Ayodele Fayose and Owoseni Ajayi

By Ayodele Oni

As things fall apart between former Governor Ayodele Fayose of Ekiti state and his estranged ex-attorney general and commissioner for justice, Owoseni Ajayi, Governor Fayose, was on Tuesday docked at the State High Court sitting in Ado Ekiti over alleged  N900 million indebtedness to his Aide.

Ajayi, who was Fayose AG during his first and second term tenures as Ekiti governor between 2003-2006 and 2014-2018, reportedly fell apart with Fayose for his refusal to endorse him as his successor.

The suit, filed by Ajayi on 17th December, 2018, with  number HAD/113/2018, the claimant, said he handled a total of 18 cases through his law chambers for the former governor, with each costing a sum of N50 million as professional fee, which he alleged were not paid for.

Ajayi said those cases were prosecuted for Fayose between 2006 and 2014, which bordered on his impeachment in 2006 and the corruption case filed against him by the Economic and Financial Crimes Commission, among others.

In the writ of summon deposed to by the claimant, Ajayi prayed the court for an order compelling Fayose to pay the professional fee without delay.

Ajayi also sought an order compelling the defendant to pay 20 percent interest on the debt from October 5, 2018 and 10 percent from the day of judgement.

Fayose in his preliminary objection, urged the court to dismiss the case on the premise that it was statute barred, improperly constituted and that the claimant failed to comply with the conditions precedent.

While being cross-examined  in court, Fayose, described himself as a  full time politician, and he admitted to his statement on oath of April 16, 2019 that the suit was ill-conceived and lacking the legal validity to fly.

Speaking on his relationship with the former AG, Fayose said;  “Yes, I knew him, he did some few works for me.

“Between 2006 – 2017, he was working with me and also keeping documents for me.”

Ajayi was represented by Barrister Bayo Idowu, while the former governor was represented by his counsel, Ahmed Tafa.

Justice L.O. Ogundana, the presiding Judge, adjourned to December 13, 2022,  when both parties would adopt their final replies and written addresses.

AGF Malami Renews FG’s Commitment To End Impunity, Undemocratic Cultures

Nigeria has been given a clean bill as the only country in the world where there is no impunity for crimes against Journalists.

The Committee to Protect Journalists’ (CPJ) report says Nigeria was the only country to get off the index of nations with impunity for crimes against journalists in 2020.

Attorney General and Minister of justice, (AGF) Abubakar Malami, SAN, who disclosed this in Abuja on Tuesday, stated that this was due to the Federal Government renewed commitment to end impunity for crimes against journalists.

“The 2020 global index for impunity for crimes against journalists by the Committee to Protect Journalists (CPJ), released on Wednesday 28th day of November 2020, indicated that Nigeria is the only country that came off the index from 2019.”

The AGF spoke in Abuja on Tuesday at the on-going occasion of the 2022 International Day to End Impunity for Crimes against Journalists with the theme: “Media, Civil Society and Violence-free Election in Nigeria”

Malami reiterated that President Muhammadu Buhari-led Federal Government is committed to bringing to an end undemocratic and uncultured activities in the country.

Malami  hinted that the feat would be achieved through the administration of legally justifiable approaches on the perpetrators in order to serve as deterrence to others.

The Minister revealed that the Federal and some State Governments have taken precautionary and proactive steps in taming the tides of undemocratic culture and activities.

He renewed his call on those still involved in electioneering process to appreciate the fact that political activities are to be observed in accordance with the provisions of the Electoral Law.

Malami requested them to join hand in making sure that all campaign utterances are humane and in conformity with global best practices, thereby contributing to violence-free electoral process.

“As the 2023 election campaign gathered momentum, we chose the theme of this celebration to revolve around “Media, Civil Society and Violence-free Election in Nigeria.”

“This proactive engagement has objective of enlightenment to shun electoral offences with the sole intention of making healthier processes at all levels of electioneering campaigns.

“It is important to note that recent developments in Nigeria proved that the Federal Government has laudable initiatives to end impunity for crimes against Nigerian citizens.

“This achievement is not unconnected with deliberate and committed efforts of the President Muhammadu Buhari led Federal Government through the implementation of many reforms in the Nigerian justice sector to include increased access to justice, speedy justice dispensation, decongestion of Nigeria’s correctional centers and judicious implementation of the Criminal Justice Act.

“Let me express our appreciation to our partners; the Management Conflict in Nigeria (MCN) programme of the European Union supervised by the British Council and the Kano State Government under the able leadership of Governor Abdullahi Umar Ganduje for their support to this programme.”

Why Police Cannot  Arrest  Tinubu Over Allegation Of Perjury –  IGP

Alkali Baba Usman - IGP

By Ayodele Oni

The Nigeria Police disclosed on Tuesday that the two petitions bordering on allegations of perjury and certificate forgery against the presidential candidate of the All Progressive Congress, (APC) Bola Ahmed Tinubu, had been adjudicated upon by Supreme Court in 2002 in a suit filed the late foremost human rights activist, Chief Gani Fawehinmi.

The Police therefore, claimed that the APC) candidate, has no pending petition or criminal matters with Police in anywhere in the country.

Inspector General of Police, Alkali Baba Usman also clarified that Tinubu is not a suspect to the Nigeria Police, hence, cannot be put on trial.

These were contained in a counter affidavit to a suit filed by a Civil Society Group, seeking order to compel the IGP to prosecute Tinubu for perjury and certificate forgery, filed at the Federal High Court in Abuja by a counsel, Wisdom Emmanuel Madaki.

IGP insisted that Police have no power to prosecute Tinubu without any known offence committed.

He, however admitted having two different petitions from a Civil Group, Incorporated Trustees of Center for Reform and Public Advocacy, requesting for arrest and prosecution of Tinubu for alleged perjury and certificate forgery related offences.

The affidavit averred that since the alleged perjury and certificate forgery had been resolved by the Supreme Court, there was no need for police to reopen the matter again.

Besides, the IGP said that police does not need any court order to make arrest and prosecute since it derives its powers from the Constitution and statutes.

IGP therefore asked the Federal High Court to dismiss the suit brought against him and the Nigeria Police Force for want of merit and jurisdiction adding that the plaintiff will not be prejudiced if the suit is dismissed.

Specifically, the IGP asserted that the suit on the alleged perjury and certificate forgery is frivolous and vexatious and deserves no  attention of the Court.

However, at Tuesday’s proceedings, counsel to the Civil group, Mr Eme Kalu Ekpu told Justice Inyang Edem Ekwo that the counter affidavit of police had just been served on him and that he needed  time to peruse it and reply to it formally.

Ekpu asked Justice Ekwo to grant him a short adjournment to enable him react to the counter affidavit properly.

In a brief ruling, Justice Ekwo granted the request and fixed January 19, 2023 for hearing of the suit.

The Incorporated Trustees of Center for Reform and Public Advocacy had dragged the IGP before the Court over his alleged refusal to prosecute the presidential candidate of the APC over allegations bothering on perjury.

The suit dated and filed on July 4 on behalf of the group in Abuja by Mike Nwankwo, has the Nigerian Police Force and the Inspector General of Police as 1st and 2nd respondents.

Godwin Obaseki

By Ayodele Oni

African Network for Environment and Economic Justice, (ANEEJ) has tasked the Edo State Governor, Godwin Obaseki, over the non-passage of the state government’s draft Freedom of Information Bill (FOI).

Innocent Edemhanria, the programme manager of the NGO who  disclosed this at a press briefing in Benin City stated that the NGOs are working with eight others on a petition over the issue to the Governor.

“We have had engagement meetings with some stakeholders both state and non state actors to join us in this advocacy effort.

“We will sustain such advocacy efforts and engage more stakeholders to support our advocacy issues.”

Edemhanria, who lamented the non-passage of the FOI bill by Edo State and several other states in the country, noted that the passage of FOI by state Houses of Assembly and subsequent assent by the various state governors will help deepen transparency and accountability in governance.

He urged states that are yet to domesticate the FOI bill to emulate Ekiti and Imo states, where the governors have enacted their own state FOI laws.

He emphasized that if states have their own FOI law, it will also bring to an end the raging controversy about the applicability of FOI Act at state level where several groups both within and outside Edo State are now in court.

The programme officer pointed out that Edo State government is yet to domesticate the Freedom of Information (FOI) Act, 10 years after it was signed into law by ex-President Goodluck Jonathan.

According to him, there is the need to draw the attention of Mr Obaseki, to the draft of the Edo State FOI Bill and appealed to the governor to revisit the draft bill and present it to Edo State House of Assembly as an executive bill for consideration.

Edemhanria, explained that the Edo draft bill, prepared by the Ministry of Justice, between 2016 and 2017, during Obaseki’s first tenure, had been subjected to consultation with  governance Partnership (OGP) framework.

By Adesina Soyooye

The Osun State Chapter of the Peoples Democratic Party, PDP, has suspended all political activities over the death of Ifeanyi, the three year old son of star musician, David Adeleke, popular as Davido.

Davido is the son of Deji Adeleke, the quiet financier of the Party in the State. The Governor elect, Senator Ademola Ifeanyi Adeleke, is Davido’s uncle. Davido named his son after the Governor-elect. Davido is also a Youth Ambassador of the PDP.

The young boy drowned Monday evening in the swimming pool at his father’s residence in the high brow Banana Island area of Lagos State.

Already, the Lagos State Police Command has arrested eight Domestic Staff members, including Ifeanyi’s nanny in order to know the circumstances surrounding the boy’s drowning. His parents were away to Ibadan when he died. He was said to have been underwater for a long time. By the time he was seen, it was late. He was confirmed dead, on arrival, at the Ever Care Hospital.

A statement issued by the Osun State Chairman, Caretaker Committee of the PDP, Dr Adekunle Akindele,  reads: “Following the death of Ifeanyi, all party activities are hereby suspended to commiserate with the  family of Adeleke.

“We mourn the sorrowful exit of our son, Ifeanyi. We pray for the repose of his soul. It is a sad day, but we remain steadfast in our fate in the Lord of the Universe.

“Our condolences goes to Davido, our Youth Ambassador. We commiserate with our father-figure, Dr. Deji Adeleke, and the entire Adeleke family.

“We pray the good Lord grants the family the strength to bear this irreparable loss.”

Ifeanyi, expectedly, will be buried in Lagos on Tuesday, 1st November, 2022.

The Lagos State Police Command has arrested and quizzed eight Domestic staff members of star Musician, David Adeleke, popularly known as Davido, over the death of his Son Ifeanyi Adeleke.

The three year old drowned in the family’s swimming pool at their Banana Island Residence, Lagos.

The Eight Domestic Staff of the award winning artistes were brought to the Station for questioning.

This was disclosed by the Lagos Police Public Relations Officer, Benjamin Hundeyin. He said that the domestic workers’ narrations would assist the Command in ascertaining the circumstances surrounding the death of the late Ifeanyi.

It was gathered by this news medium that none of the arrested domestic staff would be released until after investigation. However, anyone not found culpable of any negligence would be released.

He added that anyone of them found culpable of negligence would be held back to assist the Command in the ongoing investigation.

Hundeyin: “His (Ifeanyi’s) death is confirmed. His (Davido’s) domestic workers have been brought in for questioning and anybody found not culpable will be allowed to go immediately.

“About eight of them were brought in to narrate their version of what happened to assist us in getting what really happened.

“At the end of their narrations, whoever that is found not guilty of negligence or not culpable in anyway will be allowed to go.

“Anybody found culpable will stay back to assist us in further investigation. The domestic workers are about eight that were brought in.”

However, a lot of celebrities have been commiserating with both Davido and Chioma Rowland over the demise of their son, by posting cryptic messages that appear to confirm the death of Ifeanyi. Comedians Ayo Makun and Lasisi Elenu, radio personality Daddy Freeze among others have commented on the tragic event.

Makun, in an Instagram post early Tuesday, wrote, “The death of a child is unnatural, unfair, and tragic, this hit me so bad.”

Daddy Freeze, who went live on Instagram in the early hours of Tuesday morning said, “When the person you love is someone involved it becomes a heavy emotional burden. I am not confirming anything but bear with me I will not be live tonight.”

Lasisi Elenu also posted, “Father heal your children’s heart from this pain, strengthen them in such a dark and hurtful time oh Lord.”

Reality TV star and actress, Rosemary Afuwape, said on her Instagram story, “My heart can’t take this. This is so painfully unbearable. Chioma and Davido please accept my condolences. No amount of words can comfort your hearts. I am truly sorry for your loss.”

As of 1.28am, news of Ifeanyi’s rumored death was the most trending topic on Twitter.

The rumored death, however, emanated from a now deleted post from actress, Eniola Badmus, late Monday.

Nigerians, while reacting to Badmus’ post, criticised her for leaking such sensitive information to the public.

British rapper and singer, Stephanie Allen, popularly known by her stage name Stefflon Don, took to her verified Twitter handle to pray for the singer. She tweeted, “Prayers for Davido and Chioma.”

Actor, Williams Uchemba said, “Please say a prayer for David, Chioma and the entire family. Nobody deserves this kind of pain. Rest up little one.”

Muyiwa Ademola via his Instagram handle said, “It is one of the saddest thing when kids are being buried by parents. We really wish it never happened! May The Almighty give the parents and the entire Adeleke family the strength to bear this loss. Rest In Peace Champ.”

Actress, Iyabo Ojo mourning said, “I don’t even know how to react to this rude shock. I was hoping it wasn’t true. My God!!! This is so shocking, sad, devastating & extremely painful.”

OPINION: Let Tinubu And Obi’s Classmates Campaign For Them

0

By Amanze Obi

Mr. Festus Keyamo, the spokesman of the All Progressives Congress (APC) Presidential Campaign Council, is about to introduce an interminable process in our presidential campaigns.

He has just challenged the son of the presidential candidate of the Labour Party, Mr Peter Obi, to organize a successful rally for his father in Anambra State as the son of Bola Tinubu, the presidential candidate of the APC, has done in Lagos State.

The challenge is not just absurd, it is infantile through and through. It leaves every rational mind wondering whether the presidential contest is about Obi and Tinubu or their sons.

This set-up invokes compulsive questions. When did our political order get so debased that it can admit of such bland irrationality? When will some of these fellows who call themselves presidential spokesmen grow up? Must they descend to the pit of unreasonableness to justify their hire?

I hardly pay attention to inanities, believing as I do that sillines, in whatever variety it comes, should be underserving of the attention of the serious-minded. But, sometimes, idiotic tales have a way of dragging the unsuspecting out. Some people are just addicted to fishing in troubled waters. That is what some of these presidential spokesmen are doing.

They have, in some cases, practically made themselves agents provocateurs. They hunt for trouble so as to be seen to be doing something for their paymasters.

The other day, it was Mr. Femi Fani-Kayode, the man whose convoluted portfolio in the Tinubu campaign is still a subject of light-hearted jibes.

Fani-Kayode had railed freely at Peter Obi for not responding to comments or remarks by Tinubu’s spokesmen. In his fury, Fani-Kayode is still asking Nigerians who the hell Peter Obi, a presidential candidate, is for refusing to join issues with spokesmen who are not not contesting any election. What cheekiness.

But as the likes of Fani-Kayode pine away for no good reason, Obi has repeatedly said that he will not talk to Nigerians by proxy. He will engage them directly. He wants the people to hear from him and assess him on the basis of who and what he is. With that, they will connect more with him and his message. They will also be in a position to hold him accountable in the future.

That has been Obi’s approach. He wants other presidential candidates to do the same. In fact, he has been telling the people to reject any candidate who talks to them by proxy.

Of course, there is a whole world of sense in the Peter Obi approach. Those who aspire to lead the people should not sit askance. They should be involved. They have to make themselves part of the everyday conversation aimed at putting the country on the right track.

Anybody who has a good idea to share with the people in this regard will be very glad and willing to do so. Knowledge goes with passion. Those who know are usually eager to connect with the right audience. But aloofness, the type that some of the presidential candidates are displaying , smacks of either lack of ideas or disdain for the people or a combination of the two.

Refusal to engage the people may also be a complex syndrome. It betrays a certain lack or inadequacy on the part of those running away from their critical and mainstream audience. Such inadequacy necessarily leads to withdrawal or escapism.

Unfortunately, those who aspire to pilot the country’s ship of state can ill afford this luxury.

Let us return briefly to Keyamo’s challenge.

What was he thinking about when he decided to call out Obi’s son? Is the presidential contest now a family affair so much so that Obi’s son has to square up with Tinubu’s son?

If we go by Keyamo’s approach, we will soon see Obi’s daughter slugging it out with Tinubu’s daughter. After that, Obi’s wife and Tinubu’s wife will enter the ring.

The contest will even graduate beyond them. Obi’s kinsmen in Agulu, Anambra State, will have to face Tinubu’s kinsmen from – Keyamo should tell us. When we are done with that, Obi’s classmates from Christ the King College, Onitsha, will join issues with Tinubu’s classmates from – who will tell us? Then, of course, Obi’s course mates from the University of Nigeria will be called out to face Tinubu’s course mates from…until we know the university. The matching game will almost be interminable as the two candidates will be matched on everything and anything imaginable.

Is that what Festus Keyamo is aiming at? Who sent him? Who commissioned him? Has he prepared his candidate for this rigorous process?

Rather than shooting from pillar to post, as some of the spokesmen are doing, they should stop to think of the challenges bedeviling the country.

For a country that has become so badly fractured, what plans do the candidates have about getting Nigerians to begin to believe in their country again? How will they deal with the despondency in the land?

A lot of Nigerians have given up on their country. What magic wand does each of the candidates have to restore the lost confidence of the people in their country? What about the hydra-headed problem of insecurity? What will those who aspire to lead the country do differently? The economy of the country has collapsed.

The purchasing power of the naira has declined to an all-time low. These are just a few of the challenges facing the country. Our candidates should be put on the spot so much so that they cannot run away from these nagging issues.

Unfortunately, the so-called presidential spokesmen are shooting aimlessly at imaginary enemies. They have, by their approach, reduced the campaigns to an exercise in mudslinging. Somebody needs to tell these presidential spokesmen that the presidential contest is not about them.

It is about the candidates. Each candidate owes the Nigerian people the responsibility to sell himself and his message. Nobody can do it on their behalf.

So far, Obi appears to be the only candidate that is selling his candidature at every turn. He does not shy away from anything or any situation. Some people call him a mobile billboard. He is found everywhere. That is why he is not bothered about the discriminatory restriction placed on campaign billboards in places like Lagos.

Does a man who is boldly advertising himself and his message need the sheer symbolism represented by billboards? I do not think so.

Amechi is Dead; Buhari’s Promise To Him Unfulfilled

0
Mbazulike Amechi

By Adesina Soyooye

Chief Mbazulike Amaechi is dead. According to a release by his family, he died Tuesday morning, 1st November, 2022.

Accomplished in all spheres of life, including the gift of old age, Amechi, who was Nigeria’s first Aviation Minister, died with one of his greatest desires unfulfilled.

In his last months on Earth, he worked assiduously for the release, from custody, of the Leader of the Indigenous Peoples of Biafra, IPOB, Nnamdi Kanu.

In his desire for that, in a rare action by a man his age, he led a delegation of a few prominent Igbo men to State House, Abuja, to appeal to President Muhammadu Buhari for Kanu’s release.

In a passionate appeal, he asked the President to release Kanu to him as a favour before his (Amaechi’s) death. He promised to rein Kanu in if done the favour.

Even though Buhari promised to consider the request, difficult as he said it was, he never fulfilled the promise to the old man. Instead, the Buhari-led Federal Government has tightened its hold on Kanu, Court judgements for his release notwithstanding.

Amaechi who was in his 90s was a foremost Zikist, and until his death, the only surviving one.

A statement released Tuesday morning by his family, signed by Ezeana Tagbo Amechi, confirmed he died in the early hours of Tuesday, November 1, 2022.

The statement reads: “With total deference to the will of the Almighty God, the Ume Amechi, Ezeana Ihinede families and the Umu Mmara kindred of Amihe Ukpor in Nnewi South Local Government Area of Anambra State announce the peaceful transition of our illustrious son, father and grandfather, Chief Mbazulike Amechi (Dara Akunwafor), Nationalist and First Republic Minister of Aviation of the Federal Republic of Nigeria, who transitioned peacefully in the early hours of today November 1, 2022.

“We thank God for the fulfilled life that he lived, the lives that he touched and his service to God and Country. We respectfully ask that you keep us in your prayers”

He hailed from Amihe village in Ukpor, Nnewi Local Government Area of Anambra State.

Yoruba Group Applauds Pa Fasoranti’s Stand On Tinubu

Bola Ahmed Tinubu and Reuben Fasoranti

By Ayodele Oni

Despite mixed reactions from prominent leaders, the Yoruba Ronu, a group within the South-west, said the reception of the Presidential candidate of the All Progressive Congress, (APC) Bola Tinubu by Pa Reuben Fasoranti, former leader of the Afenifere, “has proven beyond doubt that the interest and the unity of purpose of the Yorubas comes first before any other thing.”

The Yoruba social political cultural group, Yoruba Ronu lauded Fasoranti for his dogged determination to see to the unity of the Yoruba race and the actualisation of Asiwaju Bola Ahmed Tinubu presidency in 2023.

Chairman of the group, Prince Diran Iyantan, while reacting to the reception, in a statement, in Akure, Ondo state,  noted that “Baba believes we are Yorubas before we are Nigerians.

“Therefore, the aspirations and wishes of the people of the Yoruba race should take preeminence at all times. That is what he has demonstrated by endorsing the candidacy of Bola Ahmed Tinubu in the coming presidential election.

The statement, signed by Steve Otaloro, director of communications of the group, added that “This singular action of the leadership of the Afenifere group has deepened the sense of the average Yoruba man on the unity of the Yoruba race.

“Pa Fasoranti’s action has renewed our hope in the existence of the common interest of the Yorubas for a better tomorrow for the Yorubas and for all Nigerians.

“What our nation needs at the moment is someone who can build a team that will work wonders in the country. One of the criteria for this is to secure a president that when he does other things, the team can carry on with its assignment without much supervision.

“The only man who fits such description amongst the present contestants is Asiwaju Bola Ahmed Tinubu. He has a record of identifying the appropriate men and women to build such a great team as mentioned.

“We believe in his capacity to unite our nation and bring about rapid development.

“Indeed, we, at Yoruba Ronu, also project the view that Asiwaju Bola Ahmed Tinubu is best placed to win the presidential election.

“This was the reason we are the first group to declare our support for him immediately he declared his intention to run for the presidency.

“The request of Afenifere leaders on restructuring was well noted as Asiwaju Bola Tinubu presented his manifesto to Afenifere leader, Pa Ruben Fasoranti. We see restructuring and devolution of powers as gateway solutions to so many problems.

“However, this can only be done in partnership with the North. Obviously, the North has the majority in population and that weighs in to the balance of victory in the forthcoming election.

“The Northerners would only yield ground to a man they can trust, who can make it come to pass the better tomorrow as projected.

“This is why amongst the trio of TInubu, Atiku and Obi; only Tinubu has the gut, has earned the trust of the North, and is in the position to act the desired role to achieve the great country that Nigerians crave.

“What should gladden the mind of the Afeniferes and the Yorubas in general is the RENEWED HOPE Asiwaju Bola Ahmed Tinubu represent.

“This is the first time someone who was an apostle of June 12 and who fought for this democracy has a chance to lead the democracy he fought for.

“Where were these so called ‘frontline candidates’ during the struggle for democracy? One thing that is certain is that they will all contest this election, lose and congratulate Tinubu on his victory at the end of the day.

“Asiwaju Bola Ahmed Tinubu has built a lasting goodwill. He has acquired good friends. He has built bridges across the length and breath of the entire country to secure him victory come February 2023.”
