N30bn Facebook vs. FG Suit: Court Fixes Hearing Date

The N30 billion suit filed against Meta owners of Facebook and Instagram and WhatsApp by the Advertising Regulatory Council of Nigeria, ARCON, is set to be heard this month by the federal high court in Abuja, The Punch reports.

The Director-General of ARCON, Olalekan Fadolapo, made the disclosure, saying the Council is doing all within its power to curb the illegal activities of the social media powerhouse.

The Council had sued Meta for illegally exposing advertisements to the Nigerian market through its various platforms.

ARCON is seeking a declaration among others that the continued publication and exposure of various advertisements directed at the Nigerian market through Facebook and Instagram platforms by Meta Platforms Incorporated, without ensuring the same is vetted and approved before exposure is illegal, unlawful, and a violation of the extant advertising Law in Nigeria.

The agency claimed that huge revenue has been lost by the federal government as a result of unvetted adverts by Meta.

Fadolapo stated that the court had granted ARCON a leave to serve a writ of summons to Meta, adding that the writ was served at the company’s United States corporate headquarters.

He said the decision to serve the company at its corporate headquarters became necessary after Meta claimed that it did not have any physical office in Nigeria.

According to him, “The case is coming up this October, because the level of shenanigans that is happening in that place (Facebook) is too much. But trust me, we will use all legal means to sanitise that space.

“What we are saying is that what they are showing to the Nigerian audience, which is our territorial space is indecent. We will not go and regulate the media in the US, but what we will do is regulate the media space here in Nigeria.

“They said they don’t have an office in Nigeria, but they are doing business in Nigeria. So, we are not concerned about their office, we are concerned about the business they are doing in Nigeria. If you are doing business in Nigeria, you are supposed to abide by Nigerian laws.”

The suit was first instituted in October 2022.

$2.4bn Oil Deal: Dieziani-Madueke Faces Extradition

The Economic and Financial Crimes Commission, EFCC, has disclosed that it has started the process of extraditing Dieziani Alison. Madueke, a former Minister of Petroleum.

Recall that the federal government said in February this year that the United Kingdom government rejected its extradition request for the former minister.

Alison Madueke is wanted in Nigeria for an alleged loss of over $2.4bn in Revenue from the Illegal Sale of 48 million Barrels of Crude in 2015 Including Crude Oil Exports from 2014 while she presided over the ministry.

The former minister under the President Gooolduck Jonathan Administration was last week arraigned in a London, United Kingdom court for 100, 000 pounds bribery allegation.

She has been granted a 70, 000 pound bail by the district judge, Michael Snow.

Dele Oyewale, the spokesperson for the EFCC said the commission welcomed the former minister’s arraignment, saying she still has questions to answer in Nigeria over alleged corruption while she served in that administration.

He stated that an arrest warrant had already been issued to that effect, adding that everything would be done to bring the former minister to answer to the law.

According to Oyewale, “The EFCC welcomes, with keen interest, the arraignment of former Minister of Petroleum Resources, Diezani Alison-Madueke, at the Westminister’s Court in London, United Kingdom, following alleged bribery allegations.

“Although the charges preferred against her at the London court, are diametrically different from the 13 counts, bordering on money laundering that the EFCC has raised against her, it is instructive to note that criminality is criminality, irrespective of jurisdictional differences. No crime can go unpunished. The money laundering charges for which Madueke is answerable to the EFCC, cover jurisdictions in Dubai, the United Kingdom, the United States of America and Nigeria.

“To bring the former Minister to trial in Nigeria, an arrest warrant has been obtained and extradition proceedings have been initiated. The commission is on course on her trial. She will soon have her day in our courts.”

While answering questions in the House of Representatives in February, an Assistant Inspector-General of Police and Head of the National Central Bureau, INTERPOL Nigeria, Garba Umar, on Thursday, said the UK had refused to send the former minister back to the country for prosecution.

Umar said, “The issue of Diezani, a warrant of arrest was issued. I am sorry to say the government of the UK turned down our request. We followed the MLA – you can check, that is Mutual Legal Assistance – to bring her back home. She went to court because, according to them, they have a system where they check our…let me not go there.”

Speak Up On Tinubu’s Certificate Scandal, Soyinka Told

The Neo Africana Centre has asked the Nobel Laureate, Prof. Wole Soyinka, to join the controversy trailing President Bola Tinubu’s claim of having attended and obtained a certificate from Chicago State University (CSU) in the United States of America. The public policy think tank said it is uncharacteristic for Soyinka, a sucker for controversies, to look and act disinterestedly over an issue in which he should, ordinarily, be interested in.

This is much more so considering the fact that Soyinka has, through his recent interventions, left nobody in doubt that he is an interested party in the outcome of the 2023 presidential election.

It wondered why a Wole Soyinka who has a reputation for insistence on transparency and accountability in public office is sitting askance while the shadiness and duplicity surrounding the background of Bola Tinubu is embarrassing the Nigerian presidency and tearing the polity apart.

In a statement by its Director of Public Affairs, Jenkins Udu, the Centre asked Soyinka to speak up on this national embarrassment, reminding him of his own dictum that the man dies in all who keep silent in the face of tyranny. It argued that nothing can be more tyrannical than imposing falsehood- such as false educational claims- on the people and insisting that they must swallow it hook, line and sinker.

It, therefore, urged Soyinka to step out of his closet and take a stand on the controversy surrounding Tinubu’s status at CSU.

The statement reads in part:

“We have observed with a measured degree of disquiet the embarrassing tales around President Bola Tinubu’s claim of attending and obtaining a certificate from Chicago State University in the United States of America. Most curious about this is Tinubu’s application to the university and the court that his academic records should not be released. This move by the president to shield his academic records from the public is suspicious and embarrassing.

“It leaves us asking whether there is anything he is hiding from the public. The controversy is, to say the least, messy.

“It is disconcerting that Tinubu has been evading and blocking inquiries into his past records. The opaqueness of his past is one of the grounds on which his election as president is being challenged in court. The legal fireworks in the United States on whether to release or not to release Tinubu’s academic records is an embarrassment to Nigeria. It is a matter for disgrace that the public records of Nigeria’s first citizen is shrouded in secrecy. This is unacceptable.

“Nigerians want nothing but transparency and openness in governance.

“We had expected all this while that the Nobel Laureate, Prof. Wole Soyinka, the apostle of transparency and accountability in public office, would speak up on this. But this is not the case. Instead, he has maintained a studied silence.

“We are constrained to say that Soyinka’s silence on this important national issue is unhealthy. Why has he suddenly lost his voice especially in the light of the fact that he has been speaking lately about his conviction that Bola Tinubu won the 2023 presidential election. We expect Soyinka to deploy the same alacrity with which he has been defending Tinubu’s controversial mandate on his even more controversial educational background especially at it concerns his affiliation with CSU.

“Soyinka’s continued silence on this matter is not only suspicious, it is hypocritical.”

Why Labour Unions Suspended Strike Action

Relief came the way of the Federal Government and Nigerians late Monday morning when the Nigeria Labour Congress, NLC, and the Trade Union Congress, TUC, suspended their planned nationwide indefinite strike.

The Unions had planned to start the strike which promised to ground Nigeria to a halt on Tuesday, October 3, 2023. They advised Nigerians to stock up as the action was going to be a long haul. It followed a dispute which arose after the Federal Government withdrew subsidy on fuel which condemned the masses to unprecedented hardship as the cost of everything went haywire and out of the reach of the poor.

But, on the eve of the beginning of the strike, the Federal Government managed to convince the NLC, led by its National President, Joe Ajaero, and the TUC led by its leader, to a full discussion.

It is not the first time such meetings would be held, but the FG manages not to keep to the agreements. This time, however, seeing the seriousness of the Unions, and the effect the strike was going to have on Nigeria’s fragile and wobbly economy, the Federal Government promised to keep to the letter the Memorandum of Understanding it signed with the Unions late Monday.

With the MU signed by both parties,  Labour and FG, the Unions have suspended, for 30 days, the planned National Strike.

Following is the Full text of the MU and Terms of Agreement signed by the parties.

MEMORANDUM OF UNDERSTANDING REACHED BETWEEN THE FEDERAL GOVERNMENT OF NIGERIA AND THE NIGERIA LABOUR CONGRESS (NLC) AND TRADE UNION CONGRESS OF NIGERIA (TUC) AS A RESULT OF DISPUTE ARISING FROM WITHDRAWAL OF SUBSIDY ON THE PRICE OF PREMIUM MOTOR SPIRIT (PMS) ON MONDAY, THE 2ND DAY OF OCTOBER, 2023

Arising from the withdrawal of subsidy on Premium Motor Spirit (PMS) by the Federal Government and the resultant increase in the price of the commodity, the Nigeria Labour Congress (NLC) and the Trade Union Congress (TUC) issued a strike notice which had elapsed and they were poised to embark on a strike billed to commence on Tuesday, the 3rd of October, 2023.

Consequently, a meeting was called by the Federal Government to avert the strike and after much discussion, the following agreements were reached:

  1. The Federal Government grants a wage award of N35,000 (thirty-five thousand Naira) only to all Federal Government workers beginning from the month of September pending when a new national minimum wage is expected to have been signed into law.
  1. A minimum wage committee shall be inaugurated within one month from the date of this agreement.
  1. Federal Government suspends collection of Value Added Tax (VAT) on Diesel for six months beginning from October, 2023.
  1. Federal Government accepts to vote N100 billion for the provision of high capacity CNG buses for mass transit in Nigeria. Provisions are also being made for initial 55,000 CNG conversion kits to kick start an auto gas conversion programme, whilst work is ongoing on state-of-the-art CNG stations nationwide. The rollout aims to commence by November with pilots across 10 campuses nationwide.
  1. The Federal Government plans to implement various tax incentive measures for private sector and the general public.
  1. On the leadership crises rocking the NURTW and the purported proscription of RTEAN, the Federal Government commits to handling Labour matters in line with relevant ILO Conventions and Nigerian Labour Acts. A resolution of the ongoing impasse is expected by or before October 13.
  1. The issue of outstanding Salaries and Wages of Tertiary Education workers in Federal-owned educational institutions is being referred to Ministry of Labour and Employment for further engagement.
  1. The Federal Government commits to pay N25,000 per month for three months starting from October, 2023 to 15 million households, including vulnerable pensioners.
  1. The Federal Government will increase its initiatives on subsidized distribution of fertilizers to farmers across the country.
  1. The Federal Government should urge State Government through the National Economic Council and Governors Forum to implement wage award for their workers. Similar consideration should also be given to local government and private sector workers.
  1. The Federal Government commits to the provision of funds as announced by the President on the 1st of August broadcast to the Nation for Micro and Small Scale Enterprises. The MSMEs beneficiaries should commit to the principle of decent jobs.
  1. A joint visitation will be made to the refineries to ascertain their rehabilitation status.
  1. All parties commit to henceforth abide by the dictates of Social dialogue in all our future engagements.
  1. The NLC and TUC accept to suspend for 30 days the planned Indefinite Nationwide strike scheduled to begin, Tuesday, the 3rd of October, 2023.
  1. This Memorandum shall be filed with the relevant Court of competent jurisdiction within one (1) week as consent judgment by the Federal Government.

Obaseki Picks 182 Aides, Less Than 365 Days To Exit

Edo State Governor, Godwin Obaseki, has inaugurated  new 182 aides less than a year to the end of his administration.

They include 34 Senior Special Assistants (SSAs) and 152 Special Assistants (SAs) drawn from five Local Government Areas of Edo South Senatorial District.

While addressing them on Monday, the Governor charged them to be the bearers of truth and complement the government’s efforts at driving development in the grassroots.

Obaseki said the appointees were selected from Ikpoba-Okha, Oredo, Ovia South West, Ovia North East, and Orhionmwon local government councils in Edo South Senatorial District.

He promised that appointees from other two Local Government Areas that make up the Senatorial District will be announced as soon as the party finalizes the selection of credible members that are worthy of the appointments.

The Governor disclosed that, “Out of the seven local government areas from Edo South, we are appointing SSAs and SAs from five local government areas.

“The reason is that we are trying to foster unity and inclusiveness in our party so that all are given the opportunity to participate.

“Those local governments we have not accepted their list are those local governments where work is still in progress. We are insisting that the leaders must agree and confirm that the people who are nominated are people who are faithful, worked for the party, and have the capacity to work for the governor.

“One of the key criteria for appointment is that you must be resident in that local government as you can’t be a political appointee in absentia.

“Gone are the days when you get an appointment and go abroad, it can’t happen again. You have to be resident in your local government.

“You need to be there to know what is going on so as to help us develop the local government and State.

“You all are my appointees, you work for me not the local government. We are working in all the wards in Edo State; we have teachers, health workers, and many others as we work together to develop the State. We want people on the ground to communicate to the people what we are doing and also want feedback from them.

“This is not a fancy appointment but involves real work this time around. You have SSAs who you work with and will coordinate your activities and give me a monthly report of what is going on.

“You must show me your contacts and relationship with the people and show me the medium of communication to ensure a real impact in all the wards.

“You all belong to our party as your appointment is based on the fact that you belong to our party and must show commitment towards that. You must promote the interest of the party. The people have decided to follow our party and it showed at the last local government election in the State.

“I am passionate about the poorest of the poor in the State, let me know those who can’t feed and eat in your various local governments to enable the government to send palliative measures to them as we must care for our people.

“We must know those children that can’t go to school. We must know the state of our schools. We pay civil servants to work and want you to be our eyes to know those who are really working.

“We want unity in our party because we are in charge and the party to beat. Election is coming and politicians will throw all sorts of lies to discredit our party.

“Your role is to put things in the right perspective as you are the bearers of the truth of what the government is doing and make sure you are there to correct any lies they put out there.

“You must counter all the lies they put out on social media. I have faith in you to do well and accomplish the goal set out for you.”

Niger Part-Pays N500 Million NECO Debt

To prevent its students from being blacklisted by the examination body, Niger state has commenced offsetting part of the N500 million debt it owes the National Examinations Council, (NECO).

Already, the state has paid  N120 million  for its Senior Secondary School Certificate Examination (SSCE) candidates.

The state Commissioner for Information and Strategy,  Hajiya Binta Mamman, disclosed this in Minna on Monday, saying “We inherited N500 million from the previous administration as SSCE fees.

“Governor Umaru Bago approved a standing order of monthly payment of N30 million to NECO to offset the debt. We have paid N120 million since May 29 when this government assumed office,’’

She listed priority areas of the state government as education, security, science and technology, agriculture, commerce, tourism, civil service, health and infrastructure and urban renewal.

Mamman also listed local government administration, traditional institution, revenue generation and women and youth development as other priority areas.

She appealed to traditional and community leaders to contribute their quota to intelligence gathering to help tackle insecurity in the state.

She said traditional and community leaders played critical roles in the lives of the citizens, adding that intelligence reports from them was critical in maintaining security.

Mamman said government has repositioned the traditional institution by restoring its dignity when he paid sallah homage to the eight emirates across the state.

According to her, instead of the usual Sallah visit by the traditional rulers to the governor, the governor decided to visit them.

She solicited the support of the traditional rulers to enable the present administration to actualize its dream of transforming the state into an enviable New Niger State.

She added that as part of efforts to address security challenges, the governor donated 20 operational vehicles to security agencies to checkmate proliferation of illicit drugs and curb other forms of crimes in the state.

Nigeria @ 63 : Primate Ayodele Says Nigeria’s  Leaders Are Failures

As the Nation celebrated its 63rd Independence Anniversary, Leader Of INRI Evangelical Spiritual Church, Primate Elijah Ayodele, has said there is nothing worth celebrating, as the Nation has failed to grow economically, financially, spiritually and otherwise.

Ayodele said that it is shameful and disheartening that the nation is still at its infancy even at an old age of 63.

He said the reason for this stunted growth in all facets of life is not far fetched, as the Leaders that have paddled the affairs of the Nation till date are all failures.

In a statement signed by his media aide, Osho Oluwatosin, the Prophet explained that Nigeria has nothing to show for the 63rd independence due to bad leaders that are ruling the country.

He stated that issues like economic hardship, insecurity, inability to afford basic amenities are preventing the people to experience the dividend of democracy and independence, therefore, bondage is still fully around Nigeria.

Primate Ayodele urged leaders in the country to go to God because nothing feels right in the country. He bemoaned the inability of the country to live up to her status as the giant of Africa, noting that other smaller countries in the continent are doing better than a 63 year old country.

‘’Our leaders must go to God, ruling without leadership in Nigeria will run to jeopardy. This government needs to sustain Nigeria by creating employment, making the economy better because there is terrible hardship. The significance of the government attracts four things and they are security, economy, international relations and our natural resources. If this government isn’t careful about it, they will fail. For them not to fail it, they must take steps.

‘’This government doesn’t need noise, Nigerians need to feel the impact of democracy and independence. In the real sense, we are not independent yet, our independence doesn’t give us freedom, we are still staying in bondage. The economy is hard, there is insecurity, people are dropping out of school, let them not raise false hopes. This government is making promises that can’t be fulfilled, they need to do things that are realistic and will help the people enjoy independence better.

‘’Spiritually, Nigeria needs prayers, the structure of the country is shaking, we are not an independent nation yet. We are not giant of Africa, some small countries run 24 hours lights in Africa but we are nowhere to be found.’’

He placed the retrogression of the country on the leaders’ obstinacy towards the word of God. He posited that they don’t listen to divine advice and the truth. The Prophet urged the Government to take the issue of rule of law and human rights seriously. He reiterated the need to work on the economy to avoid a tougher situation next year. He also underscored the importance of agriculture and the need to apply the right formula to combat economic hardship.

‘’God knows everything, He knows if things won’t be rosy but this government will never listen to divine advice. If you are telling them the truth, they won’t want to listen and also, we should look at our rule of law and human rights, the government will not want to take it seriously. The government will believe they are second to God, our natural resources will not be used to get money and in the next year, the economy will be tougher if the government doesn’t do anything.

‘’In the next one year, standard of living will be very costly in urban and rural areas, government will try in the aspect of infrastructure, the government will not get it right if they don’t apply the right formula for the economy, this government must not encourage thuggery, the government need to encourage agriculture to combat hunger.

‘’The government should bring out the blueprint that will make the country better and begin to work on it. At 63, we have nothing to show for our independence, no good drainage, students are out of school because of exorbitant prices. If this government fails to rule with the fear of God, there is no way they will prosper. ‘’

Furthermore, Primate Ayodele advised the government on things to focus on to have a better outing in the coming year.

‘’Nigeria’s 63rd anniversary is nothing to write home about, we have continued to swim in failed governments. God needs Nigeria to be an example and lead Africa but we are not getting it right. This government should focus on road, light, employment, payment of salaries, utilization of mineral resources, security, and look after the future of our youth. The government should stop all these ceremonial display and do what is needful.

‘’As we celebrate 63 years of independence, the government should increase salaries, create industries, let those in government do their job and not make noise. Nigeria needs God to survive, we should practice what we preached during campaign.

‘’I wish the country more years to come; I wish our president more strength. Long live the federal republic of Nigeria.’’

Peter Obi Says Fuel Subsidy Is Fraudulent, An Organized Crime

Peter Gregory Obi, Labour Party, LP, Presidential Candidate, has said that Fuel Subsidy is an organized crime and fraudulent, prompting him to emphasize on its removal.

The former Anambra State Governor said that during his campaign for the February 25th Presidential Election, he had stressed that removal of fuel subsidy was necessary for the growth and development of the nation.

Obi made this disclosure on Monday while speaking on Arise TV ‘The Morning Show’ on what approach he would have taken differently in resolving the looming strike by the Nigeria Labour Congress, NLC and Trade Union Congress, TUC.

He said, “Fuel subsidy is organised crime. I said it repeatedly that it should be removed. For me, the approach would have been,  remove the corruption and criminal side of it and remove the excess demand.

“By doing this, you would have reduced it by 50 per cent. The remaining 50 per cent is what we would have been able to, after consultation with various stakeholders in order to find a way in an organised manner, remove and show the proceed of the gains of the removal to be invested in critical development areas.”

He, however, stressed that as the nation marked its 63rd Independence Anniversary, he fells positive about the future of the country.

Alison-Madueke Charged For Bribery, Appears Before UK Court

Diezani Alison-Madueke, former Minister of Petroleum Resources under former President Goodluck Ebele Jonathan administration has been charged for alleged bribery  in the United Kingdom.

Alison-Madueke appeared before the Westminster Magistrate’s Court, London, following an investigation by the United Kingdom’s National Crime Agency, NCA, which leads the country’s efforts to combat serious and organised crimes.

It was alleged by the NCA that Alison-Madueke accepted bribes during her tenure as the Minister for Petroleum Resources in exchange for awarding multi-million-pound oil and gas contracts.

The charges specified that former Minister benefitted from various perks, including cash, chauffeur-driven cars, private jet flights, luxury holidays, and the use of multiple London properties.

The rewards also encompassed financial benefits like furniture, renovation work, payment of private school fees, and gifts from high-end designer shops.

It would be recalled that there were calls from different quarters for the repatriation/extradition of Alison-Madueke to Nigeria to face charges leveled against him by anti graft agencies bothering on corruption and other related charges.

But due to the dual citizenship of Alison Madueke, where she is also a citizen of Nigeria and Dominican Republic, it became a herculean task for her extradition to come to reality.

Breaking: Tribunal Sacks Governor Abdullahi Sule, Declares PDP Candidate Winner In Nasarawa State

The Nasarawa State Governorship Election Petition Tribunal Sitting in Lafia, Nasarawa State Capital, has sacked Governor Abdullahi Sule of the All Progressives Congress, APC, and declared Peoples Democratic Party, PDP, Governorship Candidate, David Ombugadu as the winner of the March 18th, 2023, election in the State.

Delivering  judgment virtually, Chairman of the Tribunal, Justice Ezekiel Ajayi, declared Emmanuel Ombugadu of the PDP as the lawfully elected Governor of Nasarawa State.

In the ruling delivered on Monday, two of the Justices agreed that the election was won by the PDP while one Judge dissented.

Justice Ajayi had maintained that the petitioner was able to prove his case beyond reasonable doubt.

Governor Sule was seeking re-election for a second term but faced stiff opposition during the election, and polled a total of 347,209 votes to defeat his closest opponent, PDP’s Ombugadu, who secured 283,016 votes.
