2023 Presidency: Ngige, Amaechi Get Court’s Approval To Run

Relief has come the way of some presidential hopefuls in the ruling All Progressives Congress, APC following an Appeal Court judgment, on Wednesday which voided Section 84(12) of the Electoral Act 2022. The section bars government appointees at state and federal level from contesting election.

The section provides that, “No political appointee at any level shall be a voting delegate or be voted for at the convention or congress of any political party for the purpose of the nomination of candidates for any election.”

Recall the ministers have opted not to resign claiming that the section negates the provision of the constitution

For instance, the Minister of Labour and Employment had insisted that the Act sought to disenfranchise him against the spirit of the constitution, noting that the Act is inferior to the 1999 Constitution as amended.

According to him, “An Act is inferior to the constitution, an Act cannot also take people’s right away from them, rights given to them by the constitution. So, to that extent we leave it that all these things will be decided at the realms of the law.

“I am a law abiding citizen, if the law says that we shall resign 30days before election and that is the supreme law and another smaller law says you resign 90days or 80days before, I will obey that which is in the constitution.”

“And the Constitution of the federal republic of Nigeria is supreme, it is the supreme law of the land. I haven’t also seen the party (All Progressives Congress) guideline, it is only speculative, it is in the realm of the media.

“You people want to pitch us against our party. Our party is a legal entity drawn from the constitution. We owe our formation as a political party to section 40 of the constitution, freedom of association where people are allowed to come together and form association, which can be political parties.

“Some other associations can move to become labour unions, group of workers; so there is freedom of association. Our party exists because of that portion of the constitution. So, our party is constitutionally birthed and recognised.”

The implication of the judgment, watchers of events say, is that the ministers who have indicated their interest in the presidency can go ahead to contest without resigning their positions as provided in the act.

Apart from Ngige other contesting ministers include Rotimi Amaechi (Transport); Chukwuemeka Nwajiuba (Education), amongst others.

Pressure had been mounted on the ministers to resign after President Muhamamdu Buhari signed the Act passed by the National Assembly in January.

Nduka Edede had challenged the Act before a Federal High Court in Umuahia which ruled in his favour.

But ruling on the appeal today, the Abuja Division of the Court of Appeal set aside the judgment of Justice Evelyn Anyadike of the lower court which voided the provision of Section 84(12) of the Electoral Act 2022, citing lack of locus standi on the part of the plaintiff and lack of jurisdiction by the trial court.

The Court of Appeal struck out the suit marked: FHC/UM/CS/26/2022 which Edede filed before the FHC in Umuahia.

While determining the appeal on the merit, the Appellate Court held that the provision was unconstitutional because it violated Section 42 (1)(a) of the constitution and denied a class of Nigerian citizens their right to participate in election.

Jonathan In Dakar For Sub-Regional Dialogue On Democracy, Peace

Former President Dr. Goodluck Ebele Jonathan arrived in Dakar on Tuesday to participate in a Sub-regional dialogue on sustaining democratic principles in West Africa organized by the West African Elders Forum (WAEF).

Dr, Jonathan who is the chair of WAEF will be declaring the event open alongside Senegalese President Macky Sall. The two-day programme, beginning on May 12, 2009, will provide the opportunity for former heads of state and other thought leaders in the sub-region to review recent socio-political developments, identify challenges and offer some recommendations that would enhance credible elections and peaceful transition of power in the sub-region.

Other notable leaders from the sub-region expected at the event include former Sierra Leonean President Ernest Koroma, former United Nations Special Representative to West Africa and the Sahel, Mohammed Ibn Chambas and former President of the ECOWAS Commission Dr Thomas Ouedraogo.
Participants at the dialogue will be focusing on many issues affecting the growth of  democracy in the sub-region including constitutional term limits, credible elections as well as return of military coups and unconstitutional change of government.

They will also examine processes of galvanizing and harnessing subregional and regional responses to the socio-political challenges affecting West Africa’s democratic progress and advancement.

Since inauguration last year, WAEF, an initiative of the Goodluck Jonathan Foundation, has continued to champion causes that promote, peace, democracy and good governance in the sub-region.

Two months ago, the Forum made up of mainly former Presidents and prime ministers from the sub-region  convened a strategy meeting where they shared their thoughts on the democratic trends in West Africa.

During the inauguration of the Forum in March last year, Dr. Jonathan, Chief Olusegun Obasanjo and six other former West African leaders resolved to collectively exert their enormous goodwill towards ensuring peace in West African nations, by promoting credible elections and good governance, in order to prevent the nations from descending into crises.

Other former Presidents who participated in the virtual event where a mechanism targeted at preventing and resolving election related conflicts and maintaining stability in the sub-region was established include Pedro Pires Cabo Verde, Mrs. Ellen Johnson Sirleaf Liberia, Amos Sawyer Liberia, Ernest Bai Koroma Sierra Leone as well as former Head of State General Abdulsalami Abubakar and Mrs. Aminata Traore, former Senegalese Prime Minister.

N100m Nomination Form: PDP Accuses APC of Stealing Government Funds for Elections

The Peoples Democratic Party, (PDP), has accused the President Muhammadu Buhari Presidency of allowing the mass looting of public funds to corruptly create a war chest for the APC to intimidate Nigerians and muscle the 2023 general elections.

The PDP was reacting to the embarrassing number of Presidential aspirants who are paying the sum of NI00m, each, to purchase the Expression of Interest and Nomination forms.

At the last count, at least 20 of them have made public their ambition, and are purchasing the forms. They include, surprisingly,  members of the President’s Cabinet and state Governors.

Not a few people are of the impression that the APC has reduced the aspiration to the office of the President to a huge joke. But many are of the strong belief that the APC is, deliberately, hiding under the forms to raise money for the 2023 elections, as indeed, a number of those who purchased the forms know they would never win a Local Government Area Chairmanship election in their States.

The PDP which own forms cost N40m is of this opinion. In a statement on Tuesday, May 10, 2022, signed by its National Publicity Secretary, Debo Ologunagba, the PDP called for an investigation into the sources of the funds being paid for the forms, by especially, Ministers,  and accused  the APC Federal Government of a brazen looting of public funds.

Following are excerpts from the statement.

“The PDP alerts that the APC is diverting public funds meant for development purposes and salaries of workers to its coffers by orchestrating the purchase of its Presidential nomination form by all manner of persons at excessive N100 million to warehouse sleaze funds for the elections

“Our Party has information of how public funds are being withdrawn from Ministries, Agencies and Parastatals of government and diverted to people who have no verifiable means of livelihood to purchase APC’s Presidential Nomination and Expression of Interest forms for individuals without any electoral value and who cannot even win Local Government elections.

“We have intelligence on how public funds are pulled out of government Agencies in a surreptitious design perfected by an APC leader in connivance with certain individuals in positions of authority close to top persons in the Central Bank of Nigeria (CBN).

“Nigerians will recall that the PDP had earlier alerted on how the CBN under Mr. Godwin Emefiele as CBN Governor has been turned into the finance department of the APC where APC leaders fraudulently access public funds through nebulous subsidies, shady intervention programmes and discriminatory exchange policies which perpetuate illegal arbitrage system

“The rejected APC has resorted to this underhand method to corruptly rake in billions of naira from public treasury without consideration for the welfare of Nigerians.

“This APC’s nefarious action is informed by its realization that its leaders cannot make huge donations to the APC coffers as they will be violating the limits of contribution to political parties as stipulated by law and regulation.

“The APC is a sinking ship with ill-fated and inchoate sailors holding on to straw including this shameless attempt to sweep our national treasury. It is regrettable that the APC has shamelessly and soullessly extended their corruption to our electoral process not minding the consequential effect on our democratic system.

“In any case, such shenanigan and criminal pillaging of our treasury cannot prevent the imminent crushing defeat of the APC at the polls in 2023, Nigerians having realized the fraud and life discounting experiences that the APC represents.

“The PDP calls on the Economic and Financial Crimes Commission (EFCC), the Accountant General of the Federation as well as the Auditor General of the Federation to immediately commence investigation and monitor the movement of funds in Ministries,   Department and Agencies of government so as to protect our national treasury from the APC as we approach the 2023 general elections.

“The National Assembly, pursuant to its constitutional duty to expose and prevent corruption should in the interest of Nigerians commence a public investigation into these happenings.”

PDP: Crisis In Oyo, As Senator Balogun Dumps PDP For APC; Calls Makinde’s Project Fraud

The Crisis rocking the Oyo State People’s Democratic Party, PDP, took another twist, as one of its stalwarts, Senator Kola Balogun, representing Oyo South Senatorial District has  defected to the All Progressives Congress, APC.

The Senator who is the younger brother to the New Olubadan of Ibadan, at an event held at the APC State Secretariat, Oke-Ado, Ibadan, on Tuesday, formally joined the APC, collapsing the structure of the PDP in his Senatorial District.

For weeks, Senator Balogun and Governor Seyi Makinde had engaged in a soft war, following allegations that the Governor, who owns the PDP structure in the State was not willing to give the Senator a ticket to return to the Senate for a second term on the platform of the PDP.

At the defection ceremony, Senator Balogun appreciated President Muhammadu Buhari, APC loyalists, its leadership and his supporters, the State Party Chairman, Hon Isaac Omodewu, and other Party Executives for accepting him back to the party.

He claimed he had gone to the PDP on sabbatical and now back home.

Berating the Governor Makinde-led administration for the increasing spate of insecurity in the state, Senator Balogun emphasized that hoodlums now kill recklessly daily in the State capital.

“People are being killed every day, yet the governor is not doing anything about it,” he said.

On Makinde’s Light-Up Oyo Project, Senator Balogun said using diesel to power generators to run the streetlights is fraud and a waste of resources.

“They claimed they’re lighting up Oyo State with streetlights. Ask them: whose company is selling the diesel they use to power the generator used to run the street lights? They are just serving their interests,” Balogun stated.

However, commenting on how he got the Senatorial ticket in 2018, Senator Balogun said: “When in 2018, I was given the ticket, I was told it was a delicate one. The party offered Adeniran and Sarafadeen Alli but they rejected it; I received it and God favoured me. Today, those who helped Seyi Makinde to win the election have left him, yet he kept saying ‘no problem,’ but he would soon realize that there are ‘problems.”

Welcoming Senator Balogun into the APC fold, the State Chairman, Hon. Ajiboye Omodewu said APC was lucky to have the three Senators and 11 House of Representatives members in the State, which, according to him, would give the party opportunity to win the 2023 election in the state.

In his comment at the event, Senator Abdulfatai Buhari said the coming of Senator Balogun into the APC would foster unity and enhance collaboration among federal lawmakers.

He, however, tasked the party members to unite and ensure they work for the emergence of the party in the next election.

With the defection of Senator Balogun, the ruling PDP in the state, led by Governor Makinde’s administration, has no elected representative in the upper chamber of the National Assembly.

Mixed Reaction Trails Exclusion Of Osimhen From Super Eagles Friendlies

Soccer enthusiasts have frowned at the Nigeria Football Federation, NFF and Assistant Coach of the Super Eagles, Salish Yusuf, for not inviting Napoli Football Club of Italy Striker, Victor Osimhen, for the international friendly matches against Ecuador and Mexico scheduled for the United States of America.

Yusuf released a 30-Man list of players that would prosecute both friendlies in preparation for the 2023 African Cup of Nations qualifiers, including Fatih Karagumruk Football Club of Turkey winger and Captain of the Super Eagles, Ahmed Musa and forward Moses Simon, ahead of the prestigious international friendly matches.

The inclusion of Musa has however generated controversy.

Fans and observers of the team argued that Musa’s days are numbered in the team as he has no impact in the team, just merely making up the numbers.

The Coach also invited new faces which is said to be a welcome development.  However, despite the invitation of some new faces, Nigerians have expressed their dissatisfaction with the list.

Some questioned the inclusion of Musa, while many others hit out at the NFF over the absence of Victor Osimhen.

A section of the fans also asked who would lead the team out, given the 2013 African champions are currently without a coach.

But despite the fans’ anger, the Mexico and Ecuador friendlies will be the start of a new era for the Super Eagles.

The three-time African champions will hope to put their World Cup failure behind them as they start a new chapter. The Super Eagles missed out on World Cup qualification after losing to Ghana via away goals.

The three-time African champions will clash with CONCACAF powerhouse Mexico at the AT & T Stadium in Dallas, State of Texas on Saturday, 28th May, before flying to New Jersey to tackle Ecuador at the Red Bull Arena in Harrison on Thursday, 2nd June.

Yusuf, who is also Head Coach of the CHAN and the U23 teams, has included eight home–based professional players, including goalkeepers Adewale Adeyinka and Ojo Olorunleke, defender Ibrahim Buhari, and forwards Victor Mbaoma and Ishaq Rafiu.

Continued ASUU Strike: NANS Declares Operation Test Run, To Ground Nigeria For Three Hours Daily

Frustrated and tired of continued stay at home, universities students are set to confront the federal government over its passive response to continued strike by the Academic Staff Union of Universities, (ASUU).

ASUU leadership had on Monday extended its strike by another three months after completion of over two months no work order.

The students under the eagis of the National Association of Nigerian Students, (NANS) are set to paralyse economic activities and ground commercial activities nationwide to compel government to meet demands of the striking lecturers.

NANS President, Sunday Asefon condemned what he described as government’s lack of concern and empathy to the plight of parents, who are direct victims of the continued ASUU strike.

Asefon, in a statement, declared that “The 3months extension of the strike is totally condemned. The failure of the government to reach agreement with ASUU underscores their lack of concern and empathy to the plight of the common men and women of our nation who couldn’t afford private tertiary institutions.

“Having exhausted all window of constructive engagement with the government. I, on behalf of the national leadership of NANS therefore declare National Action from tomorrow 10th.

“The National  Actions is tagged “Operation Test Run” Operation Test Run shall be held in all the 36 State of the Federation. Federal Roads across the 36 States shall be occupied for a minimum of 3hrs.

“The Operation shall be a precursor to a total shutdown that will be decided during our Senate meeting/pre-convention on Saturday 14th May 2022. Our decision from the pre-convention be binding.

“The action shall be total as the extension of the ASUU strike is a direct declaration of war by the Federal Government against university students in Nigeria.

“Our proposal to congress on the 14th shall be total blockage of the airport roads across the country and total disruption of political party primaries, blockage of the national assembly until they are committed to passing legislation banning public office holders from sending their children to university abroad.

“We therefore advise divisive elements or paid agents of government to stay clear of our actions as the consequences shall be severe.

“By this release, all JCC Chairmen, Zonal Leaderships and Stakeholders are directed to act appropriately and ensure total compliance to the directive of “Operation Test Run” Shut down the Federal Roads in Your State, the nation must feel the heat.

“I therefore call on NLC, TUC and Civil Society organisation to join us to savage the remaining crackers of our public tertiary education in Nigeria. Let me assure you, I will lead from the front.”

2023: Calls For Buhari’s ‘ Third Term’ Intensify

Plan to keep President Muhammadu Buhari in office beyond 2023 appears to be gaining traction, watchers of political events in the country have said.The incumbent’s tenure expires next year by which time he would have completed the statutory two terms as commander in chief.
But its seems some vested forces are planning to elongate the president’s tenure beyond what is specified in the constitution, insiders who are familiar  with the issue told the magazine, at a time some politicians are already campaigning to take over power from him next.

Buhari has, however,  promised not to stay in office beyond next year.

An elder statesman, Chief Robert Clarke, a senior Advocate of Nigeria, SAN said on Monday that Buhari can remain in office beyond next year, citing the security situation in the country as a reason. According to him, the president can extend his tenure to tackle an emergency, noting that the prevailing security situation will not allow for a seamless election in the country next year.
Clarke made the assertion on the heels of an earlier call by Afe Babalola, another senior advocate that next year’s election should be suspended, while Buhari hands over power to an Interim National Government, ING. Babalola said the ING must be in office for six months to organise a credible election for the country.
The only elected president that tried to extend his tenure in office is former President Olusegun Obasanjo. He failed in what is now famously known as the third term saga.
Stating his position, Clarke said Buhari must tackle the menace of Boko Haram, bandits, kidnapping before organising a fresh election in the country, noting that this cannot be achieved within the few months before the scheduled 2023 election.
Clark who spoke on Arise Television argued that the months preceding the 2023 elections are not sufficient to put an end to the insecurity, making the conduct of election possible.
He maintained that the Constitution provides that the President can extend his tenure for six months, in the first instance, if he feels that conditions are not good to carry out elections.
He argued that it’s an erroneous belief that the President cannot stay in office for more than eight years of two tenure, saying the President can extend his tenure by at least six months to take care of a national emergency.
According to him,: “The Constitution provides that the President can stay longer than eight years. I’ve always said it. It is in the Constitution. If the situation in which we’re in now continues, and it is impossible to vote in the 2023 election, the Constitution says if a situation persists, the President will write INEC in view of all insurgencies, in view of kidnappings, in view of Boko Haram, I don’t think in these different areas of Nigeria, we can have a good election.
“The Constitution says I am going to stay for six months and in the first instance. So, the fact that the Constitution says the president cannot stay for more than eight years is wrong. Because the same constitution says he can be giving himself six six months if those conditions persist.

“Now, I don’t see any green light. I don’t see how what is happening today can be stopped within a period of six months from today or before February next year when the elections will be held.
“The alternative then is for Mr. President to continue as president, allow the security watches to carry up the mopping up and Nigeria will become stable.”
He explained that the security situation in the country is sending investors away, adding that Nigeria could collapse if these problems are not resolved before any election is held.
He said: “Because I swear to God Almighty, without stability in Nigeria, without security, Nigeria is going nowhere. No foreigner will bring his money and put in any business in Nigeria, when he knows that any of his expatriates who are sent to Nigeria can be kidnapped at any time. So, until all these things are sorted out, I don’t see any green light.”
“If nothing happens before the elections, God forbids, this country will be in flames,” Clarke warned.
He explained that the country has been mismanaged since the return to democracy in 1999.
He added: “I am 84 years old, and I can assure you I’ve had the best time in my life, both in my legal practice, in my social life, in every aspect of life, but I can assure you, that those days are gone by. Since 1999, I have not been a happy man, the way and manner Nigeria has been moved.
“For instance, look at our first President, Obasanjo with due respect. What was the first negative act he did? I want a third term. Can you imagine? But he says, oh, it’s not me who wants it, is my friend who are asking me to go for a third term.
“That is how we started 1999 constitution by looking for loopholes to breach the Constitution. I don’t see any green light for Nigeria. And if we’re not careful, if we’re not careful…the only consolation is this.”

NIMASA DG Harps On Harmonisation Of Regional Ports State Control

The Director General of the Nigerian Maritime Administration and Safety Agency, NIMASA Dr. Bashir Jamoh, has stated that the growth potential and high expectations of maritime stakeholders for the industry would only be realized through the development of a system of harmonized Port State Control inspection procedures for West and Central Africa.

He made the assertion while addressing Chief Executives of all Maritime Administrations signatory to the Abuja MoU at the International Maritime Organization, IMO organized workshop on Port State Control for West and Central African Region. The IMO partners the Memorandum of Understanding, Abuja MoU, in organizing the regional workshop for heads of maritime administrations in Lagos.

Dr. Jamoh, who was represented by the Agency’s Executive Director, Operations, Mr. Shehu Ahmed, identified the importance of effective Port State Control systems to the efficient running of member states’ Maritime Administrations.

According to him, “As we all know, Port State Control provisions are featured in the United Nations Convention on the Law of the Sea (UNCLOS) provision under the duties and responsibilities of Flag states, Coastal states and Port states and it is also highlighted under enforcement in all major IMO and some ILO conventions.

This function entails the enforcement of applicable conventions of the IMO and ILO that have been cascaded down to us as signatory states for domestication through our national laws.”He added that: “It would interest you to know that NIMASA executes four legal instruments in keeping with our international obligations – The Merchant Shipping Act; the NIMASA Act; the Cabotage Act and the most recent being the SPOMO Act for the suppression of piracy and other maritime offences.”

While declaring NIMASA’s unflinching commitment to Abuja MoU in it’s focus for reduction of substandard ships, curbing marine pollution and ensuring good working conditions of crew members onboard ships within member states waters Jamoh urged 22 member countries of the Abuja Memorandum of Understanding on Port State Control (Abuja MoU) to improve on their financial contributions to the organisation

Also speaking at the event was the Permanent Secretary, Federal Ministry of Transportation, Dr. Magdalene Ajani, who represented the Vice Chairman of Abuja MoU and Honourable Minister of Transportation, Hon. Rotimi Amaechi, commended the organizers of the training/workshop for their commitment to developing the most critical resource of all, that being the human element.

On his part, the Secretary General of the Abuja MoU, Captain Sunday Umoren identified the need for continuous capacity building and networking initiatives in order to gain the support of top maritime administrations, MARADS thereby promoting productive working relationships which would in turn, benefit the maritime industries in member states as well as collectively.

Captain Umoren, disclosed that only 14 countries are presently conducting inspections in the region, and called for a Campaign for effective inspection regime with focus on Standards of Training, Certification and Watchkeeping (STCW). He said detentions are not the best parameters to measure port state control efficiency.

The Abuja MoU is one of the 9 Regional MoUs and 1 national MoU established pursuant to IMO Resolution A.682(17) of 1991. The Organization operates under a Cooperative Agreement with the IMO and was established on 22nd October 1999 as an inter-governmental body comprising maritime administrations of countries abutting the Atlantic coast of Africa.

 

Oyo Government Reintroduces History in Public Schools’ Curriculum

The Oyo State Government has prioritized the need for students to be abreast of the historical background of the nation and its heritage by reintroducing History, as a subject, in Public Schools curriculum.

The State Ministry of Education has mandated all Public Primary Schools in the State to immediately implement the teaching of History as an independent subject starting from this term (3rd term) of the 2021/2022 academic session.

Nureni Aderemi, the Executive Chairman, Oyo State Universal Basic Education Board, made this disclosure  on Monday, while monitoring schools’ resumption in Ibadan.

Adeniran who applauded the massive turnout of pupils in public primary schools, said the reintroduction of History is in line with the new education policy of the State Government, and it would make the cultural heritage of the nation not to go into extinction.

He applauded the leadership of Universal Basic Education Commission, Abuja, for the technical support received, as well as the supply of textbooks.

Over Four Thousand, Nine Hundred and fifty (4,950) history textbooks are being distributed to public primary schools state-wide, he said, adding that this will give pupils a proper understanding of the Nation’s history.

He hinted that the curriculum would enable pupils to appreciate history as an instrument of national integration, adding that it would allow students to know the history of the country.

Adeniran, an Educationist, who dazzled OYOSUBEB staff members and teachers by teaching pupils, said he was optimistic that the curriculum would equip the younger generations with the knowledge of the past.

The OYOSUBEB Boss said that the importance of history to nation building, patriotism and human development could not be overemphasized.

Meanwhile, he equally appreciated the Heads of Public Primary schools across the State who have commenced academic activities immediately, saying idleness of teachers or pupils would not be tolerated.

Continuing the monitoring exercise alongside other members of the board expressed satisfaction with the situation they met at some schools visited, compared to the turnout of pupils last week.

The Chairman, however, called on other parents, whose children are yet to return to schools to kindly ensure they do so without hesitation, as academic activities have commenced.

The Executive Chairman and his team monitored schools across Local Governments in Ibadan and Ibadan less city.

My Govt Will Accord Women Adequate Recognition – Anyim; Says It Is PDP Tradition

PDP Presidential aspirant, Senator Anyim Pius Anyim, has assured Nigerian women that they would be adequately recognized if he becomes president in 2023.

Anyim stated this in Minna, capital of Niger State while answering to complaints of marginalization of women in Nigeria, during his consultative visit to the state.

He described women as one of the critical groups in Nigeria he intends to mainstream into governance next year.

The former President of the Senate shared with the frustrations of Nigerian over the inadequate recognition given them.

The Peoples Democratic front runner said women in Nigeria are educated, experienced and very hardworking but regretted that they have not been given opportunities to showcase their skills.

He reminded women that the PDP is their traditional ally and that the setback women have suffered was because PDP lost power in 2015.

According to Anyim, mainstreaming the women would be one of the ways he intends to bring back the good old days of PDP which, he said, Nigerians have been yearning for since 2015.

Said Anyim: “If you look at the Nigerian women, they are very educated; they are well trained but they are not exposed to opportunities.

“I will say, why should a woman be worried when I am coming to run a PDP government?

“In the last PDP Government, a woman was the Coordinating Minister of the economy and Minister of Finance.

“A woman was Minister of Petroleum, a woman was Minister of Aviation”, the Presidential aspirant recalled.

Anyim, therefore, urged women to vote for him in the forthcoming PDP primaries and also during the main presidential election next year to regain their glory and gain more recognition.
