CNPP Hails INEC over Conduct of Osun Governorship Poll, Congratulates Adeleke

Conference of Nigeria Political Parties (CNPP) has commended the Independent National Electoral Commission (INEC) over the improvement in the conduct of the Osun State governorship election held on Saturday compared to that of Ekiti State.

The umbrella association of all registered political parties and political associations in Nigeria, in a statement issued on Sunday by its Secretary General, Chief Willy Ezugwu, also congratulated the winner of the election, Senator Ademola Adeleke on his victory.

Maintaining that the electoral umpire has again given confidence to the people ahead of the 2023 general elections, the CNPP noted that “with the observable improvement in the process of elections in recent times, INEC has continued to inspire more confidence in the electorates across the country.

“This is evidence in the large turnout of voters in Osun State”, saying that “with the reduction in incidents of vote-buying in Osun State due to the presence of operatives of the Economic And Financial Crimes Commission (EFCC) in parts of the State, more Nigerians will be willing to vote.

“Nigerians have known from the conduct of the Ekiti and Osun states’ governorship elections that there is a clear departure from the old ways of electoral impunity occasioned by mass rigging and are now much more willing to vote in future elections.

“We urge INEC to continue to improve on the use of its electronic systems and technology ahead of future elections to ensure free, fair, and credible elections in the country as the only panacea for enthroning good governance in line with the wishes of the ordinary citizens.

“The CNPP heartily congratulates Senator Ademola Adeleke of the Peoples Democratic Party (PDP) on his victory by the popular wish of the people.

“We’re urge the Governor-elect to reciprocate the confidence consistently reposed in him by the people of Osun State by giving the residents the good governance they earnestly desire”, the statement read.

The Independent National Electoral Commission, (INEC) has again proved for the second time within a month that it is capable of organizing a free, fair and capable election.

First, it was that of Ekiti state on June 18 and now Osun, July 16, where the results of the election was declared by the electoral umpire within 24 hours.

Candidates and even stakeholders have applauded the electoral Umpire for this feat. Security agents too are not left out as they were commended for decent policing, which reduced thugerry if any to the bearest minimum during the two elections.

INEC has declared Ademola Adeleke, the candidate of the People’s Democratic Party, (PDP), two time contestant as the winner of the keenly contested election after he defeated incumbent Governor Gboyega Oyetola who is seeking a second term in office.

This victory is unique. First an incumbent was roundly defeated in a state he has been governing for over three years, in a state where Bola Tinubu the APC presidential candidate is believed to have hailed from, apart from Iyiola Omisore the APC national secretary .

The results as announced by INEC show that Adeleke obtained the highest number of votes from 17 of the 30 local governments in Osun State.

His closest rival, incumbent Governor Oyetola of APC won in 13 Local government Areas.

The results showed that Adeleke obtained 403, 371 votes from 30 LGAs while Oyetola got 375, 027 votes. This has further demonstrated that electorate in Nigeria have the power to effect a change in the leadership when they wish. It is equally a lesson to leaders that there will always be a judgement day, close watchers of politics in the country say.

Governor Oyetola has every opportunity to resolve crisis between him and his predecessor in office, Rauf Aregbesola, now Minister of interior, but he never exploited the chances, apparently banking on power of incumbency to get his way. He was Chief of Staff to Aregbesola, so whatever might have caused the feud, ought to have been resolved. After all, Aregbesola has nothing to loose at the end of the day, judging by the results of the election l, analysts contend.

On the eve of the poll, some members of the Aregbesola faction of APC resolved to still vote for the candidate of their party, but this may just be mere statement not backed by strong will, according to insiders close to both Aregbesola and Governor Oyeta. Aregbesola jetted out of the country on the eve of the election, knowing fully well how his action would affect the governor.

In 2029, it was Aregbesola that came to the rescue of Oyetola when Adeleke almost defeated him.

So, when a former commissioner in the administration of Aregbesola said on the eve of the election that the minister’s supporters will still vote for Oyetola despite the feud, only a few took him serious.

The commissioner said: “As the Osun Governorship Election comes up tomorrow, we The Osun Progressives (TOP) have been inundated with calls, questions and demands for our position by the media and our supporters and enthusiasts.

“Fundamentally, we are unabashedly democrats of the progressive hue. We live its credo and our entire being is in it.

“Our association, a caucus within the State of Osun All Progressives Congress (APC), was founded last year when we alarmingly saw the direction our party was going.

“It was like the falcon could no longer hear the falconer. We were filled with trepidation on the tempest long foretold.

“We were at this junction before, in the run-off to the 2003 General election. We feared that history might tragically repeat itself except we acted selflessly and forthrightly. Like-minded members and leaders of the party, therefore, came together to form the group.\

“The administration of our leader, Ogbeni Rauf Aregbesola, produced a successor in Alhaji Gboyega Oyetola, against all odds, by snatching victory from the jaws of defeat.

“We worked hard on the mantra of continuity, the continuation of the giant development strides of the Aregbesola administration, which endeared the party to the people of the state, producing the victory that brought Governor Oyetola into office.

“As a caucus within the party, we have consistently made strident efforts at peace and reconciliation within our party. For this, we have only asked for one condition, which is inclusiveness.

“The State Governor and his henchmen, most regrettably, have turned his office and our party into a zero-sum game. You are either with them or against them.

“They rejected any idea of inclusiveness. They rebuffed all propositions for peace and reconciliation and not even a Councillorship position was ceded to any other section of the party outside of the Ileri-Oluwa caucus.”

In one of the reactions which trailed the outcome of the election,  Solomon Adewoye, an analyst notes that “Fighting those who brought you to power is dangerous. Everyone matters in politics, that’s why they say politics is a game of numbers.

“With Aregbesola foot soldiers in Osun politics, you don’t go into such election without settle matter with them. Sanisile and Adeoti from Iwo, Najeem Salam and Hussain from Ejigbo, Lasun Yusuf and Kolapo Alimi from Erin/ifon. These are Aregbesola’s loyalists and later worked against APC except Nojeem Salam.

“It happened in Ekiti during Fayemi first tenure, when MOB left the party for Labour. That’s why Fayemi lost the election then. Am sure next time, Oyetola will put his house in order. Everyone matters in politics.

In his own reaction, which sounds biblical Rauf Aregbesola says “This matter is by the decree of the watchers and the demand by the word of the holy ones : to the intent that the living may know that the most High ruleth in the kingdom of men and giveth it to whomsoever he will and setteth up over it the best of men.” – Daniel 4:17. The comment, in the Minister’s Twitter handle has generated 415 likes, 129 comments and 119 shares.

The last may not have been heard of the Osun State governorship election as the loser may not likely accept defeat humbly, there may be attempt to seek victory from the Courts.

The Independent National Electoral Commission (INEC) has declared Senator Ademola Adeleke of PDP as the winner of Osun 2022 governorship election.

The INEC Returning Officer for Osun 2022, Prof    of University of Lagos declared Adeleke winner on Sunday at the Commission Headquarters in Osogbo.

Adeleke secured 403,371 votes to defeat incumbent Governor, Alhaji Gboyega Oyetola who polled 375,027 votes.

FactualTimes reports that PDP won in 17 local government areas while APC emerged victorious in 13 local government areas.

Osinbajo Undergoes Surgery; Why He Was Absent At Osun APC Campaign Rally

Vice President Yemi Osinbajo has revealed why he was absent during the mega rally of All Progressive Congress, (APC) to support Governor Gboyega Oyetola reelection has been clarified.

Osinbajo was conspicuously absent during the APC campaign that paraded the party’s stalwarts such as Bola Tinubu, APC presidential candidate, Abdullahi Adamu, amongst others.

Some had even suggested that he was absent at the rally due to alleged disagreement with Tinubu over his choice of Kassim Shetima as his running mate.

Mixed reactions have  trailed Tinubu’s decision to pick the former Governor of Borno state to run with him in the 2023 presidential election.

But Osinbajo, in a post explained that he is on admission at an undisclosed hospital for a surgical procedure due to a leg injury.

The Vice President, who made the announcement via his verified social media accounts, said the injury was possibly sustained while playing squash.

“I have been admitted today at the hospital for a surgical procedure on account of a recurrent pain in the leg possibly sustained from an injury while playing squash,” the post said.

Osun: PDP Claims Victory; Warns Against Election Manipulation

It is not official yet, but the Peoples Democratic Party, PDP, Osun State Chapter, has claimed victory in the Governorship election held in the State on Saturday, July 16, 2022.

In a statement issued in Osogbo late Saturday evening, signed by the Chairman,  Caretaker Committee, CTC, PDP Osun Chapter, Dr. Akindele Adekunle, the Chapter said its candidate, Senator Ademola Adeleke, has overwhelmingly won the election. It also warned against what it called “any plot by some agents of chaos to doctor the results” The party asked the Independent National Electoral Commission, INEC, to watch “fifth columnists in its fold.”

“The Osun state chapter of the Peoples Democratic Party (PDP) has claimed victory in the ongoing governorship election , affirming that collated results from the polling units confirms PDP’s emerging victory at the poll, ” the statement reads in part.

The party noted that the victory of the party at the poll is a product of mass mobilisation and grand coalition of people of Osun state against bad governance and insensitive leadership.

While thanking people of Osun state for endorsing and affirming Ademola Adeleke’s governorship bid, the party sternly warned against any attempt to tamper with the result of the election.

“We want to assert that Ademola Adeleke has won this election overwhelmingly going by results at our disposal. We warn against any plot by some agents of chaos to doctor the results. We specifically call on the Electoral commission to watch fifth columnists within its fold who may have been contracted for hatchet job. Osun people have decided and their votes must be respected”, the statement noted.

The party specifically called attention of the Commission to an alleged paid agent of the State Government who is presently working round the clock to tamper with the results, vowing that any attempt to subvert the will of Osun people will be strongly resisted.

In one of the confirmed results, Adeleke defeated the incumbent Governor Gboyega Oyetola of the All Progressives Congress, APC, at the Government House Osogbo Polling Unit.

Uzodimma Appoints Enyinnaya Onuegbu Chief Political Adviser/ Head of Political Bureau

Governor Hope Uzodimma of Imo State has appointed pioneer Commissioner for Lands and Survey, Barr. Enyinnaya Onuegbu, as his Chief Political Adviser and Head of Political Bureau of his administration.

According to a statement signed by the Governor’s Media Adviser/Chief Press Secretary, Oguwike Nwachuku,  Onuegbu who had had a short stint as Commissioner for Power before the Governor dissolved his Cabinet which affected him, was unveiled on Saturday at a meeting where Governor Uzodimma addressed the All Progressives Congress candidates in Imo State.

His appointment takes immediate effect.

Onuegbu, an ex-officio member of the APC, is a committed member of the Party and has many years of active experience in legal practice.

He hails from Ngor Okpala Local Government Area of Imo State and, as the Traditional Prime Minister of his community, goes by the title Ebekuodike.

Governor Uzodimma expects Onuegbu to bring the weight of experience he has acquired in the traditional, political and legal institutions into the office he has just been appointed into and make a mark that will not only be irresistible but an envy to many.

LASG Shuts 19 Medical Facilities In Alimosho Over Malpractices

The Governor Babajide Olusola Sanwo Olu led administration in Lagos State has shut 19 Medical Facilities  in Alimosho Local Government Area of the State over alleged malpractices

The LGA is the most populous among the 20 LGAs and 30 Local Council Development Areas.

The state government through its Taskforce on Counterfeit, Fake Drugs and Unwholesome Processed Foods shut the said Medical Facilities around Igando-Ikotun for non-compliance to regulatory standards.

Prof. Akin Abayomi, the State Commissioner for Health, made this disclosure after reviewing report of the recent enforcement exercise carried out by the Taskforce, explaining that the affected medical facilities were sealed for various offences including; display of drugs for sales in unregistered and unlicensed shops by the Pharmacists Council of Nigeria (PCN); inappropriate storage conditions of drugs; handling and dispensing drugs by unskilled persons and the sales of drugs outside the approved scope.

He noted that the operation of the Taskforce is part of the state government war against fake drugs and illegal drug shops.

Abayomi stressed that monitoring and enforcement activities of the Taskforce has been rejigged to ensure that the provisions of the law on the operation of pharmacies and patent medicine shops is strictly adhered to, in order to safeguard the health of the citizenry.

Similarly, Director Pharmaceutical Services in the Ministry of Health, Oyebisi Omolambe, said that the state government will not relent in its efforts to stop the inherent dangers associated with the operations from unlicensed pharmaceutical outlets and drug shops.

“This closure is thus part of the Government’s renewed efforts to sanitize the drug distribution system and curb proliferation of fake drugs in the State” Omolambe said.

The enforcement and compliance raid by the State Taskforce on Counterfeit, Fake Drugs and Unwholesome Processed Foods was carried out in collaboration with the National Agency for Food Drug Administration and Control (NAFDAC), Pharmacists’ Council of Nigeria (PCN), Pharmaceutical Society of Nigeria (PSN), the Legal Unit of the Ministry of Health and the Police Officers from Environmental and Special Offences Unit (Task Force) of Lagos Police Command.

Ekiti: SDP In Crisis Over Alleged Imposition Of Senatorial Aspirant

Social Democratic Party, (SDP) in Ekiti state is embroiled in fresh crisis following an attempt to impose a senatorial candidate by some officials of the party.

The favoured candidate, Obafemi Adewale, a Senior Advocate, is one of the counsels handling the petition of the party’s governorship candidate at the tribunal.

In a petition to the leadership of the party, one of the senatorial aspirants, Sesan Arowolo claimed that  the  candidate is unknown to members of the party in Ekiti central senatorial district.

Arowolo stated that “I will start by saying, to whom much is given much is expected, betrayal was what I felt, my heart broken not just by a leader I was in love with, but also as I once believed, a true leader.

“I have worked tremendously for this great party without no fear of regret, but it is a surprise to the entire people of Ekiti Central Senatorial District and Ekiti State in general as this injustice uproar from the unthinkable.

“It is of note that in the process of joining this great party we all came as an aggrieved members, who had been victimized by the oppressors in APC and PDP.

“Now it sounds we are from “fry pan to fire” as this is the first time in the history of Ekiti, a none party member as at the time of our primary election will now be the party’s candidate.

“We are categorically saying, the imposition of Barr. Obafemi Adewale, SAN is a day light robbery on the people of Ekiti Central Senatorial District that will jeopardize all our efforts to build a formidable party of tranquility.

“We were told all will be transparent and democratic but the reverse is the case as the party cabal hijacked the structure in favour of their close pals in disguise of the court case.

“Without an iota of fear, distinguished leaders you gave us a criteria for the selection of preferred candidate, which are; winning of unit, ward, local government, posters, jingles and our financial contributions to the party’s project, therefore, how did a man who never showed interest in the Senate seat talkless of participating in the screening, primary election and now suddenly become a preferred candidate of the party?

“We write this to you, to outrightly condemn this ugly incident, notify you that Ekiti Central choice, Project 2023 campaign organization will never accept the charade called nomination.”

The petitioner specifically accused the governorship candidate of the party, Chief Segun Oni of being behind the imposition of his lawyer on the people.

“Your Excellency, you left APC because of injustice and unfairness, you left PDP because of imposition and injustice, we can not but say the truth is that, you who had been an advocate for justice and equality and, in tinkle of an eye changed because of personal gain.

“This has shown to the world, that your agitation is personal than Ekiti wish, as a result, we say it to you that, the past is bad and the present with you is unpleasant, but we will erase this horrible present to have a better future where people of good characters rule without pretence.”

Uzodinma to Imo Primary School  Teachers: Your Problem Is My Problem

Governor Hope Uzodimma has told primary school teachers in Imo State that he shares in the challenges they face in the course of discharging their duties and assured them that together they will get the problems out of the way.

The Governor spoke weekend at a meeting he had with heads of primary schools, their teachers and staff of State Primary Education Board in Imo State, at the Rear Admiral Ndubuisi Kanu Square in Owerri to find a lasting solution to the problems plaguing the sector.

The meeting was also an opportunity for the teachers and staff of IMSUBEB in the State to carry out their data and physical verification to enable the government implement reliable payment of salary, increment in salary,  promotion and general welfare structure for the primary school teachers.

While addressing the teachers, Governor Uzodinma acknowledged that they needed to be properly paid and on time too, as well as being motivated by government, but regretted that the pupils who are on the receiving end of the teachers services are not getting quality education because of the attitude of their teachers.

Governor Uzodinma therefore promised  to breach the gap by ensuring that the teachers are properly motivated with the provision of teaching materials, promoted as at when due among others  as soon as the data verification is in place.

He urged all the teachers to submit themselves for the verification and assist the government to get rid of ghost teachers collecting salaries they do not deserve.

He promised that genuine teachers will continue to receive their pay and that with the verification, those who have been left out in the past two years will be paid, even their arrears, after confirmation of their proper verification.

Governor Uzodinma used the occasion to inform the teachers that government has decided to introduce the Clock-in and Clock-out System in the primary schools and offices as a way of monitoring truancy and commitment among the teachers.

The Governor emphasized that his administration is poised to make public schools better than private schools hence his determination to encourage the teachers and to provide them with teaching aids for proper teaching and learning.

Governor Uzodinma said he will not play politics with schools and education generally in Imo State because “the children are the future of the State, the politics of the APC, PDP or any other Party should not be there problem, we must give them the best they deserve.”

He reiterated that he has come to correct the bad state of things he met on ground on assumption of office which include: providing light, water, good roads and accessible healthcare facilities as indices of prosperity.

He said the ideology of his administration is based on the fear of God,  aimed at making the people happy.  “I will be happy when my people are happy and this is my mission and angry when they are angry.”

Governor Uzodinma assured the teachers that the verification will guide his government on how to raise their pay as a way of mitigating the hardship everyone goes through in the State and the country at large.

“Your problem is my problem and your happiness is my happiness. I have come to serve you and I will serve you well. And by the Grace of God the Egyptians you saw yesterday you will see them no more today.”

Earlier in his remarks, the Commissioner for Education, Prof. Sylvester Okorondu, said the meeting was meant for data and physical verification capture for the teachers and staff of IMSUBEB aimed at ensuring that the State has “the right teachers in our schools so that they will enjoy smooth transition from salary payment of teachers to pensions payments when they retire.”

He informed that the exercise will go a long way in removing ghost teachers from the payroll of government “as government is making efforts to ensure that her teachers are made comfortable through prompt payment of salaries, procurement of teaching materials as well as sufficient books for schools in the State.”

In her address at the occasion, the Executive Chairman of Imo State Universal Basic Education Board (IMSUBEB), Her Excellency, Dr. Ada Okwuonu,  thanked the Governor for assisting IMSUBEB to wear a new look.

She said the Governor provided them with funds that made it possible for the establishment to come back to life through the restoration power supply, water supply and renovation of the entire structures and offices of the Board.

She also applauded the Governor for providing education materials to all schools including private ones in the State.

She informed that under Governor  Uzodinma, the State Government will soon commission nine ICT Centres in the three zones of the State for digital and E-Learning of Imo children, and acknowledged that the Governor had continuously approved counterpart funds to attract external funding from UBEC to Imo State.

The Chairman however appealed to the Governor to have compassion on genuine teachers who have been omitted in the salary payment for the past two years and bring them in and accommodate them in the monthly salary payment of the State.

The Deputy Governor of Imo State,  Prof. Placid Njoku, the Secretary to the State Government, Chief Cosmas Iwu, the Chief of Staff, Barr. Nnamdi Anyaehie, and other top government functionaries joined the Governor in supervising the verification.

Facts I have uncovered from the Independent National Electoral Commission (INEC) show that Labour Party’s Peter Obi may become Nigeria’s president next year by default because Bola Tinubu and Atiku Abubakar, candidates for the All Progressives Congress (APC) and the Peoples Democratic Party (PDP) respectively, have violated the Electoral Act 2022, which may cause them to be disqualified if Obi sues them.
The Electoral Act 2022 requires political parties to notify INEC of their intent to conduct primary elections at least 21 days before the date of their convention. It also requires parties to submit their membership registers to it at least 30 days before their primary election. The APC didn’t meet the first requirement and the PDP failed the second requirement. The Labour Party met both.
Documents an INEC insider shared with me (which you can find on my blog at www.farooqkperogi.com) show that the APC didn’t notify INEC of its intent to conduct its primary election 21 days before its convention. Section 82 of the Electoral Acts says the penalty for this infraction is outright disqualification of the candidates of political parties.
Section 82 (1) of the Electoral Act 2022 says, “Every political party shall give the Commission at least 21 days’ notice of any convention, congress, conference, or meeting which is convened for the purpose of ‘merger’ and electing members of its executive committees, other governing bodies or nominating candidates for any of the positions specified under this Act.”
Subsection (5) then says, “Failure of a political party to notify the Commission as stated in subsection (1) shall render the convention, congress, conference, or meeting invalid.” An invalid convention can’t produce a valid candidate.
Now, let’s look at how the APC, the PDP, and the Labour Party fared in their observance of this requirement of the Electoral Act.
Records at INEC show that the APC notified INEC of its intent to hold its convention on May 23, 2022 (before INEC granted it an unfair extension, which other parties also benefited from) and held its convention on June 8. That’s just 17 days’ notice, which falls short of the 21 days’ notice the Electoral Act 2022 requires.
Based on its May 23 letter to INEC of its schedule of primaries, the APC’s June 8 primary election is invalid in the eye of the Electoral Act 2022, and Bola Tinubu may be disqualified if he’s sued.
Unlike the APC, however, the PDP did give INEC more than 21 days’ notice prior to the conduct of its presidential primaries. It notified INEC of its intention to conduct its primary election on May 4 and conducted its primary election on May 28. That’s about 25 days’ notice, which puts it in the clear on this provision.
The Labour Party, like the PDP, complied with the requirements of Section 82(1) of the Electoral Act 2022. It notified INEC of its intent to conduct its primaries on March 9, 2022, and held its convention on May 30. That’s more than 80 days’ notice.
Then Section 77 (2) of the Electoral Act 2022 mandates political parties to submit their membership registers to INEC at least 30 days before the conduct of their primary elections.
It says, “Every political party shall maintain a register of its members in both hard and soft copy.” Subsection 3 also says, “Each political party shall make such register available to the Commission not later than 30 days before the date fixed for the party primaries, congresses or convention.”
The penalty for failure to abide by this provision of the Electoral Act is exclusion from participation in elections of the candidates of the political parties that infract the provision. Section 84 (13) Electoral Act 2022 says, “Where a political party fails to comply with the provisions of this Act in the conduct of its primaries, its candidate for that election shall not be included in that election for the particular position in issue.”
Now, let’s see how the APC, the PDP, and the Labour Party fared in this provision of the Electoral Act.
The APC submitted its membership register to INEC on 25 April and conducted its primary election on June 8. That’s clearly more than 30 days. So, it’s in the clear here.
But the PDP fell afoul of Section (3) of the Electoral Act 2022. Although an INEC document titled “Table of Submission by 18 Political Parties” shows that the PDP submitted its membership register to INEC on April 29, which would make it exactly 30 days since it conducted its convention on May 28, the PDP’s series of correspondence with INEC that an insider shared with me indicates that the party submitted its register in four installments, with the earliest being May 3. May 3 to May 28 is less than 30 days.
The last correspondence the PDP had with INEC over its membership register is dated May 18. So, technically, the PDP didn’t turn in its complete membership register to INEC until May 18. The Electoral Act makes no provision for a bit-by-bit submission of membership register.
The Labour Party abided by this provision of the Electoral Act. It submitted its membership register to INEC on April 25, which is more than 30 days before its convention, which was held on May 30.
Unfortunately, INEC erred in not notifying the APC and the PDP that their primary elections—and their candidates for election— were invalid because they flouted the Electoral Act. INEC erred even further by going ahead to publish the names of people who emerged from invalid primaries even when the Electoral Act mandates it to not include the names of candidates who run afoul of the Electoral Act.
Section 29 (1) of the Electoral Act 2022 says, “Every political party shall, not later than 180 days before the date appointed for a general election under this Act, submit to the Commission, in the prescribed Forms, the list of the candidates the party proposes to sponsor at the elections, who must have emerged from valid primaries conducted by the political party.”
Subsection 3 says, “The Commission shall, within seven days of receipt of the personal particulars of the candidates, publish same in the constituency where the candidate intends to contest the election.”
As I have shown, the candidates for both the APC and the PDP did not emerge “from valid primaries” because they contravened significant provisions of the Electoral Act that rendered their elections void. Yet INEC went ahead to publish the particulars of candidates for president and the National Assembly on June 24.
In other words, even INEC is in violation of the Electoral Act 2022, and this isn’t the first time it is. In its entanglements with the Ahmed Lawan and Godswill Akpabio senatorial nomination fraud, INEC also refused to exercise its power of rejection.
Section 84 subsection 13 of the Electoral Act 2022 empowers INEC to write to political parties and alert them to the fact that the names they sent to it were inconsistent with the reports of the primary elections monitored by its staff.  Had INEC done this, it would have obviated the need for litigation by candidates who have been shortchanged by their parties.
In response to an explosive and credible July 8 Sahara Reporters story (with which I was familiar days before Sahara Reporters published it) titled “Nigerian Electoral Body, INEC Succumbs to Pressure from Ruling APC to recognize Senate President Lawan as Yobe Senatorial Candidate, Moves to Destroy Electoral Commissioner’s Report,” INEC’s Festus Okoye issued a statement where he, among other things, claimed that INEC stood by the reports of its state monitors.
That was obviously not exactly true. One, if INEC did, it would have rejected names sent to it that were at variance with the names their staff recorded and certified. Second, the INEC headquarters in Abuja would not have denied Resident Electoral Commissioners the power to issue Certified True Copies (CTC) of primary elections. CTCs are centralized to Abuja creating needless bottlenecks in the process because, an INEC insider told me, it’s a conduit for corruption.
Anyway, section 285 of the constitution (4th alteration, no. 21) empowers any “aspirant who complains that any of the provisions of the Electoral Act” has been violated to seek redress in a court of law. Subsection b specifically confers the right on aspirants to sue if INEC violates the Electoral Act, which it serially has, “in respect of the selection or nomination of candidates and participation in an election.”
Subsection C extends that right to political parties. The Electoral Act itself gives candidates and political parties the right to sue to seek redress if the law has been violated.
So, if either the APC’s Bola Tinubu or the PDP’s Atiku Abubakar wins the 2023 election, their victory would be invalidated by the courts, and Labour Party’s Peter Obi may be declared president by default since he is likely to be in the top three performers in the presidential contest.
Of course, either Peter Obi or the Labour Party has to sue first for this to happen. And, although the invalidation of Tinubu’s and Atiku’s candidature by the court is a slam dunk, neither INEC, which should supply the evidence, nor the judiciary, which will give the judgement, is reliable. But the evidence is reliably strong.
There will also clearly be legal disputations about dates since the parties wrote to INEC on the same issue on several dates. But a lawyer called my attention to the Supreme Court’s July 5, 2019, ruling in the case of Garba v APC [2020] 2 NWLR (Pt.1708)345 at 360 where it excluded the date the cause of an action arose. It ruled:
“From the passage I have reproduced above (that is the Appellant’s originating summons)…I am satisfied that the cause of action occurred on the 7th of October, 2018. The appellant’s suit was filed on the 29th of October, 2018, 22 days (excluding the 7th October) after the conduct of the primary election. Clearly, the action was filed outside the prescribed period and it is therefore statute-barred.”
So, there’s plausible cause to invalidate the nominations of the APC’s and PDP’s candidates.
