Bar Association, (NBA) Human Rights groups to intervene.

Adeoye stressed that Onitsha’s travails is another way of gagging the media.

He added that this was just the same way Abba Jalingo was incarcerated by Prof. Ben Ayade, Governor of Cross River State.

JODER called on relevant authorities to look into the issue to forestall a reoccurrence.

In another development, the Lagos Journalists’ League (LJL),  a group of conscientious journalists operating in Lagos has frowned at the barbaric harassment of journalists by policemen Tuesday night.

In a statement issued in Lagos on Wednesday by the group’s acting Secretary, Enitan Olukotun, LJL queried the rationale behind the locking up, and defection of journalists who were designated as essential workers for being on the road after 8pm when curfew sets in.

N48 Billion Agric Scam: PDP Condemns APC, Says Buhari’s Government Stinks

0

…..Alleges FEC Involvement In Racketeering

By Akinwale Kasali

The Peoples Democratic Party, PDP, has condemned, in its entirety, the President Muhammadu Buhari administration and his political Party, the All Progressives Congress, APC, following the revelation of over N48 billion fraud in the Ministry of Agriculture and Rural Development.

The PDP says that monstrous corruption, sleaze and cover-ups are going on in the President Buhari-led administration, alleging that the Federal Executive Council, FEC, members is also part of the sleaze.

In a statement by the National Publicity Secretary, of the PDP, Kola Ologbondiyan, it says the Ministry of Agriculture has become a cesspit of corruption.

Ologbodiyan said the confession by the queried former Permanent Secretary of the ministry, Dr. Umar Bello, that the duplicitous purchase of an ordinary carcass building for a whopping cost of N7.044 billion passed through the Federal Executive Council further exposes the rot that has permeated the Buhari administration.

It said: “The PDP holds that such revelation has again shown how the corrupt cabal in the Buhari Presidency and the APC has been pillaging our national treasury and fleecing our nation of billions of Naira through fraudulent transactions in various ministries, departments and agencies, while parading before Nigerians as saints.

“Nigerians were shocked by reports of how funds meant to service the food security system in our country is being plundered by those in power, resulting in the crippling of our agricultural sector thereby creating attendant hunger and starvation in our land.”

The PDP described as shameful that the FEC, under President Buhari’s watch, is being fingered in financial manipulations and procurement sleazes in the Ministry of Agriculture, including the alleged disappearance of N48 billion contractors’ fund, over N7 billion duplicated payments, diversion of N9.1 billion worth of drilling rigs to unnamed private individuals, purchase of carcass building for N7.044 billion, in addition to misapplication of billions of naira meant for strategic grains, rural grazing area settlement funds and other food production intervention schemes.

It said: “The fraud in the Ministry of Agriculture has further exposed how officials of the Buhari administration and corrupt APC leaders have turned government ministries and agencies into their Automated Teller Machine (ATM) just as the case of exposed looting of billions of Naira in the National Health Insurance Scheme (NHIS), the Federal Inland Revenue Services (FIRS), National Emergency Management Agency (NEMA) among others.

“It is even more distressing that the corrupt cabal continues to enjoy official cover while, in some cases, allowed to sacrifice their fronts to conceal their tracks.

“The PDP, therefore, rejects this attempt at cheap scapegoatism and demands that the Buhari Presidency should immediately speak out and conduct an open investigation that will expose all those involved in this huge scam in the Ministry of Agriculture as well as recover the stolen funds.

“Moreover, the PDP calls on the National Assembly as well as the Economic and Financial Crimes Commission (EFCC) to immediately commence investigation into the behemoth of fraud in the Federal Ministry of Agriculture and Rural Development.”

President Buhari had ordered  that a query be issued to Dr Bello on the allegations. But in answering to the query, Hello said approval was given by the FEC for the purchase.

APC: Fresh Crisis Over Oshiomhole’s Appointment Of Party’s Scribe

0

By Tosin Olatokunbo

A fresh crisis is brewing in the ruling All Progressives Congress, APC barely three months after the Supreme court vacated an order stopping Adams Oshiomhole, the party’s chairman from parading himself as such and reinstated him.

The crisis of leadership nearly tore the party into pieces before the apex court intervened.

Whoever thought that the proverbial sleeping dog has been allowed to rest, is wrong as a fresh wound has now been opened by the party’s deputy National Chairman (North), Lawal Shuaibu, on Wednesday, who warned that Oshiomhole’s leadership posed a danger to the unity of APC.

Shuaibu accused Oshiomhole of various acts of lawlessness, including his appointment of Waziri Bulama as the party’s new National Secretary.

He said the party stood the risk of disintegration if the alleged arbitrariness of its National Chairman, Adams Oshiomhole, was not immediately checked.

He said the reinstatement of Oshiomhole has not taught him a good lesson.

Shuaibu in a statement titled “APC and its future, let us exercise caution,” said the APC boss should be stopped from running a one man show, which is capable of destroying the party.

He insisted that Oshiomhole must step down for the APC to move forward.

The party chieftain said many did not take his concerns seriously when he asked Oshiomhole to step down and allow the party refocus and rebuild.

He said the APC, under Oshimhole’s leadership has been riderless and now  “subject to arbitrary administration, without dictates of the law.

The ruling party which ought to be a model for others in the upholding of the rule of law, is now the nest of lawlessness.”

He said all the issues he raised last year have not been addressed and that situation in the party has now become worse.

The letter read, “Interestingly, all the issues I raised in my said letter have come to pass. Till date, the party, founded on the principles of constitutionalism and rule of law, is now subject of arbitrary administration, without regard for the dictates of the law.

“The ruling party which ought to be a model for others in the upholding of the rule of law, is now the nest of lawlessness. The entire legal framework governing the party administration in Nigeria today, the Nigerian constitution, the party constitution, the Electoral Act and INEC regulations and guidelines are more honoured by the party in breaches than obedience.

“To buttress my above assertion, the following few examples will drive the point home. By (Article 9.1(ii) and 9.4 (i) of the APC Constitution as amended, pages 6 and 8) every member will be registered at his ward when his or her name is entered in the register by the Ward Executives.
My understanding of this provision is that power in the party is exercised bottom up! What this means is that every member of the party is answerable to his constituency. Being a party member therefore is a constitutional issue embedded in the membership register.

“Also, the constitution of the party stipulates a mandatory meeting of the National Executive Committee (NEC) every three months (Article 25 B (i) of the APC constitution as amended.). This regular meeting is not only targeted at keeping the members abreast of developments, but ensuring collective responsibility of decision taken by the combined effect of the above provision and Article 18 of the APC Constitution as amended).

“NEC is the main decision-making organ after the convention, and shall meet every three months. The power to set up standing or ad-hoc committees of the party is vested in the same NEC.”

He said the party boss has become a dictator who now runs the party as he likes without inputs from other members of NEC.

“It is this refusal to convene NEC to perform its role that has led the party to the comatose state it is now. My fear is, it is being repeated now for Ondo and Edo,” he said.

For instance, he said Oshiomhole singlehandedly appointed Bulama as secretary against every democratic norms.

Acxording to him “There is nowhere in that same constitution where it was envisaged that an officer of the party could be appointed by the chairman nor the NWC.

Not even NEC has the power to appoint any national officer of the party in any capacity. Let me ask this simple question, what is difficult in organising a midterm convention to elect the officers in line with the constitution so that even the officers will have confidence that they are elected like all other officers.

The constitution of the party in Article 25 (A) (1) page 89 stipulates that there shall be a convention every two years.

We had convention in 2018 and another one is due in 2020. What is the hurry in appointing an acting national secretary when we have the duly elected Deputy National Secretary who have been acting in that capacity since December 2018 in line with Article 14.4 of the constitution on page 58?”

Shuaibu called the party leadership to intervene.

He said “What are the leaders of the party doing in the midst of this anarchy? Are they all equally fed up with the seeming collapsing party in the hands of a politically injured person that seems to be nursing political revenge? The leaders need to take a stand so that the followers know whether the party is now either a jungle or that entity of our collective dream at the inception.

Majority of the members of the party are already perplexed, disillusioned and some even weighing their options. A stich in time, I believe, saves nine!

Article 2 of the APC Constitution, provides that subject to the provisions of the constitution of the Federal Republic of Nigeria, 1999 (as amended) and any other laws for the time being in force in the Federal Republic of Nigeria, the provisions of this constitution SHALL be SUPREME PROVIDED that where any rule, regulation or any other enactment shall, to the extent of its inconsistency, be null and void and of no effect whatsoever.

This document leaves no room for any form of aberration or brigandage.”

Shuaibu has last May demanded the resignation of Oshiomhole who he said was responsible for the APC electoral misfortunes in Zamfara and other states.

Meanwhile, the magazine learnt some APC governors not happy with his leadership could revisit their demand for him to step down, this may further divide the party as governors supporting him will rally behind him, political analysts say.

Rivers:Wike’s Signature Sells For N6k

Governor Nyesom Wike

By Adesina Soyooye

In Rivers State and environs, Governor Nyesom Wike’s signature is selling like hot cakes.  It has become a money spinner in the hands of unscrupulous people.  They fake it and give to those who are desperate to go about their businesses in the state.

In the face of COVID-19 and the accompanying lockdown in  the country,  a Pass is needed to be issued by authorising authorities for movements.

In Rivers State,  Governor Wike is the only authorising authority. He dubbed any other pass, including those issued by the Police  fake. He does not recognise them. He calls them illegal, and accused the DCP Operations, Rivers Police Command, of collecting money from companies to issue them with illegal Passes.

He has opened an ATM business for criminally-minded people.  They now either clone it, or scan it, and use it to issue fake passes to individuals and companies.

The bubble burst for some of them on Wednesday when passengerd were hidden inside a trailer carrying building materials. They were intercepted by the Rivers State Task Force on COVID-19 at Rumuigbo. The Task Force was aided by  Ijaw youths  and  residents.

When the trailer was searched the passengers said they paid the sum  of six thousand Naira each. They presented Passes, signed by the Governor.  And the Passes were easily found to have been scanned.

The lockdown excludes those on essential services. It also excludes those transporting foodstuffs. But it has variously been abused, and reduced to money making ventures. The trucks and trailers transporting foodstuffs and other essential materials, now use it to smuggle in people to various states, especially, to Southern states.

Orji Kalu To Remain In Jail Till June 2

0

By Adesina Soyooye

A Federal High Court, Lagos Division,  has slated June 2, to hear the case in the battle to release former Governor of Abia State, and Senate Chief Whip, Chief Orji Kalu from jail.

Kalu and the Director of Accounts, Government House, Abia, while he was Governor, Jonnes Udeogu,  were on December 5, 2019, sentenced to 12 years and 10 years jail terms respectively by the Hon.Justice Mohammed Idris in a case brought against both men by the EFCC.

The EFCC had accused them of fraud and corruption to the tune of N7.1billion.

But penultimate week, a seven-man panel of  the Supreme Court quashed the sentence for lack of jurisdiction in a case brought by Udeogu.

Udeogu had argued that Idris, having been elevated to the Court of Appeal, no longer had the jurisdiction in the case. The Justices of the Supreme Court agreed with him.

Kalu, as did his family, friends and associates had celeberated the judgement, thinking it also affected him. But he filed no case before the Supreme Court, and so did not from  the ruling. Only Udeogu who filed the case benefited from it.

Kalu remains in jail against his expectations.

On Wednesday, he filed a case at the Federal High Court, Lagos, before Justice Mohammed Lima, seeking his release, and describing his continuous stay in jail as an illegal detention.

An array of 12 Counsels, including six SANs, will argue his case on June 2.

Pundits say he is, most likely, to be released, given that the Supreme Court has declared Justice Idris’ judgement, null, void, and, therefore, of no effect.

Cross River: Tax Consultants In Trouble

0
Professor Ben Ayade

Illegal tax collectors masquerading as “Tax cmConsultants” are common sight in Cross River state.

Even in the hinterland, they often lay siege on poor peasant farmers, taxing them mercilessly on their farm produce.

A House Wife’s Woes

A housewife in Bekwara council area of the state narrated how men who identified themselves as “tax consultants” once pounced on her demanding “tax” on livestock she was taking to the market to sell.

“They were so aggressive and refused to heed my pleas that I needed to sell my goat and chicken to feed my children”, she told The Source.

Businesses Relocate

As a result of the illegal collection of multiple taxes by the illegal collectors or “consultants” as they baptized themselves, this magazine was told that small scale businesses that could not cope with the burden have since relocated out of the state, particularly Calabar, the capital city.

Ayade to the Rescue

Saddened by the ugly situation, the state governor, Professor Ben Ayade, upon assumption of office in 2015 exempted certain categories of businesses from paying tax.

However, like a hydra headed monster, the perpetrators of the illegal act continued in their act thus attracting the governor’s ire.

Wednesday, Professor Ayade sought to permanently clip the wings of the “tax consultants” when he inaugurated what could pass as anti- tax police.

Enter Anti- Tax Agency

As part of COVID-19 palliatives, and in furtherance of the State tax exemption law, the governor inaugurated the anti-tax Agency with a charge to ensure small that scale businesses and peasant farmers enjoy tax holiday.

He insisted that the poor must be protected.

The governor frowned at the activities of illegal tax consultants, who he said impose unnecessary taxes on the poor and vulnerable in the state and urged members of the Agency to immediately swing into action.

“I charge you that this responsibility comes with its own troubles, you have a choice to do that which is good and the selection of this team is based on your history, it’s based on your profile ,the understanding of your closeness to God and that you will do that which is fair to all manners of people equally and fairly.

“We charge you to ensure that the poor masses of Cross River State and the small business owners do not come under the harsh hands of the desperate search for money by tax consultants”, Ayade told members of the Agency which is comprised of Christian clerics.

Continuing, he further implored the members: “Your responsibility from today going forward is to put and end to illicit taxes on people. We have a tax law here that prescribes the people who are exempted from tax.All those categories of people and those that from time to time will be so announced by the Governor, including every single hotel that has less than 50 rooms in Calabar and the whole state, today, are exempted from payment of taxes.

“We have exempted all Okada riders, taxi drivers airport taxi drivers, small saloon owners, small catering and restaurant points popularly called mama put. All those people who sell basic things struggling to earn a living, they have been exempted today from paying tax. We have exempted them because it is better for me as a Governor to rather task my brain, than to tax my people.”

I’m not Interested in Taxing the poor to Generate Income

Governor Ayade said though the state was facing precarious financial situation, he was not interested in generating income from all sources, including imposing tax burden on the small scale business and service providers.

“My governance does not entail that income must come from all sources. If we don’t have enough why do you put pressure on that your brother or sister whose situation is much worse? Why do we expect that people who don’t have scholarship for their children, struggling to pay school fees, struggling to get uniforms, struggling to secure their small businesses, struggling for water, struggling with power and government is providing almost nothing, why do tax them? I think it is injustice.

“This is part of my post Covid 19 response. So as part of the post Covid 19 response action plan of Cross River State we are exempting a larger part of the public from  tax”, he quipped.

Resist “Tax Consultants”

Ayade advised small scale business owners to resist illegal tax collectors, saying: “Anyone who comes to you to demand tax, you have a right to say stop, the Governor has said we should not pay tax and if we have to pay tax, then let me contact the anti-tax agency to tell us whether we fall under the category to pay tax or not.”

He urged members of the Agency to take their assignment seriously as all eyes are on them: “I charge you to take this task very seriously. I want to hear you everyday on radio and tv listing those who are to be exempted and telling them what to do if any tax consultant or any person comes before them. I have abolished tax consultants at this category. No tax consultant is allowed and I give you the powers to arrest any tax consultant you see and we will try him under the Cross River State Tax Exemption Law and jail him for putting pressure on already pressurized people.

“Today is the end of the bullish drive for tax and I know that the team I have assembled is not a team that will collect patronage, it’s not a team that will close their eyes to injustice. I choose only people who are close to God.”

We will End the Reign of “Tax Consultants”

Replying, Chairman of the Agency, Bishop Emma Isong, commended Ayade’s passion for the downtrodden and promised he and his team would deliver.

He thanked the Governor for finding them worthy of serving the people of the state.

“Your Excellency today you have proven to the world the kind of politician you are. By inaugurating this agency, your passion for the downtrodden has been proved to the whole world. On behalf of members of this Agency, I wish to thank you immensely for the opportunity.

“It has always been my passion on how we can encourage small businesses to thrive. You have proven to me by this appointment that you are detribalised and I want to thank you so much for believing in me”, Bishop Isong said.

Clerics as Anti-Tax Police

The Four-Member Agency is comprised of Bishop Emma Isong as chairman and Rev.Fr Julius Ada Secretary.Others are Pastor John Ekpenyong and Rev.Sister Patricia Olom.

Rivers: Anarchy Looms, As FG Checkmates Wike; Why The IGP Acted; Gov Cries Out

0
Governor Nyesom Wike

By Gideon Njoku

The Rivers State Caucus in the National Assembly, has described as shocking, a recent action by the Force Headquarters in the State.

Reportedly on the instructions of the Inspector General of Police, (IGP) Mohamed Adamu, the Commissioner of Police, Rivers State Police, John Mukan, has set up a Technical Committee to oversee the movement and right of way of trucks carrying agricultural products and other essential items given the lockdown meant to stem the spread of COVID-19.

But the Rivers State National Assembly Caucus, led by Senator George Sekibo and Hon. Kingsley Chinda, is crying foul. At a Media briefing in Abuja, they said the activities of Committee, will spell doom. They say it is a deliberate action to undermine the powers of the state government, and erode the gains already made in the state in the battle against COVID-19. They are it as a parallel Task Force in the state, emphasizing that there cannot be two Chief Executives in the state, a position they accuse the CP of indirectly assuming.

The Governor of the State, Nyesom Wike, is, also, crying blue murder. He is accusing the Federal Government of planning to declare a state of emergency in Rivers state in order to assuage their thirst of conquering the state, a  desire, he accuses the FG of long been nursing.

The setting up of the Technical Committee nh the Police, stems from the untidy relationship between the State and FG since the COVID-19 lockdown. The strong feeling, among many, is that the Governor has reduced the lockdown to a political weapon. But he has vehemently denied it, saying every of his action was to protect the state from the ravaging Virus.

Some of his actions and utterances were seen in some quarters as deliberately crossing the borderline.

It began with the Governor’s seizure of a  helicopter belonging to Caverton Helicopters which flew Oil workers into the Airforce Base, PH. He arrested the crew members( two Pilots), and the passengers, and had them charged to court.

They were detained, thereafter.  It took a combination of pleas and threats from the Company, and all the Associations in the Aviation Industry to agree that they be released on bail.

Before the bail, he had declared the company personae non grata in the state, sealing its offices. The Court trial continued,  until this Tuesday, when he ordered that it be discontinued.

The incident caused the then Police Commissioner in the state his job.

Next, he arrested Exxon Mobil workers on their way to Onne Port from Akwa Ibom state. He had them quarantined. It took a threat of a strike by oil workers to have them released.

Marine workers also had their taste of the Wike treatment. They were arrested, and it took another round of threats to secure their freedom.

But Wike’s argument, always, remained that nobody told him of the status of those entering the state, and that it was a deliberate breach of the complete lockdown he had ordered in the state.

He then upped the ante by establishing the State’s Task Force to enforce his lockdown order, saying that he could no longer trust other Security Agencies,  the Police, in particular, to protect his people.  He said they were deliberately engaging in the importation of the Virus into the state, and accused them of sabotage, insisting: “they wish my people dead”.

And, worse, he publicly accused the DCP Operations, Rivers Police Command, of taking bribes to allow people to breach the lockdown he ordered.

The irony was that the Governor expected the Police to accompany his Task Force Members in order to give them security backing. They did, initially.

But the IGP withdrew them from the Task Force.

The PDP, Wike’s political party, cried foul, asking that the Police attached to the Taskforce be reinstated. They were not restored. But that did not deter Wike.

He, atimes, led the Taskforce himself, enforcing the lockdown order, impounding trucks, vehicles and cows, and saying he would auction them. He also arrested, at a point, policemen too, whom he felt could not explain, properly, what they were doing driving along some particular roads.

The allegation became rife that the Governor was not allowing agricultural products to be transported into the state. And that some of the actions he had taken, and might take,  could hurt more, the country’s already basket economy.

They point at the cases of the Aviation, Oil, and Dock workers.

Something had to be done. And it came in the setting-up of  the Technical Committee  in the State to ensure the free movement of agricultural products and other essential items in the state.

But the Rivers State Caucus  in the NASS is crying foul. And so is the Governor.

On Tuesday, Wike accused  the FG of planning to declare a State of Emergency in the state because of his fierce protection of his people against contracting COVID-19.

But the State’s NASS Caucus leaders, Senator  Sekibo and Hon. Chinda,  speaking at a Media briefing in Abuja say the setting up of the Technical Committee in the State is an invitation to anarchy. They want the Committee disbanded, a request the Rivers State Council of Traditional Rulers had also made.

Condemning it, they called on President Buhari, and the IGP to disband the Committee.

Their words: “The development is sour, and highly confrontational, not only to the authorities of the Rivers State Government, but also to the people and residents.

“It is essentially antithetical to, and a reversal of the aims and a reversal of the aims and purposes if the COVID-19 interstate lockdown and measures to curb the pandemic.

“It is in this regard that we join the Rivers State Council of Traditional Rulers to request the IGP to reconsider the action.

“We run a Federal System of Government, and cannot afford to have two Chief Executives in Rivers state at the same time. That will be a clear invitation to anarchy.”

They accused the State CO, John Mukan, of setting up a parallel Task Force in the guise of a Technical Committee, saying that the Committee has even assumed the task of who enters the state or not.

For now, the tension in the state is high, and the people hardly know what to expect next. They fear that a clash between the Task Force set up by the State Government, and the Technical Committee set up by the Police may be imminent, and could be bloody.
