Embattled Central Bank Governor, Godwin Emefiele, has accused the federal government of disobeying the court order that granted him bail recently.
Recall that Emefiele was finally arraigned in court three weeks ago after being detained for close to two months by the Department of State Services, DSS.
He’s being prosecuted for illegal possession of firearms.
The suspended CBN Governor has now described his continued detention as ‘brazen disobedience’ to the rule of law, saying the, DSS has no reason to further detain him, after Justice Nicholas Oweibo of the Federal high court, Lagos had already granted him bail to the tune of N20 million on July 25.
On Wednesday, one the counsels to Emefiele, Victor Opara, a Senior Advocate of Nigeria, SAN, said the former CBN boss has filed an
application at the federal high court for him to be discharged of all the allegations against him by the DSS.
In the application, Emefiele is praying the
court to stop the Federal Government from further prosecuting him on the charge of illegal possession of a firearm and ammunitions or on any other charge whatsoever.
He said except the DSS released him in line with the court order, the court must not entertain any further charges against him by the DSS.
The application, according to his legal team, was filed pursuant to Section 6(6)(a) of the 1999 Constitution (as amended), relevant sections of the Administration of Criminal Justice Act, 2015 and under the inherent powers of the court.
Emefiele asked also prayed the court not to entertain any charges until his application demanded his freedom from the DSS is dealt with, including an order of the court allowing him to be remanded in the custody of the Nigerian Correctional Services.
The federal government had filed an application on August 3 asking the court to stay execution on the order remanding the embattled CBN boss with the NCS.
Three weeks ago, the DSS was seriously criticised after its men were involved in a scuffle with officials of the NCS at the premises of the Federal high court, Lagos in their bid to take Emefiele to custody.
Â
The DSS has since launched an investigation into the matter.
