SERG Carpets APC Over Nominees For Elective 10th National Assembly Leadership

Urges North Central, Opposition Lawmakers To Dislodge APC Anointees

Pan-Igbo sociopolitical pressure organisation, the South East Revival Group (SERG) has frowned at the incoming executive’s interference in the choice of the elective leadership of the 10th National Assembly through the ruling All Progressives Congress (APC), urging opposition lawmakers and the “excluded North Central to work together with other aggrieved political blocs to elect leaders of the 10th National Assembly based on competence, justice and equity.”

In its reaction to the nomination of individuals as preferred lawmakers for various elective legislative offices in the incoming National Assembly, the SERG in a statement signed by its President and National Coordinator, Chief Willy Ezugwu, the pro-Igbo group noted that “the list released by the APC shows clearly that the party has learnt no lesson from its politics of exclusion in since 2015.”

The National Working Committee (NWC) of the APC had on Monday announced the zoning of the leadership of the 10th National Assembly.

According to a statement by the National Publicity Secretary of the APC, Felix Morka, the zoning arrangement as reported to the party’s NWC, indicated that the Senate President — Senator Godswill Akpabio (South-South, Akwa Ibom); Deputy Senate President — Senator Barau Jubrin (North West, Kano;  Speaker of the House of Representatives — Hon. Abass Tajudeen (North West, Kaduna); and Deputy Speaker —Hon. Ben Kalu (South East, Abia).

The SERG noted that “the announcement of the zoning arrangement after a so-called consultations and meetings held with the President-Elect, Bola Tinubu, and other stakeholders is an effort to impose a rubber stamp national legislative leadership on the lawmakers.

“Micro-zoning the elective offices to individuals has tactically arm-twisted the members of the National Assembly and denied them the constitutionally guaranteed right to choose their leaders from among themselves.

“The party threw justice, equity and rule of law to the wind by not only excluding the South East from the Senate Presidency but also gave zero allocation of elective slots to the North Central zone.

“We therefore call on the opposition parties and the excluded regions to form a formidable alliance and elect principal officers of the 10th National Assembly in the interest of good governance and the well-being of the masses”, the SERG said.

Ali Ndume, a ranking Senator representing Borno South Senatorial District has disclosed that Senator Godswill Obot Akpabio remains the preferred Candidate to vie for the Senate Presidency seat of the 10th Assembly, but not the anointed candidate.

Speaking on a Television Programme, ‘The Morning Show’ on Arise Television, Ndume said that Akpabio was only a preferred choice of the party which did not make him the automatic leader of the House, adding that the senators would still have to vote to determine the leader of the red chamber.

“I don’t think anointed is the right word to use. The APC has Akpabio as its preferred candidate, that would be a better word.

“Not anointed but preferred candidate. Because if it is anointed then it is fait accompli, which is not the case. We have to go into the chamber and vote, and it can go anywhere.

“Akpabio is going to be first among the equals as president of the senate. It is going to take the remaining 108 of us to restore integrity to the Senate,” he said.

It would be recalled that on Monday, 8th May, 2023, reports that Akpabio was nominated for Senate President, while the party nominated Abbas Tajudeen as the Speaker of the House of Representatives went viral.

The leadership of the Party is yet to comment on this development as the Senators from the South East have called on the President Elect to look into the direction of the region in choosing the next Senate President.

In a spirit of sportsmanship, the Osun State chapter of the All Progressives Congress (APC) has congratulated the state Governor, Ademola Adeleke over his victory at the Supreme Court in Abuja.

The party, in a statement, said it received the verdict of the Supreme Court which affirmed Ademola Adeleke’s victory with equanimity and placidity, bearing in mind that in a contest, someone must emerge the winner.

It however said: “While we are congratulating the beneficiary of the judgement, we make bold to state that we shall not be found wanting in playing our expected opposition roles in order to keep the government on its toes.”

The state Acting Chairman of the APC, Sooko Tajudeen Lawal, was quoted in a statement issued by the party’s Director of Media and Information, Kola Olabisi, that the Supreme Court decisions are final which cannot be challenged in any other court of the land.

Lawal pointed out that as a democratic political body that solely believes in the rule of law, there is no way that we can fault the judgement of the Supreme Court, which is the highest court in the land even though we are not happy with the judicial decision.

According to the statement: “The members and supporters of our party should refuse to be downcast with the current political situation in the state as the nature of politics is that one doesn’t win all the times.

“The prevailing condition of the winner(s) of today does not make him the perpetual winner as the political office which was contested for is a tenured one for a period of four years, after which we shall have the opportunity to slug it out with those who are rejoicing over today’s victory.

“It is however, worthwhile to state that our party and our candidate, former Governor Gboyega Oyetola, might have lost the election as it was pronounced by the apex court of the land, but it is visible to the court of the public that they never lost the battle.

“That Osun State is a common patrimony is the reason why we are assuring the PDP and the government that we shall be meeting in the trenches when it’s constitutionally ripe to do so.”

Ademola Adeleke

While reading the judgement, Justice Emmanuel Agim also  held that the Court of Appeal correctly set aside the decision of the Tribunal as there is no way Oyetola could depend on only the information of the back end server and not look into the voters register which forms a foundation of the electoral process in any polling unit.

The Apex Court held that the respondents findings in the issues of BVAS was that there was over voting in only six polling units which didn’t affect the emergence of Ademola Adeleke as the Governor-elect.

The Court, while dismissing the Appeal on Adeleke’s qualifications held that the Oyatola’s appeal collapsed for failure to prove his case beyond reasonable doubt as it is not enough to point out issues of certified documents without making findings to back up the claims.

Supreme Court: Adeleke victory, justice prevailed over falsehood …S’West PDP

In a congratulatory message, the PDP South west zone, described the Supreme Court ruling validating the election of Adeleke as the validly elected Governor of Osun State as a triumph of people’s mandate over falsehood.

The PDP South West Zonal Publicity Secretary, Sanya Atofarati in a press statement, lauded the judiciary as the last hope of the common man by the historic judgement, which has clearly demistified the lies and falsehood of the APC.

“The Supreme Court ruling confirming Senator Ademola Adeleke as the validly elected Governor of Osun State during the July 16, 2022 governorship election in the state was a clear indication that judiciary has once again proved to be the last hope of the common man as the judgement indicated that Senator Adeleke won the election fair and square.

“The good people of Osun State should be commended for their steadfastness and unalloyed love for the PDP and their governor as and demonstrated uncommon support for PDP against open display of intimidation, harrassment and violence as recorded in the last few months.

“The PDP thus viewed the historic victory of Governor Adeleke as a triumph of people’s mandate over falsehood perpetrated by the APC in 2018 leading to the installation of an impostor and unpopular governor.

“But the vulture is a patient bird, such that the table turned around four years after when Governor Adeleke’s stolen mandate was recovered.

“The South West hereby felicitates with Governor Adeleke for his doggedness, tenacity and will power praying that the light that he represents will illuminate  in Osun and eliminate the dark alley of maladministration unleashed on the good people of Osun State in the past 12 years

“It is our sincere hope that the judiciary will in the like manner correct the illegality perpetrated by INEC in the Presidential election at the ongoing Presidential Election Petition Tribunal.”

Osun: Victory At Last For Adeleke; Supreme Court Upholds His Election

By Ayodele Oni

It was dancing and jubilation in towns of Osun state on Tuesday as the Supreme Court affirmed Ademola Adeleke of the Peoples Democratic Party, PDP, as the elected Governor of Osun State.

Oyetola and his party, approached the apex court in a suit numbered, SC/CV/510/2023, praying the court to set aside the decision of the Abuja Division of the Court of Appeal, which voided the judgment of the Osun State Election Petition Tribunal, which returned Oyetola as winner of the November July 16, 2022 governorship election.

Oyetola and APC in their case filed at Supreme court on their behalf by their lead counsel, Prince Lateef Fagbemi (SAN), want the apex court to determine whether the appellate court was right “in declaring as nullity the judgment of the tribunal delivered on January 27 notwithstanding the earlier resolution of the same court that Section 294(1) of the Constitution is inapplicable to a tribunal”.

INEC had declared Adeleke as winner of the 16 July 2022 governorship election, having scored  majority of the votes cast in the election.

The tribunal in its split judgment of two-to-one delivered in January, held that Oyetola and not Adeleke won a majority of the lawful votes in the election.

Oyetola and his party, approached the three-member tribunal panel to challenge the victory of Adeleke on the ground that there was over voting.

Justice Tertsea Kume led-tribunal, had on January 27, in a split decision of two-to-one, voided the declaration of Adeleke as winner of the governorship election that held on July 16, 2022.

The development triggered the Adeleke and his party, to approach appeal court, prayed the appellate court to set aside the verdict of the Osun State Governorship Election Petition Tribunal, which sacked him from office.

The court, which found Adeleke’s appeal meritorious and allowed it held that the lower tribunal was “wrong to reach the conclusion that there was over-voting during the state governorship election held on 16 July 2022″.

Justice Mohamed Lawal Shuaibu, who delivered the unanimous judgement held that, “the lower tribunal was wrong to have come to the conclusion of over voting based on the document presented by the first and second respondents (Oyetola and APC) and also on Exhibit BVR, which requires demonstration in public court”.

The Court of Appeal noted that Oyetola and the APC “did not tender the voters’ registers and Bimodal Voters Accreditation System (BVAS machines,” which captured data of eligible voters at the Osun governorship election and held that the foundation of what transpired at the polling units would only be established by the evidence that is contained in the voter register and BVAS machines, which are the foundation of any election.

Aside from setting aside the judgement of the lower tribunal, the appellate court awarded N500, 000 cost against the APC and its candidate, Gboyega Oyetola.

Delivering judgment a five-member panel of the apex court held that the court of appeal correctly reinstated Adeleke as governor.
